JOINT MEETING OF THE CITY AND aoUNTY PLANNING COMMISSIONS APRIL 14, 1964 CITY HALL, ASPEN, COLORADO Present were: Jack Walls, Francis Whitaker, Mayor Harald Pabst, Fritz Benedict, and City Administrator John Kerrigan. The meeting was called to order at 8;00 p.m. by Chairman Jack Walls. The first item presented for discussion was the proposed Building Review Ordinance. Mr. Walls stated that copies of this had been sent to City Attorney Balcomb, and Mr. O'Rourke of the Colorado Municipal League. He read the comments on this from O'Rourke (dated April 6) and from Balcomb (April 7). He stated that he feels that Mr. Balcomb doesn't fully understand just what the Planning Comm- ission is trying to accomplish with this ordinance; the people will still be able to go to the Board of Adjustment, and merely another step will be added instead of any power being usurped. Mr. Whitaker mentioned the problem of persons going ahead with con- struction before a building permit is obtained. Mr. Kerrigan stated that he doesn't think that this occurs very much; however, the dorm- itories~n Block 70 were cited as an example of this having happened. Mr. Kerrigan feels that the ordinance would add unnecessary steps, making the obtaining of a building permit more difficult; feels that the Building Inspector should be able to handle the necessary check- ing,and that the only thing that the Building Inspector would not do that the Planning Commissions would do is the checking of method of design. Mr. Walls feels that this ordinance is the only way to ob- tain any sort of control over the new construction, and Mr. Benedict doesn't feel that it wouli be a great hardship, and other cities have this type of thing. It was stated that the plans would be filed, and no variance from them would be allowed without permission from the Commission; also, off-street parking could be controlled. Mr. Whit- aker feels that a Building Review Ordinance should be tried, and Mr. Walls suggested that the present ordinance be reworked and presented in the form of a report to Council. Mr. Walls read the portion of Ken Balcomb's letter with regard to amendment to the Zoning Ordinance, and the necessary public hearing. Discussion followed. Discussed - R-1S zone. jack mentioned a letter which he had sent to the Council regarding "the establishing of such a zone, which had apparently never come up for Council discussion. Mr. Walls read the letter to Mr. Wiener of April 1, and April 9, regarding the maps Wiener had sent. Mayor Pabst mentioned the problem with truck campers, because of their lack of sanitary facilities, and parking. Discussed was the possibility of going to trailer courts, or having the Forestry Ser- vice keeping a campground plowed. In regard to Subdivision Regulations, Mr. Kerrigan feels that those sent by Mr. Wiener are workable except in a few areas~ It was stateed that subdivision regulations should become as regular laws in zoning ordinace, and complied with as such; and if possible the same ones should be adopted by both City and County, even though they are set out primarily for the Sounty. April 14, 1964 Page two water, etc. are concerned, and he also feels that sidewalks in the R-1S zone are questionable. Discussed was the possibility that reg- ulations should be different for varying grades, and the dropping of streets, sidewalks and curbs. Discussed - City having a copy of State Statutes, and Mr. Kerrigan stated that they would be available soon. Mayor Pabst stated that he feels that the use of the term "aesthetic control" could possibly cause antagonism, and Mr. Walls stated that the term was not used in the proposed ordinance; the term "building review" is used. Mr. Kerrigan reported that the flushing of the streets should be completed by April 16, and also that the Justice of the Peace had contacted him regarding jailed persons working on the streets. In regard to Curb Cuts, Mr. Whitaker quoted from the minutes regarding changes in the ordinance which Mr. Kerrigan had proposed (one 20' cut or two 12' cuts.) Mr. Walls mentioned alleys as a means of access to property, and feels tha~corners should be given no special consid- eration. It was the feeling of the Commissions that the Board of Adjustment should set up a policy regarding filling stations, >> possibly allowing them two 20' cuts with a minimum space of 20' between them. Mr. Walls suggested that the same curb cuts be allowed for Tourist, Residential and Commercial Districts. Mr. Benedict showed a plat and scale model of the Aspen Alps Club. He stated that the Aspen Alps Club would like to have permission to pave Ute Ave., which runs between the present unit and the one to be constructed soon, in a manner as shown; in this way, it would be more like a mall, and would be landscaped right up to the pavement, which would be curved through the block. He also stated that most of the access to the buildings is off the street, causing little congestion on the street, and that he had taken this proposal to the City Council and had been referred to the City Planning Commission. Mr. Whitaker suggested that the proposed pavement be widened from 20' to 24', and Mayor Pabst stated that the City would have to re- tain the right to widen and straighten the street so that it would be a normal size, should the need ever arise. Mr. Walls feels that this may set a precedent, and encourage the closing or restricting of other thoroughfares by private means. The Commissions are in general agreement that this sort of informal-appearing paving and other such improvements should be encouraged. Discussed - Glory Hole and Durant Mine, and possiblity of filling up the Glory Hole and using it for parking.
