Special Meeting
Aspen Planning & Zoning
September 29, 1967
Meeting was called to order at 5:10 p.m. with the following members
present:
Chairman Tom Benton - Presiding
Mayor Robert Barnard
Councilman Clyde Clymer
Sam Lum
Donald Copelin
Francis Whitaker - Absent
Special meeting was called by Chairman Tom Benton.
Mayor Barnard made a motion the Commission go into executive session.
Seconded by Donald Copelin. All in favor,motion carried.
Mayor Barnard made a motion to go out of executive session and into
special session at 5:55 p.m. Seconded by Donald Copelin. All in favor
motion carried.
Commission member George Heneghan arrived.
Attorneys Robert VerShure and Kern were present. Mr. VerShure stated the
firm of Holland and Hart did not have anytning formally to submit
since the building permits were issued on the Chateau DuMont and Chateau
Chaumont and today the permits were revoked. Would like to know why the
permits were revoked and would-like to discuss the problem.
Chairman Benton explained that the objection was that the plans were
rejected by the Planning and Zoning based on zoning violations.
Mr. VerShure request they discuss these violations - off-street parking
and density. Understand the cease and desist order was based on the
above as outlined in the code. Feel that they are not in violation
of either of these sections of the code based on previous decisions
of the Planning and Zoning and their interpretations. Feel legally and
in all fairness that we can rely on these decisions.
Discussed the plans of Tom Daly and George Madsen and the Planning and
Zoning's decision on such.
Also discussed the bed tax as relates to enforcement of short term rentals.
Mayor Barnard made a motion to recind the action taken as pertains to
letter dated September 26th from Marvin Reynolds as follows: "The sod
has been removed in the rear of the building to provide the required 11
spaces; the 2 parallel spaces in front have been defined by a low curb
so as not to extend into City property. The total 14 spaces, as required,
have been provided." - because it is beyond the Commissions jurisdiction.
Seconded by Councilman Clymer. Roll call vote - Councilman Clymer aye;
Mayor Barnard aye; George Heneghan aye; Donald Copelin aye; Sam Lum aye;
Chairman Benton aye.
Donald Copelin made a motion to recind the Commissions approval of the
Ginsberg - Kunda - Hoehne pr~ject at 6th & Hopkins. Seconded by

Commission discussed recinding actionon the Tom Daly project. Commission
agreed not to recind the action due to the project already being under
construction, but agreed a rooming house license would have to be
applied for on the building and the bed tax collected.
Mayor Barnard made a motion to adjourn at 6:45 p.m., seconded by Sam
Lum. All in favor, motion carried and meeting adjourned.
