Special Meeting Aspen Planning & Zoning April 1, 1969 A special meeting was called by Chairman George Heneghan for the purpose of considering the request of the Metro Sanitation District. Chairman called the meeting to order at 5:10 p.m. with the following members present: Chairman George Heneghan Mayor Robert Barnard Councilman John Benninghoff Francis Whitaker Yvan Tache Absent: Robin Molny (see late arrival) Dale Mars - excused Mr. Fothergill explained the District is applying for two Federal grants. One from the Water and Pollution of 30% for the outfall line from the Aspen plant to the new plant and for construction of the new plant. The second grant is being applied for from Housing and Urban Development for 50% which concerns only the trunk line. This is the grant for which the letter is being requested. Letter should indicate that the Metro plans are consistant with the plans of the City Planning and Zoning Commission. Benninghoff suggest since the County Commissioners will be meeting on the following Monday to discuss this, perhaps the Planning and Zoning should wait till a decision is reached by the County Commissioners. Robin Molny arrived. Benninghoff questioned if the Planning and Zoning gives their endorcement would this be covering the site of the plant. Mr. Fothergill explained it would depend on how the letter is worded. Whitaker questioned what would happen_to the land that has been purchased and the bonds. Barnard stated Mr. Stein is willing to buy the land back if another location is found. Mr. Kirchner was present and explained that he could not give a legal opininn on this but as a matter of good faith to the property owners it would not be a good thing to make any drastic changes. Discussed if the ballots at the time of voting on the bonds and organizatior contained where the site would be. Mr. Vroom stated he could not recall but the plan was posted at the polling places election day, it was published and information was sent out to all qualified voters. Whitaker questioned what the County Commissioners could do. Barnard reported the County Commissioners can take on the project of locating the plant further down the valley but would have to work in connection with the Metro Sanitation Dist~ict. Barnard moved to hold this in abeyance till the County Commissioners have decided, if anything, of what they are going to do. Discussed one large plant vs several plants. stated a series of plants are more desirable the affluent over a larger area of water. Vroom stated McLaughlin because you are spreading Barnard questioned if there should be any affluent at all if the plant is working properly. Vroom stated the engineers have designed this plant to meet the requirements. If the plant is overloaded, then you would feel more comfortable in having the affluent spread over a larger area. Barnard moved to reconsider this on the agenda this next Tuesday, April 8th. Seconded by Whitaker. Roll call vote - Molny aye; Whitaker aye; Heneghan aye; Benninghoff nay; Tache aye; Barnard aye. Molny moved to adjourn at 5:55 p.m., seconded by Whitaker. All in favor, meeting adjourned. -~~~ I \. N? 29
