ASPEN CITY PLANNING COMMISSION
MARCH 31, 1964

Present were: Jack Walls, Francis Whitaker, Richard Lai, Andrea Law-
rence, and Bill McEachern.
The meeting was called to order at 7:45 p.m. The motion was made to
approve the minutes of March 10 as corrected, and those of March 23,
and was seconded and carried.
In regard to the petition for annexation of Dorothy Koch Shaw, it
was stated that there is a petition from the County Commissioners
asking the City to annex the street next to the property which had
been overlooked previously. This petition, and the amended petit-
ion of Dorothy Koch Shaw, was read.- Discussion of the plat accom-
panying the petition followed. Mr. McEachern stated that the City
Council is somewhat disinclined to accept this petition, as the an-
nexation of the property would not help to strighten the City bound-
aries; he also stated that the City does not own land to t~e center
of the street as had been previously thought. Mr. Whitake~eels
that the annexation of the lots makes sense, but that annexing of
the street doesn't from the stand00int that it will not straighten
City boundaries. The letter to the Council of March 23 in which the
Commission recommended acceptance of the Shaw petition was read. It
was stated that the remaining portion of the block won't be free
for annexation for some time. Mr. Walls feels that another letter
should be written to the Council, stating the Commission's views on
both petitions. Richard Lai moved that it be recommended to the
Council that both petitions for annexation be accepted, and Mr.
McEachern seconded. Discussion followed as Mr. Whitaker asked if
the petition of the County Commissioners included the street only,
and it was stated that it does. Motion carried.
The letter of March 24 from the ColorFdo Municipal League in regard
to sample ordinances on Building Review was read. Mr. Walls sug-
gested that a final draft of the proposed ordinance be sent to
Mr. O'Rourke of the League, and this proposed ordinance also sent
with a coPy of the letter from Mr. O'Rourke to Ken Balcomb. The
other members concurred with this suggestion.
Jack Walls stated that Subdivision Control Regulations were received
from Mr. Wiener on March 30, and that John Kerrigan had gone over
them and made the comment that they "appear to be quite workable."
A final draft of existing facilities, and several maps of existing
facilities have been received. Mr. Kerrigan's letter to Mr. Wiener
of March 25 regarding discrepancies he had found in several maps was
read. Discussion of the maps followed.
The Existing Land Use Map: Several discrepancies were found by
the members, and it was stated that this map should be
kept current and up-to-date.
Evaluation of Existing Buildings: It was suggested that this
might be turned over to the Historical Society so that
they might check it and make a report.
Transportation and Thoroughfare Plan: The members do not feel
that the traffic count figures are adequate, as only one
was taken and they feel tha~periodic checks should be made,
to give a full picture. Mr. Whitaker feels that besides
the traffic counts taken on Highway 82, that those in the
Tourist and Commercial zones are aero. There is a general
feeling among the members that peak and alack times must
be recorded before planning can be done accurately and
effectively.

A letter is to be written to Mr. Wiener, pointing out the discrep-
ancies so far noted, and informin~ him of the disposition of the
maps not checked by the Planning ~ommission members.
In regard to Density Control, Mr. Whitaker mentioned a proposed
zoning ordinance change in San Francisco which would raise the min-
imum lot area per dwelling from 400 square feet to 800 square feet.
Mr. Whitaker stated that the Council should be asked for an interim
ordinance for density control, and possibly consider 750 square feet
per unit. He then quoted from the Zoning Ordinance to the effect
that the Planning Commission can inaugurate proceedin~for a public
hearing on amending the Zoning Ordinance. He stated that he feels
that this interim ordinance is important in regard to the master
plan, because of streets, etc.
Discussed _ possibility of person adding an incidental use, such
as a restaurant, on top of living units, but density control only
takes into consideration persons living there, or the number of
persons which can be accomodated. Mr. Walls feels that it might
be better to have people living in the Commercial area, as this
would be a form of control as to noise, etc.
As to the interim ordinance, Mr. Walls feels that the best way,
to start would be with inquiring of Ken Balcomb as to how to
initiate proceedings, and asking for a time-table to follow in
regard to this amendment; also, he should be asked about policy
in regard to special meetings, and to find out if a public hearing
is necessary on an interim ordin~nce'on the basis of one year. Mr.
McEachern stated that Council is favorable to some form of density
control, but no action has been taken.
The proposed curb cut ordinance written by John Kerrigan was read.
There is a general feeling among the members that the amount of the
curb cut as set down in this proposal is too high. It was
suggested that the ordinance be reworked on the basis of having
two 12-foot cuts or one 20-foot cut in each block.
Mr. McEachern asked the Commission for opinions in regard to
liquor policy. He mentioned the three license applications which
will be heard on April 6, and that the Council is seeking some way
to control the number of licenses in Aspen without being unfair.
Meeting was adjourned at 10:30 p.m.
