Regular Meeting Aspen Planning & Zoning June 28, 1967 Meeting was called to order at 5:10 p.m. with the following members present: Chairman Tom Benton - Presiding Mayor Robert Barnard Sam Lum Francis Whitaker George Heneghan Councilman McEachern (unexcused absence) Donald Copelin (unexcused absence) Also present Roger Mahnke, Building Inspector and City Engineer, and also Marvin Reynolds, Building Inspector. Francis Whitaker made a motion to approve the minutes with the following correction: "Barbara Fasching - Two letters were read, one from Jerry Brown and one from the Aspen Chamber and Visitors Bureau relating to this matter. Mr. Minor, Mrs. Faschings builder, showed a plan of similar housing he is doing in Glenwood Springs also a plat showing her proposed development. Mr. Benton explained the problems with the project in relation to zoning. Considerable discussion followed." Seconded by Mayor Barnard. All in favor, motion carried. BUILDING REVIEW Innsbruck Sports Inn - Second and Main Street Plans were previously reviewed. Plans corrected to show 22 parking spaces, 18 required. Roger Mahnke reported the plans were in order. George Heneghan made a motion to approve the nice looking plans for the Innsbruck Sports Inn. Seconded by Mayor Barnard. All in favor, motion carried. South Point - Tom Daley - Lodge Condominium - Dean Avenue & Aspen 30 Units with underground parking of 25 spaces. Discussed the required spaces for a condominium if short term and those required if on a long term basis. Mr. Daley reported a large percent of the local condominiums are owned by individuals, rented short term and managed by a manager. Stated the plans were submitted on the basis of accomodation units and would be mainly short term rentals. Mayor Barnard made a motion to approve the plans for South Point Lodge Condominium. Seconded by Sam Lum. All in favor, motion carried. SERVICE YARDS Chairman Benton questioned ghe 10% to 15% of open space. Roger Mahnke reported a percentage of open space looks much better than a solid fence. Also would discourage painting etc. on the fences. Il l. co. Reg. Meeting, P & Z, June 28, 1967, continued. CHATEAU ASPEN - Parking Roger Mahnke reported Mr. Wallen has not returned to Aspen. BOARD OF ADJUSTMENT - Decisions Discussed recent decision made by the Board of Adjustment to approve a building permit to install 2 gas pumps. Chairman Benton reported he was not in favor with the decision made by the Board of Adjustment due to the fact it goes against the Master Plan and Title XI and destroys the goals of the Master Plan. Also would set a precedent for other non-conforming uses. Francis Whitaker liaison member to the Board of Adjustment reported the Board of Adjustment acted under Section 11-1-12 (a), this was not a variance. Stated the Board requested a legal opinion from the City Attorney - #1 questioned if it was a gasoline station #2 whether the property was leased pertinent and #3 how would it relate to an existing non-conforming use. Also reported the Board based on the legal opinion decided this was not classified as a gasoline station but it was storage of material incidental to and used in connection with the existing non-conforming use. Chairman Benton questioned why Jerry Brown, Planner, was not consulted. Mr. Whitaker also stated the Board was lead to believe the City had granted permission for Esco to cross the alley with pipes. Mayor Barnard informed the Commission permission had not been granted and he had instructed the Building Inspector not to issue the permit due to the improper procedures by the Board of Adjustment. JACK JENKINS - Vehicle Showroom Chairman Benton reported Mr. Jenkins would like to know if this is possible to be located between the Donut Shop and Alpine Cleaners on Hunter Street. Commission agreed vehicle sales and service is not allowed in the C-l, only in the C-2 District and this would not be allowed at this location. Chairman Benton read legal op~n~on from the City Attorney relating to definition of a condominium. The following is an excerpt from that legal opinion: "It is my opinion that detached buildings even with some common areas, would not qualify as a condominium."
