Regular Meeting Planning & Zoning July 26. 1967 Meeting was called to order at 5:10 p.m. with the following members present: ?Chairman Tom Benton - Presiding Francis Whitaker George Heneghan Mayor Robert Barnard Donald Copelin Sam Lum (unexcused) Councilman McEachern (unexcused) Also present Marvin Reynolds, Building Inspector. Francis Whitaker made a motion to approve the minutes of July 12th and June 29th as mailed. Seconded by Mayor Barnard. All in favor, lIIO tion carried. BUILDING REVIEW George Madsen - Addition of 2 units plus addition to residence at Fifth and Hopliins. Building Inspector Reynolds reported all building review requirements had been met. Donald Copelin made a motion to approve the plans for George Madsen. Seconded by Francis Whitaker. All in favor, motion carried. Ginsberg - Kunda - Hoehne - 8 units at Sixth and Hopkins. Marvin Reynolds reported there was some question on the parking. Plans show 6 spaces, based on the 2 for 3 ratio. As a lodge 6 spaces are required and for an apartment 9-1/2 spaces are required. Question as to whether the Planning and Zoning Commission would classify this as a lodge or apartment building. Donald Copelin made a motion that a decision on these plans be made on the same basis of previous decisions as set by precedent. Donald Copelin withdrew his motion. Mayor Barnard made a motion that the plans be approved. Seconded by George Heneghan. Mayor Barnard aye; Chairman Benton aye; Donald Copelin aye; George Heneghan aye; Francis Whitaker nay. Motion carried. PARKING Discussed confusion of parking requirements as relates to lodges, condominiums and apartments. Mayor Barnard made a motion to recommend an amendment to the zoning ordinance to change the parking requirements in the Tourist District to one parking space per each accomodation or dwelling unit. All in favor, motion carried. Donald Copelin made a motion to set a public hearing on August 16th 1967, 5:00 p.m., City Council Chambers on Parking Regulations. Seconded by Mayor Barnard. All in favor, motion carried. CHATEAU ASPEN Attorney Kern was present representing the Chateau Aspen and request the Planning and Zoning be fair and consistent on the parking requirements. BUILDING REVIEW Fifth Avenue Condominium - Foundation Permit - 11 Units. Marvin Reynolds, Building Inspector reported when the Fifth Avenue was in the County, the original building was built 40' high. Now request to build the addition the same height. Attorney Gaylord stated the City is not bound by what happened in the County and this should be handled by a variance. Francis Whitaker made a motion the plans be returned to the building inspector because the height is over the limit in the AR-l zone. Seconded by Donald Copelin. All in favor, motion carried. Palazzi Texaco - Excavation permit to bury 500 gal. tank to store crank case oil. Marvin Reynolds reported they are presently storing the oil in tanks above ground, now wish to bury a tank. Donald Copelin made a motion to approve the plan. Seconded by Mayor Barnard. All in favor, motion carried. C-lA DISTRICT - Tabled. BY-LAWS - Tabled. PARKING Chairman Benton proposed a change in the parking requirements for the C-l District to no parking requirement. The burden would be on the owner to provide as many spaces as he felt he needed. Discussed this as relates to the restrictive parking and a new parking facility proposed by the City. Commission agreed in order to make the no parking requirement work in the C-l zone, restrictive parking would have to be strictly enforced and would have to sell the parking facility at the same time. Chairman Benton aye; Copelin aye; Barnard aye; - Chairman Benton to acquire the remaining votes of Francis Whitaker and George Heneghan. SIGNS Mayor Barnard made a motion to hold a public hearing on maximum size of letters in signs, on August 16, 1967, 5:00 p.m., City Council Chambers. Seconded by Donald Co~elin. Chairman Benton aye; Mayor Barnard aye; Copelin aye; votes of Francis Whitaker and George Heneghan to be obtained by Chairman Benton. MEETING DATE Chairman Benton stated the Aspen Illustrated News request Planning and Zoning change their meeting date to either Tuesday or Thursday so that articles would hit the paper in the same week as the meeting. Commission agreed to take this under advisement. RED MOUNTAIN WATER Francis Whitaker request this be put on the agenda, felt the Planning and Zoning should approve the road system before water mains are extended to new areas. It was stated the Planning and Zoning would study the zoning before running new lines, not the road system. TOM DALY CONDOMINIUM Letters from Attorney Gaylord to Chairman Benton and the Building Inspector were read by Chairman Benton. Mrs. Gaylord stated this had been brought to her attention by Mr. Uhifelder as the plans were approved at the previous meeting of the Planning and Zoning on the basis of a lodge, plans labeled lodge condominium. Letter to Chairman Benton relates to a recent court case pertaining to definition of a lodge as opposed to an apartment or multi-family dwelling and recommended changes for a definition of a lodge. Letter to Marvin Reynolds, Building Inspector relates to the Building Inspector giving notice to Tom Daly of this problem. Planning and Zoning agreed no further action was required by the Commission.
