Planning & Zoning Commission
February 23, 1968
Meeting was called to order by the Chairman at 5:05 p.m. with the following
members present:
Chairman William Tharp
Mayor Robert Barnard
Councilman Clyde Clymer
Administrator Leon Wurl
Francis Whitaker
Joel Hartmeister
Also present Building Inspector Marvin Reynolds and Planner Jerry Brown.
Discussed amendments proposed for public hearing on March 1, 1968 - Zoning
North Side Annexation, C-lA District, Building Review, Re-zoning request
Block 58 and Vertical Zoning.
Chairman Tharp explained since this was a study session, only comments from
the Commission members and those persons connected with the Commission would
be recognized.
NORTH SIDE ANNEXATION ZONING
Jerry Brown proposed zoning as shown in the Master Plan except for the
industrial area. Discussed zoning for Neal Avenue Park, which Mr. Brown
proposed as a park. Commission agreed if the deed of this land from Mr.
Herron has no restrictions as to its use and Mr. Herron had no objections,
to zone this for multiple family dwellings leaving an area by the river for
park so that there would'be no zoning problem if the Cities proposed low
cost housing is constructed on this land.
Commission instructed Attorney Scott to check into the deed for restrictions
as to the use of the land.
Jerry Brown reported the zoning should be by the boundaries of parcels of
land. Discussed the lack of distinct boundaries on Neal Avenue Park.

Mr. Wurl reported that the builders lease to build low cost housing at this
location could contain that a certain area along the river bank be retained
as a park.
C-lA DISTRICT
Jerry Brown proposed the C-lA District cover from 4 lots east of Hunter to
Original on the south side of Main and depending upon the ownership on the
north side of Main from Hunter to Original. Marvin Reynolds stated starting
from the 4th lot on the south side of Main would split ownership of property.
Commission agreed to propose the district from the 3rd lot on the south side
of Main.

BUILDING REVIEW
Agreed the procedure should be changed as outlined at the last regular
meeting, except Building Inspector Reynolds agreed to furnish the Commission
members with a list of proposed construction projects, in memo form along
with the agendas.
RE-ZONING REQUEST BLOCK 58
Jerry Brown stated this would be spot zoning and also would cause a traffic
problem with the school across the street.
Also pointed out was the fact that 1/4th of the block already has a use
variance on it.
Also considered by the Commission is the fact that there is presently enough
AR-l zone in the City.

It was stated that the Commission agreed with leased spaces in the same zone
when the Commission passed the leased spaces for Matthew Drug. Attorney
Scott stated the ordinance implies that a person can lease spaces in the
same zone.
Discussed a percentage of 1/3rd - Mr. Wurl felt 1/3rd was not a large enough
percentage, people would put in just enough commercial space in order to
obtain the accommodation units.
It was stated in the interim time between adoption of vertical zoning and
establishment of a parking district, the people will have to provide the
parking or agree to participate in a district until the district is formed.
Attorney Scott stated banning all types of dwelling units in the business
district would be legally questionable.
