CITY AND COUNTY PLANNING & ZONING COMMISSION MEETING
The City and County Planning and Zoning Commissions met on
Tuesday, June 25, 1963, at City Hall. Present were: Jack
Walls, Frank Humphrey, Richard Lai, Frederic Benedict, Sam
Caudill, Ken Moore, Mayor Mike Garrish, Bill McEachern, Wendy
Morse. Others attending the meeting, not members of the
Commissions, were Francis Whittaker, Mick Strong and Jess
~!addal one.
The meeting was called to order by Chairman, Jack Walls. He
read a letter received from Mr. Wiener, in which there was
a request for information to be supplied from this group.
Mr. Walls was going to distribute the questions for different
members of the Commissions to answer. There was discussion
on these questions, and it was felt that no research should
be done by this group for the planner, but that those
statistics which are compiled and readily available should
be sent to him. The other constitutes part of the work of
the Planner himself. It was felt that if incorrect or in-
accurate figures were given to the Planner, he might have
some comeback on this group. The Mayor and Mr. Whittaker
felt that the Planner should perform these duties,partially
in order to get the feel of the community. Mr. Moore and
others felt that there should be a resident planner in Aspen.
Mr. Benedict felt, too, that the planner should become
familiar with the area in order that a plan not be super-
imposed upon the community by one who is not involved in it.
The Chairman will send those facts which are compiled and
readily available to the Planner and will simply state on
the other questions that the information is not at hand.
Mr. Walls also read a letter from Clint Stewart regarding the
rezoning of the west end of town, and asked the group whether
there was any other matter to come before a public hearing.
It was stated that Riverside Subdivision has been annexed
but not rezoned, and possibly the East Aspen patent area
will require rezoning with regard to setbacks. Mr. Whittaker
cautioned the group to be very careful about any zoning
changes or variances that amount to changes in zoning before
the Planner makes his recommendations. He felt that the
planner should familiarize himself with the town and the
people by doing research on the town as part of his own
educational process.
Bill McEachern read the minutes of the meeting of May 28th
which were approved as read.
Clint Stewart is awaiting the ordinances on Sante Fe and
Monterey with regard to the Historical Society. It was
suggested that those persons who will be involved in the
Historical Society be approached before any steps are taken.
Discussion followed regarding the rezoning of Riverside
which is presently R-6 and R-15. Mayor Garrish suggested
study and recommendations on this problem to the City Council.
The area must be taken into the city zoning. The matter was
tabled until the next meeting. Mr. Whittkaer suggested that
the matter be sent to the Planner.
Mr. Maddalone and Mr. Strong then presented their plan for
a trailer court, which presentation had been previously mde
before the Board of Adjustment, and a variance in the zoning
allowing such trailer court was granted. They stated what
their plans were with regard to sewage, underground electrical
connections, and uncertainty as to using city water, as well
as plans for barbeques and playground areas. Mr. Stanton
was said to have received a call from D.R.C. Brown and Robert
Kopp who object to the creation of the trailer court there.
However, twenty-six notices were received stating no complaints
by adjoining property o,mers. Possible other objectors may
be Buck Buchanan, the Sparovicks, Mrs. Mikkelsen and Fred Madsen, Jr.

Messrs Maddalone and Strong were then told by Mr. Stanton
that they had to come to the Zoning Commission rather than
to the Board of Adjustment. Mr. Morse stated that this
entire situation resulted from poor liason. The need for a
trailer court has been shown, and this seems to be an ideal
location for it. Mr. Morse stated that he did not see how
this group could renig on the ruling of the Board of Adjust-
ment, but Mr. Strong had been told that the Council should
hold a public hearing on a change in zoning. Mayor Garrish
stated that precedent had been established to the effect
that the decisions of the Board of Adjustment are final.
However, the men who wish to begin work on the project were
reluctant to do so in view of the possibility of a lawsuit
in which the legality of the decision of the Board of Adjust-
ment would be questioned. Mr. Morse suggested putting the
matter in the hands of the attorneys for the Board of Adjust-
ment and to try to clear the matter up by one week from today.
Contact with Mr. Delaney, Mr. Stewart and the County Com-
missioners was to be made. He suggested, however, that the
two applicants make application now for rezoning, in the event
that the decision of the Board of Adjustment were nullified.
Mayor Garrish stated that if the Board of Adjustment is able
to grant a variance of this type in the city, it could rezone
the entire area. Mr. Maddalone and this group are to contact
Mr. Wendt and Mr. Delaney. Mr. Strong stated that an un-
restricted piece of property was rezoned to R-15 without
notice to the property owners, in the past. Mr. Caudill and
~!r. Wendt are to call Mr. Delaney and notify the applicants
of their decision. Mr. Benedict stated that the Palm Springs
ordinance requires walls or screening of some nature for such
a project, but that the proposed location will afford natural
screening by the mine dumps. He asked that the applicants
submit a more complete plan to this body and be very specific
with regard to landscaping, water, etc. - a plan for final
and complete development.
Mr. Walls said he had a list of books he wished to purchase
for the education of the members of the Boards of Adjustment
and Planning Commissions, and received approval of the Mayor
for the expenditure of $38.00 for these books.

Mr. Benedict brought up the matter of uprooting of trees
which is being done by the City with regard to its curbing
program.
Mr. Whittaker stated that low cost housing is a myth and
always has been. The only way to get it is to have sub-
standard housing, which is not good for the community. The
ideal way to handle the need is to have large and small lots
within the same subdivisions, to create a balanced community
rather than setting aside portions of the town for low cost
housing. This is cluster housing, done with private moneys,
with green areas within the plans. The cost for the developer
is less and the advantage to the public greater. Guarantees
should be in the subdivision agreements with regard to
permanent maintenance of the property as proposed. This
type of housing preserves scenery, is attractive to sub-
divider as well as to the people, and costs are lower due to
concentration of facilities. Traffic is not on these streets
as the drives open to minor streets, not main ones. The
only answer to low cost housing presently is trailer courts
here or government subsidy.
