Regular Meeting Aspen Planning & Zoning August 13, 1968 Meeting was called to order by the Chairman at 4:15 p.m. with the following members present: Chairman William Tharp Mayor Robert Barnard George Heneghan Yvan Tache Also present: William Kestner, Building Inspector Jerry Brown, Planner Leon Wurl, CityAdministrator Roger Mahnke, City Engineer Absent: Councilman John Benninghoff (excused) Francis Whitaker (excused) MINUTES Barnard made a motion to approve the minutes of July 23rd and August 7, 1968 as mailed. Seconded by Heneghan. Roll call vote - Tache aye; Tharp aye; Heneghan aye; Barnard aye. BUILDING REVIEW Earl Schennum - Recreation room below ground covered with concrete slab. No problems. Barnard made a motion to recommend Inspector. Seconded by Heneghan. aye; Tache aye; Tharp aye. approval of the plans to the Building Roll call vote - Barnard aye; Heneghan Aspen Leaf Building - Basement remodeling No exterior remodeling, no plumming or electrical. Shop for tobacco, pipe and posters. Heneghan made a motion to recommend approval of the plans to the Building Inspector. Seconded by Tache. Roll call vote - Heneghan aye; Tache aye; Tharp aye; Barnard aye. Fasching House - 15 unit condominium George Heneghan reported the plans were not complete. Ms. Fasching stated she would like the feeling of the Commission before having final plans drawn. Commission agreed they could not consider the plans until final plans are submitted. We feel that the building which is being constructed on Lot 4, West Aspen Subdivision, does not conform to the architectural control concept as portrayed in the cov- enants for West Aspen subdivision. We also feel that it does not follow the exact letter or spirit of zoning for a two-family dwelling. We feel that it is more like two separate houses with a brief connection inbetween, all on one lot. We would like you to re-evaluate any further building of this sort which the owner of Lot 4 may desire to put on Lots 2 and 3 at a later date." Mr. Robert Stevens who presented the petition stated the signers of the petition are quite concerned about a continuation of these duplexs on Lots 2 and 3. The way the zoning code reads, this can be done. Administrator Wurl suggested to control this present problem, the architectural control committee of the West Aspen Company could change their covenants faster than the ordinance of the City could be changed. Barnard made a motion to schedule a public hearing on Sept ember 10, 1968 at 4:00 p.m. to consider the definition of a duplex. Seconded by Tache. Roll call vote - Barnard aye; Heneghan aye; Tharp aye; Tache aye. PARKING Proposals for off-street parking were submitted by Jerry Brown and Admin- istrator Wurl. Jerry Brown reported with the present parallel parking , you can park approximately 616 cars within the C-C Zone and those blocks facing this zone. Proposed a beginning mall pattern consisting of Galena extending to Hopkins and Hyman which would pre-empt approximately 150 spaces. Initial parking garage should accommodate approximately 500 cars which would take care of the 150 spaces due to the mall and additional spaces left over. Another garage would accommodate another 500 cars and you would then proceed with another block of malls. The following sites for parking structure and their advantages and dis- advantages as follows: #1 - Edelwess Site Between Aspen and Monarch, Hyman and Hopkins. Not on Main Street or Highway 82 Residential area One block away from potential mall pattern Block is mostly vacant. it2 - Roland Site By the Post Office 1/2 Block residential and one house on the other 1/2 of the block Adjacent to potential mall pattern On Highway 82 Surrounded by Post Office, lodges, residential and undeveloped land. it3 - Meyer Site Corner of Main an~~ring 46 --- RECORD OF PROCEEDINGS 100 Leaves FORM 'I C.F.HOECKELB.B.lll.CO. A Adjacent to eventual mall pattern On Highway 82 Surrounded by undeveloped residential land Partially vacant. #4 - County Site On Mill below Main Street, County sheds 1/2 Block from mall pattern Not directly on arterial circulation. Bordered by potential railroad development Mostly vacant. its - Isis Site Between Main and Hopkins, Mill and Galena Within the C-C Zone Surrounded by pedestrian oriented businesses Bordered by the mall pattern On arterial circulation 7 lots vacant, 11 developed #6 - Center Site Bottom of Little Nell Adjacent to eventual mall pattern Not on arterial circulation Bordered by non-pedestrian oriented uses n - Clark Site Ruby Park and 1/2 block adjacent where swimming pool is located. Favor Site #5 because of its proximity to eventual mall pattern, its on Main Street and Highway 82 and City owns 4 lots. The lots owned by the City could be used immediately for surface parking. Considered the garage with attendant parking or park yourself. With attendant parking could park 76 cars per floor. Visualize 2 levels undergroun surface with terminal, garage etc and 2 levels above. C. M. Clark stated with the traffic circulation moving more towards the mountain perhaps the parking should be where the traffic is and where parking is needed. Jerry Brown pointed out with the complete mall pattern, another garage would be needed. Administrator Wurl pointed out first of all would have to determine where the pedestrian oriented area is, all agreed it was the C-C Zone, and use this as a guide. Number 2~ locahe around that area the parking structure. Another question would be how fast can we initiate the program in relation to financial capabilities. George Heneghan pointed out by putting the parking garage at the base of the mountain this would cause more traffic. Dan Gale pointed out by locating near the base of the mountain would cause traffic to go across town. Chairman Tharp pointed out the 2 sites in question seem to be #5 and #7. Mr. Clark pointed out the Ruby Site lends itself to further expansion. Could adjoin Wagner Park. Administrator Wurl pointed out the City would like the feelings of the Commission since leasing spaces from the City is being considered. Barnard made a motion to recommend to the City Council the parking structure be in or on the immediate perimeter of the C-C Zone. Seconded by Heneghan. Roll call vote - Tache aye; Barnard aye; Heneghan aye; Tharp aye. A lease form for leased parking spaces from the City was submitted by Administrator Wurl. Heneghan made a motion to approve the form for leased parking spaces as submitted by Administrator Wurl. Seconded by Barnard. Roll call vote - Barnard aye; Heneghan aye; Tache aye; Tharp aye. Plans for an office building across fromthe Post Office,were submitted. Will require leased parking spaces. Plans reviewed by the Commission. Building Inspector left the Chambers. Chairman Tharp pointed out the Commission cannot give approval to the plans until Council has accepted the lease agreement. Barnard made a motion to recommend approval of the plans subject to the City Council's approved contract for the leased parking spaces. Seconded by Tache. Roll call vote - Heneghan abstain; Barnard aye; Tharp nay; Tache aye. Motion carried. CAPITAL IMPROVEMENTS Building Inspector returned to Chambers. A list of the items from the city questionnaire was submitted. Commission agreed to have a study session on August 14th, at 4:00 p.m. to discuss capital improvements. C-2 ZONE - USES PERMITTED Chairman Tharp read a revised proposal submitted by Administrator Wurl. C. M. Clark request to go on record that to not hold another public hearing on this revision is an illegal action of the Planning and Zoning Commission. This material I am looking at for the first time. I have not had a chance to look at it, discuss it, digest it or in any other way come in contact with it. This is not what was presented to me at the public hearing and I think it is an illegal action and I object strenuously ot it, I think it is grossly injustice. Discussed if another public hearing would be required. Barnard made a motion to schedule a public hearing on this proposal for September 10th, 4:00 p.m., City Council Chambers. Seconded by Tache. Roll call vote - Heneghan aye; Tache aye; Barnard aye; Tharp aye. Chairman Tharp request Mr. C. M. Clark if he desired to make a statement at the September 10th hearing, to do so in writing and it would be read by the Chairman, since Mr. Clark has made many statements before on this same subject. PUBLIC HEARING - Proposed change under Building Review Chairman Tharp opened the public hearing and read the proposed ordinance. Commission agreed to also include the RMF Zone under building review. Mr. C. M. Clark objected on the grounds the Planning and Zoning agreed 6 months ago to eliminate this function from the Planning and Zoning. This is a political tool. Object to the review of plans being thrown into the political arena. Resent the way in which it is done. Tired of paying for law suits and losing all the time. Chairman Tharp pointed out until the City Council approves of eliminating this function from the Planning and Zoning, the ordinance should be kept up to date. No further comments. Chairman Tharp terminated the public hearing. Barnard made a motion to recommend approval of this proposed ordinance to the City Council which include the C-C and RMF Zones under Building Review. Seconded by Heneghan. Roll call vote - Tache aye; Barnard aye; Heneghan aye; Tharp aye. Tache made a motion to adjourn at 6:35 p.m., seconded by Barnard.
