Study Session Aspen Planning & Zoning Commission February 18, 1969 Meeting was called to order by Chairman Heneghan at 7:00 p.m. with the following members present: Chairman George Heneghan Robin Molny Francis Whitaker Dale Mars Yvan Tache Building Inspector William Kestner City Engineer Roger Mahnke ABSENT: Mayor Robert Barnard - see late arrival Councilman John Benninghoff - excused INVITED GUESTS: City Attorney Albert Kern Frank Ducote - Planner Jack Walls - Architect Janver Derrington - Architect Robert Sterling - Architect Bruce Sutherland - Architect Mr. Jack Walls representing the local architects outlined the proposals of incline plane system and Barnard proposal in graphic form as prepared by the local architects showing the maximum of each proposal. Mayor Robert Barnard arrived. Graphs were prepared on a one half block basis. Mr. Janver Derrington outlined the Whitaker proposal. (See attached.) Mr. Jack Walls explained that the architects while working on this project came up with some ideas, presently in rough form. This proposal was outlined by Robert Sterling. (See proposal attached.) Mr. Sterling also stated the figures used in this proposal are arbitrary figures. Discussed the different proposals. Also discussed the extent of authority by State Statute the City has in regulating the size of buidings and the location on a piece of land of a building. Mayor Barnard contended the City does have the authority to regulate where a building can be placed on a piece of land. City Engineer Mahnke showed the Commission a projection as relates to view of the mountain and height of buildings. He also stated you will obtain better quality by going up as a different type of construction is required as height increases. Attorney Kern stated you cannot review where a building sits on a lot. But you can make laws that will force them to build in a certain way. Can require that open space be either north and south or east and west. Molny read the revised proposal by Tom Benton. (See attached.) He also stated with the Barnard proposal there is a problem with site line control- where do you put the buil~ on the lot. Study Session, P & Z, 2/18/69, continued. floor ratio, certain amount of sq.ft. per unit, already includes a bonus plan all we lack is a better definition of open space. Also recommend not considering the AR-l area at this time. Mr. Whitaker questioned Attorney Kern if the size of a building could be controlled. Mr. Kern reported there were no cases,ito his knowledge, in Colorado but felt that it could be done. Mr. C. M. Clark stated he had worked further with Barnards proposal and figured you could get 2 floors of 100' x 180' from lot line to lot line and 5 stories of 90' x 100' on top of the first two floors. This would give you the first floor entirely commercial, second floor mixed commercial and residential, 4 floors of residential and top floor restaurant. Mayor Barnard left for house call. Frank Ducote statedhe did not feel the problme had been defined as yet. Need a complete survey for a plan which considers traffic, passage, view light etc. Mr. Sutherland pointed out view and light can be obtained by free areas running north and south, this can be handled with set backs. Mr. Walls questioned the Commission if there would be any good in pur- suing the architects proposal, submitted graphs and checking the figures used further. Chairman Heneghan questioned khen an ordinance would be effective if passed by Council on first reading February 24th. Attorney Kern and Secretary Graves stated with an emergency clause would be effective on March 18th. City Engineer Mahnke reported there have been no large projects submitted to the inspection department to his knowledge as of this date, also he knew of no large projects on the boards. Molny made a motion to request the City Council to reschedule the public hearing of February 24th to the earliest possible subsequent time. Seconded by Tache. It was pointed out the earliest date COU9cil could reschedule for would be March 10th. Roll call vote - Tache aye; Molny aye; Mars aye; Whitaker aye; Heneghan aye. Tache left the meeting. Attorney Kern stated he had his doubts as to the legality of requiring commercial space and the dividing of land into parcels. Mr. Kern also reported to locate a building on a site, this could be done by set backs, open space and area requirements. Chairman Heneghan questioned Mr. Stanton of the County Planning and Zoning if high rise buildings had been discussed for the low lands behind N? S ~ '- , . Mr. Stanton reported high rise has been discussed for the areas where the mountains come up such as the base of Smuggler Mountain. where they would not inter fer with view. Molny made a motion to amend his previous motion to include, "because the problem is too complex and have not had sufficient time to come up with a recommendation for Council". Seconded by Whitaker. All in favor, motion carried. Commission agreed to meet on February 24th at 7:00 p.m. to finalize a proposal for Council. Attorney Kern reported Council will not be able to take action till a final recommendation is made by Planning and Zoning. Whitaker made a motion to adjourn at 9:20 p.m., seconded by Molny.
