REGULAR MEETING OF CITY OF ASPEN PBANNING AND ZONING COMMISSION
June 28, 1966
Meeting was called to order at 3:@9 P.M.
Present were: Woodward -(arrived late)
Benton
McEachern Absent

Hold Minutes for Correction June 14 meeting until next meeting.
No building review.
Nothing further on Pelletier Plan.
Letter from the City Attorney concerning Beruman Annexation.
Letter was read requesting Planning and Zoning Commission to
work out Zoning.
It was suggested that notices for public hearing on zoning of Be=
rument property be set for the 19th of July. Moved by Benton
that the 19th be set for Public Hearing date; seconded by Walls.
Motion carried.
Letter From City Attorney concerning Taxi use as being an exten-
sion of a non-conforming use.
Benton moved that Council be required to instigate legal Action
against the Little Percent Taxi and its owner based on the City
Attorney's opinion concerning the extension of this non-conforming
use. Walls seconded. Motion carried.
Sign Ordinance:
Amelias sign - complaint drawn up for Charmaine signature on
Amelia's sign, (copy in file) discussion followed. Motion by
Benton to authorize Francis Whitaker to sign complaint on Amelia's
Sign. Seconded by Woodward. Motion carried.
Committee report by King Woodward on proposed sign ordinance.
Mr. Woodward read the new proposed sign ordinance and each point
was discussed. Walls recomended that copies of the proposed
ordinance fie supplied to each member and then go over ordinance
at next meeting. This will give an opportunity for each member
to study proposed ordinance.
Joint Planning & Zoning arid a Citizens Planning
Mr. Walls proposed that the Chairman appoint a two man committee
from the Planning and Zoning Commission to organize a joint Citizens
Planning project. Mr. Walls felt that since we note have the Aspen
Area Master Plan, The Planning and Zoning Commission should stop
nit-picking with zoning and get on with a needed detailed planning
project for the Central Business district. This grouop, working
within the frame work of the Planning & Zoning Commission.
The Commission would work out detailed studies and recommendations
for density, municipal and private off street parking, malls,
traffic flow, expansion of the business district and signs.

This planning project would extend over a period of a
year and would be presented in the form of a package plan. Mr.
Walls felt that should be basically a Community Project whmch
would involve architects, artists, landscape designers, contractors
and business people, as well as members of the Planning and Zoning
Commission.
If such a package could be worked up, and if we can obtain the
overwhelming support of a major portion of the citizens for this
package, then a great deal of this nibbling away at the ordin_
ances could be eliminated. If it is ~mpossible to obtain citizens
to work with the Planning and Zoning and if it is impossible to
obtain the support of the citizens, a s a whole for the idea, then
there would be no need to continue.
Mr. Whitaker objected and felt that this meeting was not the time
to bring this idea up. He felt that a special meeting should be
held.
Discussion followed by all members. The Chairman took no action
on the proposal and went to other business.
Mr. Whitaker presented each Planning and Zoning member a copy of
the supplemental report from Jerry Brown on zoning regulations.
Municipal Parking Lot:
Mr. Wurl proposed that Planning and ZoniBg Commission make a
recommendation to Council for leasing space in Municipal Parking
Lot. General recommendation from Planning and Zoning as to the
feasibility of the use of Wagner Park for underground parking.
Motion was made by Woodward that Planning and Zoning Commission
recommend to City Council that the City make a feasibility study
of underground parking under Wagner Park as soon as possible.
Seconded by Benton. Discussion. The Commission would like
to see leased parking space in lieu of off street parking require-
ments be included. Motion carried.
Secretary to draft a letter for Chairman along the aforementioned
lines.
South Annexation: Continued to next meeting.
Small Lot Clause: No response from Estes Park. The City Clerk
cannot find any such small lot ordinance.
Benton moved to submit Commission report on small lot clause to
the City Attorney to be drafted in ordinance form. Woodward
seconded. Motion carried.
parking: Ullr Plot plan still missing.
Chatelet: noplot plan.
Woodward moved that the next meeting the City Building Inspectors
office request owner or contractor of the Limelite, Chatelet, Ullr,
to submit plot plans to planning and Zoning Commission that were
approved at the time of building review showing off street parikng.
Benton seconded. Motion carried.
Mountaineer Lodge: Whitaker discussed this with City Attorney.

She Ruggested that a letter be wtitten by The Commission quoting
minutes of the May 25, 1965 Planning and Zoning meeting and the
Commission feels the condition set forth has not been complied
with. Whitaker moved that a letter be sent with Whitaker's sign-
ature, to the owner of the Mountaineer. Benton seconded. Motion
car:tled.
A copy of a letter written by City Attorney Balcomb to the Building
Inspector dated January 22, 1965 regarding acessory Buildings was
read. This was read due to the question raised by Mr. Whitaker
regarding Zick and Irwin properties. Discussion followed.
Discussion regarding ordinance and its loophole. Chairman appointed
Woodward and Whitaker to investigate.
Off street parking ordinance__ The worli"Principle Use" shall tve
omitted and the paragraph regarding use from McAlister, Oklahoma
Ordinance be included in the ordinance. Woodward moved to submit
letter regarding this change to council.
Discussion followed again on Walls proposal by Mr. Dunaway.
Whitaker does not seem to agree that Planning and Zoning should
inaugerate this plan but should be done in cone in continuing
service program by a planning consultant.
After Much discussion Mr. Whitaker finally appointed a committee
of Walls, and Benton to work out details and report on the
organization of such committee, to woek up a community planning
project for the Business District covering density, municipal
and private off street parking, malls, traffic flow and expansion
of the Business District.

Meeting called to order at 8:09 P.M.
Present were Woodward (late) Benton, Walls, Whitaker, McEachern
absent.
Hold June 14th minutes for correctoin until next meeting.
No Building Review.
Pelletier Plan continued.
Beruman Annexation. Letter from City Attorney regarding Berumen
Annexation, and requesting that Planning and Zoning work out
zoning recommendation. Moved by Benton that a Public Hearing
on the zoning of the Beruman property be set for July 19th, and
that notices be sent to property owners and published in the Aspen
Times. Seconded by Walls. Motion carried.
Little Percent Taxi. A letter from the City Attorney read with
an opinion that the Taxi use is an illegal extension of a non_
cpnforming use. Moved by Benton that the City Council be re_
quested to initiate legal action against the Little Percent Taxi
and its owner, based on the opinion of the City Attorney.
Secondad by Walls. Motion carried.
Amelia's Sign. A complaint drawn by the City Attorney was pre_
sented. Moved by Benton to authorize the Chairman to sign the
complaint. Seconded by Woodward. Motion carried.

Mr. Walls proposed that the Chairman appoint a two man committee
from the Planning and Zoning Commission to organize a joint

A copy of the supplemental report on Zoning Regulations prepared
by Jerry Brown was presented to all members.
Wagner Park Parking Structure. A letter from Leon Wurl was read
requesting the Planning and Zoning to make recommendations to the
City Council regarding the use of Wagner Park. Moved by Woodward
that a recommendation be sent to the City Council: That the City
undertake a feasibility study of underground parking at Wagner
Park, and that consideration be given to the leasing of spaces in
lieu of providing spaces under the parking ordinance as a means
of possible financing. Seconded by Benton. Motion carried.
Secretary to draft a letter for the Chairman's signature.
South Annexation. Continued until next meeting.
Small Lot Clause. No further reply from Estes Park. Moved by
Benton that the Committee report be sent to the City Attorney
to be d;afted in ordinance form. Seconded by Woodward. Motion
carried.

Parking Compliance.
Ullr Plot plan not available
Chatelet plan not available.
Moved by Woodward that by the next meeting the Building Inspeactors
Office request either the owner or contractor of the Limelite,
Ullr, and Chatelet to submit to the Planning and Zoning Com mission
the plot plans that were approved under Building Review. Seconded
by Benton. Motion carreid. Whitaker has disuussed the Mountaineer
with the City Attorney. Whitaker moved that aletter be sent to
the mountaineer stating that conditions required under P. and Z.
approval have not been complied with. Seconded by Benton. Motion
carried.
Accessory Buildings. A letter from former City Attorney Balcomb
was read concerning accessory buildings. This was due to the
question raised regarding buildings on the Zick and Irwin proper-
ties. Chairman appointed a committee of Whitaker and Woodward to
investigate the possible loopholes in the ordinance and report
back to the Commission.
Off Street Parking Ordinance. Moved by Woodward that a letter be
sent to the City Council recommending the removal of the word "
"Principal Use" and including the section from the McAllister ordi-
nance as read by Mr. Walls. Seconded by Walls. Motion carried.
Joint Planning andZoning and Citizens Planning. Fruther discussion
on the proposal by Mr. Walls. The Chairman appointed a committee
of Walls and Benton to work out details and report on the organi-
zation of such a committee, to cover a community planning project
for the Business District covering density, municipal and private
parking, malls, traffic flow and expansion of the Business District.
