Regular Meeting Aspen Planning & Zoning March 11 , 1969 Meeting was called to order by the Vice Chairman at 5:30 p.m. with the following members present: Vice Chairman Robin Molny Mayor Robert Barnard Councilman John Benninghoff Francis Whitaker Absent: Dale Mars - excused Chairman George Heneghan - excused Yvan Tache - unexcused Minutes Minutes - Whitaker moved to approve the minutes of February 25, 24, 18, 12, 11, as prepared and mailed by the Secretary. Seconded by Barnard. Roll call vote - Whitaker aye; Barnard aye; Benninghoff aye; Molny aye. Metro San. Dist. Metro Saniation District Request - Mr. Fothergill was present and request a letter from the Planning and Zoning Commission indicating that the Commission had reviewed the plans and that the plans fit in with the plans of the Planning and Zoning. Mayor Barnard pointed out authorization for such a letter to be written appears in the minutes of the Commission on April 13, 1968. Mr. Fothergill stated the Metro Sanitation District had not received the letter. Mayor Barnard and Councilman Benninghoff both stated their concern for a larger plant further down the valley. Letter is required in order to obtain funds for a grant. Whitaker made a motion to support the Metro Sanitation District request that the Planning and Zoning had previously gone on record of approving the location of the plant. Motion died for lack of second. Secretary to check the different sources for a copy of the letter. Mr. C. M. Clark requested to go on record as objecting to the attitude of the Commission as a taxpayer of taking away the $400,000 grant. Mt. Valley Sub. Mountain Valley Subdivision - Second filing - Mr. Whitaker pointed out the Master Plan does not show a road plan for this area. Without a road plan there is nothing the Planning and Zoning can do. Whitaker moved that since no major streets are involved this is beyond the jurisdiction of the City Planning and Zoning. Seconded by Barnard. Roll call vote - Benninghoff aye; Barnard aye; Whitaker aye; Mars aye. Whitaker moved to request a legal opinion from the City Attorney on responsibility for major street plans with reference to 139-59-13. Seconded by Barnard. Roll call vote - Barnard aye; Benninghoff aye; Whitaker aye; Mars aye. Letter from John Doremus relating to row house, patio house and high density areas was read by Mr. Whitaker. Commission request this be put on the next agenda. Letter from Administrator Wurl relating a request by the Postmaster was read by Chairman Molny. Discussion arose to the need fu r a planner. Barnard moved to table this request due to its complex nature. Seconded by Whtaker. Roll call vote - Whitaker aye; Benninghoff aye; Barnard aye; Mars aye. Scale Control and Height Proposal - Chairman Molny request permission from the Commission to send a letter drafted by Mr. Molny to Council requesting the City Council give further consideration to the proposals presented by the Planning and Zoning Commission. Letter was read by Vice Chairman Molny. Barnard moved that permission be granted to Vice Chairman Molny to send the letter to the City Council. Motion died for lack of second. Benninghoff stated it is the height that is objectionable and also where the building sets on the lot. Chairman Molny stated the last motion made by Council requesting the P & Z work on the basis of 4 stories and open space is going to causelaw suits. Mr. C. M. Clark stated the Council can be guaranteed of a law suit if it becomes confiscatory. Mr. Whitaker stated the City Council has the final authority, they appoint the members to make studies and recommendations, if they don't like the results, it is their final say. Mr. Whitaker quetioned if there was a need to give bonuses, if open space can still be obtained. Barnard moved that permission be granted for Vice Chairman Molny to send the letter to the City Council. Motion died for lack of second. Mayor Barnard stated he felt that the City Council had a moral obligation to study material given to them. Meeting, P & Z, 3/11/69, continued. Scale Cohtrol & Height act on it. They have directed the P & Z to open another study and it will not happen. Do not have the time to get back into this thing and we have an urgent problem in Aspen. Nothing will happen before the next construct- ion season. Mr. Whitaker suggest since there is $500 in the budget for a planner or planning consultant, rather than send the letter, have a joint session of Council and Planning and Zoning with a planner in attendance. Mr. C. M. Clark stated the alternatives to adopting the proposal are: building will be restricted to the shabby developer. The law presently permits me to put up a discount house on Ruby Park, this would give me an economic return. Whitaker n~ved that the Planning and Zoning request a study session of the entire Planning and Zoning Commission and City Council to go over the proposal the Planning and Zoning has made and counter proposal that was made by Council and the attendence of a planner at the session. Mayor Barnard stated he would not call the Council into such a meeting becuase it would be non-productive. Motion died for lack of second. Barnard moved to grant permission to Molny to send the letter to Council. lack of second. Vice Chairman Motion died for Mayor Barnard request permission to leave on a call. Permission was granted.
