MINUTES Regular Meeting of Planning and Zoning Commission July 25, 1966 Meeting was called to order at 8:08 P.M. by Mr. Whitaker Roll Call: WoodwHEd _ Absent (arrived late) Benton - here Whitaker - here McEachern _ absent Walls - here Minute s : Discussion concerning minutes of June 28th, 1966. Benton moved that minutes of 2nd reading be approved. Seconded by Woodward. Woodwara - yes Benton - yes Whitaker - yes Mceachern- Absent Walls - No Benton moved that op~n~on be obtained from the City Attorney on taking of minutes. Seconded by Woodward. Motion carried. Beruman Annexation: Whitaker said that the absence of the members for the Public Hearing was inexcusable. Discussion followed regarding the suggested zoning of this annexed area in either Tborist or R-6 or T. Mr. Brown (planner) felt that a higher density in the way of a Tounist designation is not desirable. The R-6 designation suggested , he would like to make a study before making a com- ment or recommendation. Whitaker read the names on the petition for zoning the annexed area either Tourist or R-6. Whitaker felt that a master plan of streets and right_of_way for this area be worked up befae increa&ing the density. The present street system is not adequate. Berumen requested that discussion be included in the minutes. Mrs. Johnston, Attorney, said that all Mr. Berumen is what is shown on the Master Plan. Benton moved that Sunny Park Subdivision and Sunny Park North Subdivision be zoned &..15" pending a major street plan and agreement with the County Planning and Zoning on the zoning of the adjacent area. Woodward seconded the motion. Discussion _ Woodward mentioned that Planning and Zoning should get together with County and that we should not spot zone at this time. Henry Thurston, Building Inspector said that the planning and Zoning Commission owes it to Mr. Berumen to try to get this property in a position so that he can use it. He has been talking about this for 2 years. Page 2 Minutes of July 25, 1966 Planning and Zoning Commission are happening in this area. Whitaker said 2 months ago that a request for a master street plan was made to council. No answer has ben recieved from the council. Brown-(planner) says thatcthe boundaries show on the master plan are loose and is explained inthe text of the master plan. Berumen said all of the property owners are aware of the problem. Benton said that one property owner did not recieve notice, therefore the public hearing is not valid. The one person in question was Mr. Wm. Lane. This will have to be checked out. Thurston _ said that his secretary was not an attorney and she is not supposed to determine property owners for a public hearing on a zoning change. Motion was voted and carried. Mr. Whitaker will call Edgar Stanton, chairman of County Planning and Zoning, and set up a meeting. Street plans for Smuggler Area: Whitaker suggested that another letter be written to the council requesting a master plan for streets in the Smuggler Area with a map of the area enclosed. Woodward so moved; Benton seconded. Motion carried. Whitaker said that communication with the City Council is not too good. Whitaker appointed Tom Benton to appear at all Council meetings. Mr. Benton accepted the appointement. Thurston said that Benton should impress the Council with the urgency of the situation. Arne lias Sign: Whitaker reported _ Amelias was fined $150.00. Two of the signs are down, but the large signs above still remain. Whilitaker says that acconding to the will of the commission the Board of Adjustment should be informed at their next meeting that the present signs meet with the planning a and zon ing approval. pelletier Plan: No action by the City Attorney. Page 3 Minutes of July 25, 1966 meeting Planning and Zoning Commission Mr. Thurston announced that the man working on the cross connections will go around and take pictures of all signs in the City and in the proposed annexed area with size and deminsion information necessary, to become a record to determine conformance or non-conformance to the new sign ordinance now under consideration. Arthur's was sighted for non conformance of signs, has appeared in court and was fined $150.00 with a suspended sentenct if he complied with the ordinance. Knit Ski was sited for not applying for a sign permit. Re: HHght Mr. Thurston askecl the Planning and Zoning a question regarding height parapet walls. He said he is assuming that height measured in Business District would be to the top of the flat roof. He felt that the top of the parapet is not the top of the building. . . Discussion followed regarding height of parapet. Building Review: Remodel & additions to existing Texaso Service Station, problem regarding proposed signs. There was also discussion regarding whether there is a problem on off street parking. Whitaker felt that Planning and Zoning doesn't havv to review the plans at this time. Mr. Thurston felt that he can issue a building permit tommorrow and is not applicable to todays laws. Whitaker said that we then do not have to review the plans. Woodward made a motion that the Texaco Drawings not be reviewed by the Planning and Zoning Commission because they were not submi- submitted to the plan check committee 7 days prior to the scheduled Planning and Zoning meeting.
