CO. r RECORD OF PROCEEDINGS 100 Leaves Regular Meeting Aspen Planning & Zoning May 27, 1969 Meeting was called to order by Chairman George Heneghan at 5:15 p.m. with Robin Molny, Francis Whitaker, Dale Mars and Councilman John Benninghoff. Absent, Mayor Robert Barnard. Minutes Steep Lots Unattached Bldgs. 10 I Alley Set Back High Density Street Plan Legal Opinions Metro Sanit. Dist. Motion was made by Mars, seconded by Molny to approve the minutes of May 13, 1969 as prepared and mailed by the Secretary. All in favor, motion carried. Board of Adjustment Request - Letter from the Board of Zoning Adjustment requesting the Planning and Zoning review the section of the zoning code relating to height of buildings on steep lots was read by Chairman Heneghan. Commission reviewed the Board of Agjustment by-laws, Section 6, Guide Lines for Considering Height Variances. Whitaker made a motion that a letter be sent to the Board of Zoning Adjustment that the opinion is that the Guide Lines for Considering Height Variances as set forth in the by-laws are the best method for handling the situation on exceptionally steep lots. Seconded by Mars. Roll call vote - Whitaker aye; Heneghan aye; Mars aye; Molny aye; Benninghoff aye. Unattached Buildings - Tabled till next meeting. Secretary research material relating to this. Ten Foot Alley Set Back - Whitaker outlined the back ground on alley set backs. Discussed if there can be a legal requirement that trash be stored inside a building and what section of the code this should come under. Benninghoff stated he felt the set back should be in the front as open space, no alley set back and disallow parking in the alleys. Molny moved that the Planming and Zoning not take action on changing the 10' alley set back requirement. Seconded by Mars. Roll call vote - Benninghoff nay; Mars aye; Molny aye; Heneghan aye; Whitaker aye. Motion carried. High Density, John Doremus - Tabled till Mr. Doremus is present with a plan. Major Street Plan - Whitaker pointed out that by the Statutes in order for a City to have control over the streets, requires Planning and Zoning draw up and adopt a street plan. Part of the City is included in the Master Plan which was adopted by the City. The South Side Annex- ation and North Side Annexation do not have street plans. Commission agreed to put this on the next agenda and in the meantime the Secretary to send copies of the proposal for a street plan on the South Side Annexation to the Commission. Legal Opinions - Secretary to check into this. P & Z, 5/27/69, continued. Metro Sanit. Dist.is made on this item. Mr. Dunaway stated that Planning and Zoning has never adopted rules of procedure and questioned why they could not reconsider. Molny made a motion that Chairman Heneghan be authorized to send a letter to the Department of Housing and Urban Development stating that in the light of further study the plans for the development of the Metro Sanitation District meet with the approval of this Commission and are consistant with the plans of the City. Seconded by Mars. Roll call vote - Benninghoff aye; Mars aye; Molny aye; Whitaker aye; Heneghan aye. Memo from Marion Scott, Administrative Assistant, was City Bulletin read by Heneghan relating actions of the Planning and Zoning be sent to his office for the City Bulletin. Commission instructed the Secretary to handle this. Rules of Procedure - Commission instructed the Secretary Rules of Procedure to contact the Municipal League and other sources for information on rules of procedure that could be used for this Commission. Whitaker moved to adjourn at 6:15 p.m., seconded by Molny. All in favor, meeting adjourned. ~e5~ N9 88
