Regular Meeting
Aspen Planning & Zoning
November SI. 1966
Meeting was called to order at 8:00 p.m. by Chairman Francis Whitaker
with Secretary Jack Walls, King Woodward, Tom Benton and Sam Lum.
Also present Building Inspector Henry Thurston.
King Woodward moved to approve the minutes of October 11th, 18th and 25th.
Seconded by Tom Benton. All in favor.
Chairman Whitaker called the public hearing open to the public on the
subdivisionof Sunny Park and Sunny Park North Subdivision.
Commission agreed to wait for Anthony Berumen to arrive.
Mr. Berumen arrived.
Mr. Whitaker asked if there were any members of the public who wished
to speak.
Chairman Whitaker read the public hearing notice, as mailed to all
property owners in the subdivision and those within 300'. There being
no comments from the public, the hearing was turned over to the Commission.
Commission reviewed the preliminary plat and the following recommendation
from the Mountain States Telephone and Telegraph. "It is our recommend-
ation that a 10' utility easement be allowed in the Sunny Park and
Sunny Park North replats".
Discussed if preliminary plat should show the proposed utility easements
and utility lines. Commission agreed the easements and utilities
do not have to be shown on the preliminary plat.
Mr. Berumen stated he would like the Commission to issue a Certificate
of Acceptance.
Sam Lum moved that the preliminary plat be approved with the recommend-
ation that the final plat be submitted showing all utility easements.
Seconded by Jack Walls. All in favor.
Mr. Berumen stated he would be willing to cooperate by filing the final
plat, but would like the Commission to issue him a Certificate of
Acceptance.
Jack Walls read State Statutes relating to the Certificate of Acceptance.
If the subdivision preliminary plat is not acted upon within 30 days
after being submitted, they are automatically approved, and the sub-
divider can demand a Certificate of Acceptance and is not required to
submit a final plat.
Chairman Whitaker called the public hearing to a close.
PUBLIC HEARING - AMENDMENT TO ZONING CODE
Chairman Whitaker opened the public hearing on the amendment to the zoning
code relating to notification to property owners for public hearing.

Secretary Jack Walls read Ordinance #33, Series 1966 in full. Essence
of the Ordinance was explained by Chairman Whitaker.
There beiggc;uo:futther comments, motion was made by Jack Walls, seconded
by Mayor Barnard that the commission recommend to the City Council that
the special procedure, Ordinance #33, Series 1966 be approved. All in
favor, motion carried.
BUILDING REVIEW
Guido Meyer, Cooper Street, Addition to Sport Shop.
Committee reported the plans met with the zoning and off-street parking,
but stated the building does not meet'with the fire zone code, also code
requires 2 sets of plans and only 1 set was submitted.

TITLE XI
Tom Benton read rev~s~on relating to rear yard in the two C zones.
Letter from Tony Berumen, read by Secretary Jack Walls was discussed
relating to minimum floor space, feels ordinance should provide for a
maximum instead of minimum floor space. Chairman Whitaker stated this
would be brought up at the public hearing.
Building Inspector, Henry Thurston, stated the proposed Title XI does
not show a definition for subdivided land, feels we should specify the
size of a small lot. Also discussed a definition for open space. Sepp
Uhl asked if there would be a m~n~mum on signs. Commission stated the
new ordinance would be more flexible in that there would be no minimum.
MALL
Commission agreed in order to have a successful mall, it must be per-
manent, parking must be considered and the maintenance of the mall.
Chairman Whitaker appointed Jack Walls, Tom Benton and Jerry Brown to
work on a plan for a mall, to be ready to go by next spring.
ABSENTEE MEMBERS
Letter from the City Attorney was read by Chairman Whitaer relating to
Absentee members. Commission agreed to 3 unexcused absences per calender
year would constitute grounds for dismissal from the Commission. It
was moved by Tom Benton to recommend to the City Council 3 unexcused
absences in one calender year constitutes grounds for dismissal.
Tom Benton withdrew his motion.
Commission agreed to have Chairman Whitaker write a letter
recommending 3 absences per calender year would be grounds
to Counc il
for dismissal.

Escused absences would be illness, absnece from the City or extenuating
circumstances. Notification must be given to the Secretary or Chairman.
Letter was read by Chairman Whitaker relating to the withdrawing of
Sam Lum's resignation.
King Woodward stated he would be moving out of the City before the next
meeting and will have to resign. Chairman Whitaker requested the
Secretary draw up a Resolution commending Mr. woodward for his fine
service on the Commission.
Chairman Whitaker and Secretary Jack Walls stated they would be out of
town for the meeting of November 22nd.
Mayor Barnard, seconded by Jack Walls to adjourn at
in favor, motion carried.
