Regular Meeting
Aspen Planning & Zoning Commission February 11, 1969
Meeting was called to order by the Chairman at 5:05 p.m. with the following
members present:

JANSS SUBDIVISION
Mr. Whitaker and Mr. Molny reported they could see no problems in approving
this preliminary plat after visiting the site.
Molny made a motion to approve the Janss preliminary subdivision plat
as submitted subject to the following conditions being met: road 40'
with no requirement forpaving, fee access to Meadows Road of 20' which
will belong to lot #2, a committment to the Metro District to provide
sewer to the 3 bottom lots to the satisfaction of the Metro District
engineer, and dedication of 1/2 of the Meadow's Road to the City. Seconded
by Mars.
Discussed the dedication of theother 1/2 of Meadows Road.
Roll call vote - Whitaker aye; Mars aye; Molny aye; Heneghan aye.
Commission instructed City Engineer Roger Mahnke to check into who the
owners are of the other half of Meadow's Road and then hold this information
in abeyance until the City receives a decision on the North Side Annexation.
PUBLIC HEARING - SUBDIVISION REGULATIONS
Chairman Heneghan opened the public hearing. Francis Whitaker stated he
would like to see the road width reduced in areas where there are rough
terrain and large lots and require additional off street parking.
Excerpt from letter received from Mayor Barnard was read by Chairman
Heneghan as follows: "I feel very strongly that we should not allow street
widths to be pinched down to mere lanes relying on the hope that people
will park their cars off the street. Historically, this has not hap~ened
nor do I think it will happen here. As one looks over the country as a
whole, one cannot but be impressed with the foresight of the planners in
Salt Lake City as opposed to, let us say Denver. In the case of the latter,
two way travel on some residential streets east of Broadway is almost
impossible with cars parked on both sides of the street."
Mr. Whitaker also suggested a performance bond be required as relates to
paving so that the streets can be paved say from 3 to 5 years later.

Mr. C. M. Clark stated in Jefferson County under their regulations, you
could not put your final plat on record, which met that lots could not
be sold, till the City or County Engineer approved the paving and it met
all the specifications forpaving.
Mr. Whitaker further stated these regulations say nothing about selling the
land, also it would be a hardship on the subdivider to have to pave the
streets prior to final approval, a performance bond would be a better
arrangement.
All members agreed a matter of years would be necessary for settling
of the ground before paving is done.
Mr. Clark suggested rather than a performance bond, the subdivider put
the funds into an escrow account to the City.
Chairman Heneghan read the remainder of Mayor Barnard's letter as
follows: "I think it would be a grave mistake to force the subdivision
developer to hard surface his streets within one year or any other
prescribed time limit. With no way of controlling the type of surface
to be used or the equipment that would be used to mis and lay it, one
shudders to consider what the resulting conglomeration of paving would
be. I can readily imagine how two or three blocks of street would
be "paved" if there was no asphalt laydown machine in the area at the
time. I think it would be far better to require the street to be an
improved gravel street with no hard surfacing. In that way, your
service cuts could settle so that when the City came along with a
paving district, the gravel street would be ready for good high quality
surfacing, whatever form it might take.
I think a topographical map should definitely be a part of the subdivision
application so any problem areas in the terrain may be spotted ahead of
time."
Commission agreed the requirement of a topographical map should be
included in the regulations.
Chairman Heneghan stated these subdivision regulations show no imagination.
Mr. Whitaker suggested that the subdivision regulations should require
that all utilities be stubbed in so that the streets would not have to be
torn up after paving - water, electric, sewer, telephone, cable, etc.
Mr. Whitaker volunteered to work with Administrator Wurl and City Attorney
Albert Kern to get all these things desired by the Commission included in
the regulations.
Commission request the Secretary obtain a copy of Jefferson County's
subdivision regulations as soon as possible.
Mr. Clark stated the Jefferson County Subdivision Regulations relate their
rood widths on rough terrain to whether it is a south or north exposure.
Chairman Heneghan closed the public hearing.

Chairman Heneghan stated he had put this on the agenda and request the
members of the Commission think strongly about this as it fits in with the
whole picture of density, scale control, height of buildings etc. Mr.
Heneghan request this be put on the next agenda.
MEETING TIME
Mr. Whitaker suggest the Commission change the meeting time to the first
meeting of the month at 5:00 p.m. and the second at 7:00 p.m. Beginning
at 7:00 would allow the Commission more time to get into these problems
which are presently under consideration. Discussed if these study sessions
should be open to the public. Agreed to open the meetings to the public
but to limit comments from the floor.
Whitaker made a motion to change the by-laws of the Commission to provide
for the second Tuesday of the month meeting of the Commission to commence
at 5:00 p.m., the fourth Tuesday of the month meeting of the Commission
to commence at 7:00 p.m. Seconded by Molny. All in favor, motion carried.
CORRESPONDENCE
Secretary Graves submitted a memo to the Commission showing the publications
available from the State Planning Office, free of charge. Commission
request the Secretary obtain copies of L-5 Cities and Towns/Planning
and Zoning for each Commission member.
Mayor Barnard arrived.
Robin Molny gave the following report resulting from his attendance at the
County Planning and Zoning meeting:
Edgar Stanton will be the representative from the County to attend the
City P & Z meetings. Secretary to send copies of minutes and agenda.
Mr. Whitaker request permission to leave, permission granted by Chairman
Heneghan.
Mr. Cunningham on the golf course property is requesting permission to build
200 units, of 1200 sq.ft. per unit at the southwest side of Red Butte.
This would require re-zoning.
L-P Gas, United Lumber and Rio Grande presented a proposal on 4 acres for
3 businesses, steel buildings, near the L-P Gas Office on Highway 82.
Learned that the State Highway might enlarge the highway to 4 lanes and
move it south of the airport.
Mr. Huebinger presented a proposal involving 50 acres for an industrial
site on Owl Creek near the Sam Stapleton ranch.
There will be a public hearing scheduled on these proposals as oon as
the County receives a report from Trafton Bean, State Highway Department
and Mrs. Paepcke's Planner, Weiss.
Mr. Molny also reported he had talked to D. R. C. Brown relating to
saturation of Aspen Mountain and was told by Mr. Brown that for good
quality skiing this mountain has just about reached its saturation point.
Also no immediate plans have been made to increase the base service area
of the mountain.

General discussion followed relating to density, scale control and
height of buildings. Mayor Barnard also suggested, as relates to
parking and transportation, that the City bar all traffic south of
Durant Street.
Mayor Barnard request to be excused, permission granted by Chairman Heneghan.
Mr. Clark ask that the Commission consider discussing underground parking
at the Ruby Park site, due to the fact, construction is contemplated for
this year or next.
Heneghan made a motion to adjourn at 6:45 p.m., seconded by Molny. All in
favor, meeting adjourned.
