Special Meeting Aspen Planning & Zoning April 13, 1967 The Special Meeting convened at 4:30 p.m. with the following members present: Chairman Tom Benton Mayor Barnard Councilman McEachern Sam Lum George Heneghan Also present Building Inspector Roger Mahnke. Sidewalk designs were discussed. Roger Mahnke, City Engineer, explained design for each zone. Mr. Benningh off was opposed to the design for the R-6 area and is passing petitions to have them changed. Chairman Benton asked that any petitions be presented to the Planning and Zoning Commission first. The following opinion of the City Attorney concerning the Aspen Downtowner motel and Convention Center was read. Building review law was read and explained. Mr. Tom Benton Chairman Planning and Zoning Commission Aspen, Colorado Gentlemen: It is my opinion that the ordinance in effect on the date on which written application for a building permit is made governs the issuance of that permit. Since the City ordinances provide that an application for a building permit will not be accepted before approval of the plans and specifications under the building review procedure, the ordinance in effect at the time the plans are submitted is inconsequential. /s/ Janet K. Gaylord City Attorney City of Aspen A motion was introduced by Mayor Barnard that the Building Inspector be instructed not to issue a building permit and that the plans be rejected on the basis of Title XI. Motion was seconded by Sam Lum. All in favor, motion carried. Sam Lum made a as presented. carried. motion that the other plans reviewed on April 12th, be approved Motion seconded by Councilman McEachern.
