Regular Meeting Aspen Planning and Zoning April 9, 1968 Meeting was called to order at 5:00 p.m. by the Chairman with the following members present: Chairman William Tharp Francis Whitaker George Here ghan Joel Hartmeister Also Present: City Attorney Fitzhugh Scott III Buil ding Inspector Marvin Reynolds MINUTES Francis Whitaker made a motion Seconded by Joel Hartmeister. Whitaker aye; Tharp aye. to approve the minutes of March 26th as mailed. Roll call vote - Hartmeister aye; Heneghan aye; Mayor Barnard arrived. BUILDING REVIEW Hodge & Oliver - New plan submitted showing underground parking except for the area under the alley and adjacent to the alley, plus additional commercial space. Two sets of plans submitted. Commission reviewed plans. Question was raised if Hodge and Oliver plan to have the alley vacated. Hodge and Oliver related they would if they found the parking to be conomically feasible as rentals or leasing and then at that time would ask for approval from Council for vacating the alley. At the present time have 27 parking spaces availab~for this purpose. Would rather keep the parking underground and rent them out on a monthly or yearly basis but not go into a joint venture with the City. Matter of timing etc. This plan shows 127 total parking spaces. Hesitate to put a 2 million dollar project on a City owned garage. Mayor Barnard proposed they put their required parking above ground and make arrangements with the City for a parking garage underground. Francis Whitaker made a motion the revised plans as submitted be approved. Mayor Barnard request more time to study this plan. Motion /Seconded by George Heneghan. Mr. Willson of Hodge and Oliver stated the working drawings would be ready in about 30 days. Administrator Wurl pointed out the City Council agrees with the Mayor. Francis Whitaker pointed out the interjection by the City in their demands for parking does not relate to approval of this set of plans. Mayor Barnard stated this is a railroad job due to just hearing about the plans 2 or 3 hours ago and request this be made a part of the record. Roll call vote - Heneghan aye; Hartmeister nay; Whitaker aye; Mayor Barnard nay; Chairman Tharp aye. Motion carried. Hodge and Oliver stated they would withdraw their request before the Board of Adjustment. Bob Stevens Condominium - Little Nell Condominium - 11 units - Waters Avenue Marvin Reynolds reported it is in the AR-l District and meets all zoning requirements. Commission reviewed plans. Mayor Barnard left the meeting. Discussed the 30 days to review plans. Attorney Scott informed the Commission they should have reason to hold up a set of plans. Discussed the large influx of condominiums. Attorney Scott suggest the Commission urgently rezone for this problem. George Heneghan made a motion that the plans just reviewed by the Commission be recommended for approval to the Building Inspector. Seconded by Francis Whitake~ Roll call vote - Hartmeister aye; Heneghan aye; Chairman Tharp aye; Whitaker aye. Motion carried. Ethel McCabe. - 216 East Main - Small addition to residence. Marvin Reynolds reported the plans meet all zoning requirements. Mayor Barnard returned. George Heneghan made a motion to recommend approval to the Building Inspector Seconded by Mayor Barnard. Roll call vote - Mayor Barnard aye; Whitaker aye; He~eghan aye; Hartmeister aye; Chairman Tharp aye. Roaring Fork Apartments - End of Durant - Addition of one unit. Commission reviewed plans. Joel Hartmeister made a motion to recommend approval to the Building Inspector. Seconded by Mayor Barnard. Roll call vote - Whitaker aye; Hartmeister aye; Heneghan aye; Mayor Barnard aye; Chairman Tharp aye. Commission instructed Attorney Scott, Jerry Brown and Marvin Reynolds to work out the guide lines for this. BAVARIA PARK Joel Hartmeister to review plan. Commission to take action at the next regular meeting. OFF-STREET PARKING IMPROVEMENT DISTRICT Francis Whitaker pointed out the fact legal guide lines have not been drafted on how this improvement district can be done. Mr. Whitaker pointed out several legal questions. Commission agreed to have Attorney Scott look into these legal questions. George Heneghan pointed out during his absence at one of the meetings, Tom Daly condominium project was approved by the Commission very rapidly. Felt the Commission should have considered his past performance and this pro- jects affect on surrounding property owners. MEMO - BUILDING REVIEW A memo was submitted by Marvin Reynolds stating the Commission being remiss in reviewing plans before a Commission meeting. Marvin Reynolds request to go on record as saying that he is not strictly in favor of building review as it exists under this Commission. But as long as we have it, it has to be done. Mr. Hartmeister pointed out the Commission acted improperly by Hodge and Oliver plans - not a complete set of plans, acted on that the building inspector cannot issue a building permit on. for 30 days to review plans. vOt:ing on something Law provides Marvin Reynolds pointed out the plans submitted this date were a supplemental to the original which showed the floor plan. Attorney Scott stated the plans were as complete as they have to be for building review. Mr. Reynolds also pointed out he will not give a permit if the check list items are not the same as the original plan. If there is any change will have to come back to the Commission for approval. Commission instructed Marvin Reynolds to contact 2 people to review plans. Mayor Barnard read the following letter and request it be made a part of the record: Gentlemen: On April 4, 1968 the Planning and Zoning Commission was convened at the request of the Chairman at 5:00 p.m. to consider a revised set of plans on the Hodge- Oliver project. As the minutes will show, these revised plans failed to get the approval of the commission and the meeting was adjourned at 6:00 p.m. Approximately 15 minutes later I walked into the bar at the Elks Club in Aspen and observed the follaing persons gathered at a table in the back of the room N9 17 .. Wurl S. Flewelling Mayor Barnard further stated I don't bring this up to indicate that there might be collusion on anyones part in regards to employees of the City or members of this Commission. I merely want to submit this for the record. Chairman Tharp pointed out these people are appointed by the City Council and they should be the ones to consider this.
