Special Meeting
Aspen Planning & Zoning
March 10, 1969
Special meeting was called by Vice Chairman for 1:00 p.m. to consider
revision to the scale control and height proposal presented to Council.
Special meeting was called to order by the Vice Chairman at 1:30 p.m. with
the following members present:
Vice Chairman Robin Molny
Councilman John Benninghoff
Francis Whitaker
Dale Mars
Absent:
Chairman George Heneghan- excused
Mayor Barnard - excused
Yvan Tache - unexcused
Vice Chairman Molny stated part of the City Council objected to the height
stipulation of 10 stories and asked that this be restudied and sent back
to Council. Revision puts on a maximum of 7 stories keeping the same
percentage of open space. Vice Chairman Molny outlined the following:
1. - 40% allowable floor space MUST be 2 stories (minimum)
2. Remainder can be in structure or structures up to 62' in height.
3. - 25% open space required
4. - Seven stories maximum 72'
Mr. Molny also stated the floor area ratio stays the same and feel that
the bonuses are alright the way they are. If Councildesires to go any
less on the height, the open space requirement would have to be changed.
Mr. Whitaker stated he felt the principal is good but reiterated again that
density should be considered.
Mr. Mars stated he felt the density would not be increased that much.
Mr. Benedict questioned what the big hurry was and he agreed with Mr.
Whitaker that there are other factors involved such as density which
need to be thought out.
Mr. Whitaker pointed out there is question as to the legality of the require-
ment of 50% commercial space, that again can affect the entire picture.
Questiobed if you need the requirement of open space with the bonuses.
No bonuses and not go any higher. In other words, do we need to have
a bonus for public way and arcade with the 25% open space.
Question was raised if planned unit development had been considered which
is a form of design control and found to be legal in Colorado. It was also
pointed out that if the Planning and Zoning is involving in economics this
should be pointed out. By going higher, your construction costs are
higher which means the square foot rental price or prices will go up.
Land values will go up and as soon as that happens, we're going to reach a
stage where it will be economic to tear down old buildings which will lose
the Aspen charm. Foregoing statements made by John McBride
Vice Chairman stated there are plans being made to get into a program on
historical monuments.

Mr. Whitaker stated (1) he is concerned about the height, (2) concerned
about the bonuses and (3) something must be done about the ground space
requirement. Think more time should be spent and getting to the root of
the problem.
Vice Chairman Molny stated that the most important thing is open space
at ground level and sight lines, sun and view. This problem because
of time cannot be tackaed on a planning basis but based to hold off what
happened last summer.
Whitaker moved that the Planning and Zoning Commission request the City
Council not take action today on the ordinance based on Planning and
Zoning's recomendation and submit the draft ordinance to the Planning
and Zoning for review and possible further recommendation. Seconded by
Mars. Roll call vote - Molny aye; Benninghoff nay; Whitaker aye; Mars
aye. Motion carried.
Mars moved to adjourn at 2:10 p.m., seconded by Whitaker. All in favor,
meeting adjourned.
