JOINT MEETING OF TIlE CITY AND COUNTY PLANNING COMMISSIONS
MARCH 10, 1964
CITY HALL, ASPEN, COLORADO
Present were: Jack Walls, Francis Whitaker, Richard Lai, Andrea
Lawrence, Mayor Pabst, Henry Stein, Sam Caudill, Building Inspector
Jim Markalunas, City Administrator John Kerrigan, and Bill Mc-
Eachern came in later.
The meeting was called to order at 7:45 p.m. The minutes of the
last meeting were approved as distributed among the members.
The first item to be discussed was curb cuts. Mr. Whitaker read
a paper entitled, "Driveway Width Regulations", which dealt with
unrestricted use of curb space for driveways, and suggested that
some regulations be set up. Mr. Walls suggestua 20 foot curb cut,
which is one parking space. Mr. Whitaker suggested that the Coun-
cil should be asked to adopt some policy as to driveway standards,
but Mr. Kerrigan feels that the Planning Commission should arrive
at some policy on this. He stated that he would write to the Colo-
rado Municipal League on this, and Mr. Whitaker stated that he
would assist. The matter was continued until the next meeting.
Discussed _ Off-street parking. Richard Lai feels that the present
situation regarding this should be investigated and amended.
Mr. Markalunas asked if any survey had been made, comparing the
number of people who drive here and the number who come via public
transportation, and was told that the Aspen Ski Corp. had made
such a survey.
Disucssed _ Setbacks. Jack feels that the ordin.nce should be flex-
ible so as to allow the land owner to juggle the space and use it
as he wished, within the requirements. Jack askad Richard Lai
if he wopld work up a rough draft of a proposal on off-street park-
ing together with setbacks.
Discussed _ Building Review Ordinance. Mr. Walls explained to the
members of the County Planning Commission that at the last City
meeting a rough draft of a Building Review Ordinance had been
brought up, and suggested that they might wish to consider adopting
such an ordinance in the County. He summarized it as follows:
All new proposed construction would be reviewed by the Planning
Commission, and preliminary drawings would be submitted at least
30 days before application for a building permit; these drawings
would be checked against certain criteria. The rough draft of this
ordinance was then read. Jack explained that the Commission could
only make suggestions, and could also control development as it
progresses. Members of the County Planning Commission agreed that
this is a step in the right direction. It was stated that a letter
in regards to this had been written to the Colorado Municipal
League, but an answer had not yet been received.
Discussed _ Differences in zoning ordinances between the City and
County, particularly the boundary area. tt was mentioned that Jim
Markalunas had gone over the Zoning Ordinance and found several
discrepancies, in an attemnt to rectify the situation. Jack
stated that he had written a letter to the City Council asking them
to establish some interim zoning ordinance making the height limit
25 feet in the City, the same as is in the County. It was suggested
that perhaps the County Planning Commission members could go over
their ordinances, comparing them with the City's, and perhaps arrive

at some suggestions so that the discrepancies could be removed,
but Mr. Whitaker stated that he felt tha~erhaps this had already
been done because of adjustments made by the City in height and
setbacks.

Jack Walls read a letter from Mr. Wiener dated March 3, 1964, in
which he asked for the subdivision regulations of the City. It
was stated thationly a preliminary set of regulations had been used,
and Mr. Whitake'r referred to Section "H" of the contract which states
in part that Mr. Wiener is to recommend subdivision regulations.
Jack Walls read a letter from City Clerk Dorothy Hoffmann and
showed a plat and other documents relative to the petition for
annexation by Dorothy Koch Shaw. The area is located near 6th and
Hopkins. It was pointed out that the area is very small, and is
only a part of the section of a block which is divided by the
County line which lies in the County. Jack doesn't feel that this
small portion, or any small area, should be annexed; he feels that
the entire remainder of the block should be annexed. Mr. Whitaker
feels that anybody who wishes land to be annexed should be allowed
to, and reasonable rules set UP so that people can easily annex,
thereby straightening out the City boundaries. The remaining area
in this particular block, Block 19, is under litigation as some
property lines seem to overlap. Mayor Pabst suggested that ar-
rangements be made with both parties involved in this litigation
so that whoever wins will agree to annex. It was also suggested
that Roy Vroom, who originally presented the petition, talk to
the other two parties and make these arrangements. Discussed-
the street. Th~roperty line goes to the center of the stree~,
but it is generally agreed that it ~ight be better to annex the
property on the other side of the street so that the care of the
street is the responsibility of the City, rather than being split
between City and County. Also discussed were utilities - power
and sewer. It was stated that the streets in the area are unimproved,
and Mr. Kerrigan feels that the party involved should improve them
to a level comparable to the City. It was stated that Mr. Wiener
should be asked to supply some standards and policy on annexation
requirements. The matter of the annexation petition of Mrs. Shaw
was continued until the next meeting.
Mr. Whitaker brought up the question. of off-street parking in the
Unrestricted Zone. He mentioned the Denver Buick Case. It was
stated that off-street parking was required in every district but
the Unrestricted Zone; however, it has not been enforced. Sam
Caudill and Jack Walls are going to look into this.
Mr. Whitaker suggested the establishment of ~ Park or Greenbelt
Zone, and he feels that parks should be zone~for park use and never
used commercially, but should be protected. This zone can be ap-
plied to parks and green areas. The proposed library on Paepcke
Park was mentioned. Mr. Whitaker moved that the Joint Commissions
request the City Council and the County Commissioners to create a
Park Zone in the Zoning Ordinance, without necessarily applying
it to any particular piece of land, and a copy of this request
sent to Mr. Wiener. The motion was seconded, and was carried.

Henry Stein spoke on the importance of keening accurate records of
all proceedings and activities of the Commissions. He stated that
County zoning was about to be attacked in a lawsuit, relative to
some land which originally belonged to him, and a County right-of-
way. This began several years ago, and when the County Planning
Commission was organized several years ago, minutes were not kept;
therefore, none can be produced. He stated that his point is to
emphasize the importance of keeping all records with great formality
and care, so that they may be referred to. The other members con-
curred with this.
Mr. Whitaker asked the County Commission members about the status
of the enabling resolution to activate the Regional Planning Com-
mission. He stated that Eagle County members have orepared sub-
division and sanitary regulations, and he wants to report that Pit-
kin County has done something. He explained that he was appointed
by the City, and Fritz Benedict and Wendy Morse were appointed by
the County.. ~ will attend the next meeting of the County Commis-
