Regular Meeting
Aspen Planning & Zoning
September 26, 1967
Meeting was called to order at 5:10 p.m. with the following members
present:
Chairman Tom Benton - Presiding
Mayor Robert Barnard
Councilman Clyde Clymer
George Heneghan
Francis Whitaker
Donald Copelin
Sam Lum - unexcused absence
Also present Building Inspector, Marvin Reynolds.
Francis Whitaker made a motion to approve the minutes of September 12th
and 19th as mailed. Seconded by Councilman Clymer. All in favor, motion
carried.
BUILDING REVIEW
Red Mountain Cleaners
Mr. Reynolds submitted plans for a garage and storage area.
Also informed the Commission the set backs and height conform to the
code, no parking required but a cleaning establishment is a non-conforming
use in the C-l District.
It was reported the garage would be used to load and repair the delivery
truck used in the business. Discussed if the storage area would be an
extension of a non-conforming use. Mr. Reynolds reported a cleaning
establishement is only allowed in the C-2.
Francis Whitaker made a motion that the Commission get a legal opinion
on the storage space as to whether it is a conforming use or non-conforming
use.
Marvin Reynolds suggest, due to the time of year, the Commission consider
an alternate in this case of approving the plans if the storage area were
excluded.
Francis Whitaker withdrew his motion.
Mayor Barnard made a motion to approve the plans subjec~ to the total
addition be designated as a garage and conform to the Fire Zone 1.
Seconded by George Heneghan. All in favor, motion carried.
Chateau Aspen the following letter was read by Chairman Benton:
Dear Mr. Benton:
I have made an inspection of Chateau Aspen concerning the number of units.
In my opinion there are, for all practical use requirements, just 21
units. In some of the lower units the bedrooms do have exterior doors,
however, these units have only one bathroom.
The sod has been removed in the rear of the building to provide the
required 11 spaces; the 2 parallel spaces in front have been defined by a

low curb so as not to extend into City property. The total 14 spaces,
as required, have been provided.

Building Inspector
Francis Whitaker made a motion that the building inspector's report
be included in the minutes and the matter of the Chateau Aspen be
concluded. Seconded by Donald Copelin.
Chairman Benton stated to the Commission all should understand that the
Commission by passing this motion approve 2 for 3 parking on this.
All in favor, motion carried.
BY-LAWS
Chairman Benton appointed George Heneghan and Donald Copelin to work
on the Planning and Zoning by-laws and subdivision regulations.
VIOLATIONS
Mr. Reynolds reported as of the 1st of April, 1968 all non-conforming
signs will be coming down which will require extreme amount of
correspondence.
Discussed all violations being brought to the Commissions attention and
made a part of the record.
Mayor Barnard made a motion to go into executive session at 5:40 p.m.,
seconded by Donald Copelin. All in favor, motion carried.
Commission reconvened at 6:10 whereupon Mayor Barnard made a motion to
adjourn, seconded by George Heneghan. All in favor, meeting adjourned.
