JOINT MEETING OF THE CITY AND COUNTY ZONING COMMISSIONS
Tuesday, May 15, 1962
Present: Fritz Benedict, Jack Walls, Herbert Bayer, Fred
Glidden, Ken Moore, James Markalunas, and visitors Mr.
Hirsch and Mr. Contini.
The meeting was opened at 7:50 P.M. by Mr. Bayer. The minutes
were read by Secretary Jack Walls, and approved.
It was reported that the temporary sign ordinance was being
typed and discussed by the City Council. Ken Moore is to
follow it up and bring back report on the Council's action,
as he is to do with other matters so requested by the Planning
Commission. He requested instructions from the Commissions with
re$pect to matters in which they are interested. There followed
a lengthy discussion on the lack of communication between the
City Council and Zoning Commission. Mr. Bayer requested that
Mr. Moore bring back to the Commission the reactions of the
Council and its action on different proposals of the Commission.

A letter has been received by the City Zoning Commission stating
that $500 is authorized for consultation, $280 is the rest of
its budget, and no expenditure over $8.00 is to be made without
the approval of City Council. The expenditure for maps, authorized
by an earlier Council, seems to have sparked this action by the
Council. Mr. Bayer asked Mr. Moore to convey that this procedure
will restrict the Zoning Commission's actions unduly.
Changes are being made in street width (Mill Street) without re-
gard to the street layout plan proposed, and not acted upon by
the Council. The same is true of planting being done in Wagner
Park without regard to the Tree Planting Committee or its plans.
Mr. Contini was asked for his opinion on procedure, and he said
that City Council was to assign its problems to the Planning
Commission for study and recommendations. After its study, it is
the duty of the lias on person to see that it is reported back to
the City Council. Action is initiated by the Council. Mr.
Contini felt that there exists here an unhealthy situation wherein
neither group has confidence in the other. The outside planner
should make recommendations, and then the Planning Commission and
the City Council come together and discuss the recommendations,
and possibly alter same, before further action is taken. In
this way both the City Council and the Planning Commission would
work together towards a common goal. Mr. Bayer stated that until
recently there had been the best collaboration between the groups.
With regard to the Zoning books and maps, Mr. Markalunas stated
the new Zoning Map has not yet been formally approved. He stated
that the Zoning Commission should write a letter to the City
Clerk informing her that the Zoning Map had been approved by the
Commission. Also that the approval in writing on the map, with
the signatures of the Chairman and the Secretary of the Planning
and Zoning Commission, should be attached. Mr. Walls is to write
the necessary letter to the City Clerk, and Mr. Benedict is to
letter on the map the approval ready for the Chairman and Secretary
to sign. It was indicated that after it was approved Mr. Benedict
would be paid.
The matter of the closing of the streets is stillpending, and was
discussed. Absentee ownership was one of the reasons it has not
been adopted. It was suggested that after we have obtained our
regional plan, that it may suggest an Urban Renewal Project. In
this way, with Urban Renewal, it would be possible for the city
to sell or lease the closed streets, and thus gain money to carry
out some of the projects. This will be looked into only after we
have obtained a regional plan.

Mr. Markalunas stated that the Codification of the City's ordinances
would be for sale in its entirety or in sections. The County
map is being held up by Mr. Delaney who is to be doing the wording
for F-l and B-2.
Mr. Bayer brought up once more the desire to zone all of Pitkin
County, especially the entire area along the Highway. A dis-
cussion then followed on County zoning, which now goes only to
Gerbaz'. It is desired to have the entire County zoned, parti-
cularly along the Highway. Mr. Markalunas suggested putting in
unrestricted zoning along the highway for two reasons: it would
put the entire county under the jurisdiction of the Board of Ad-
justment, and be<;ause of the name "unrestricted" would not be
strong enough to be rejected. We should move slowly lest we be
downed entirely in the county. This is also true in the matter
of signs. There has been voluntary cooperation, but you don't
know when property will change hands or people will change their
attitudes. Mr. Glidden is to feel out the County Commissioners
as to Zoning down the valley.
Mr. Markalunas reported that he is keeping his eyes on the
trailers around town.
Mr. Bayer brought up the matter of loudspeakers at the Highlands
which are disturbing to those on Red Mountain. Mr. Contini said
that the level of sound can be regulated by ordinances, but after
discussion, it was felt that the matter of music regulation be
best left alone, as there is practice by musicians all summer,
which might be disturbing to some.
Mr. Markalunas stated that the Lions were attempting to start a
system of numbers for houses in Aspen, and showed an aspen leaf
motif with numbers which they proposed as a possible uniform
display of such numbers. After discussion the group was obviously
opposed to the aspen leaf motif in the numbering, and Mr. Bayer
and Mr. Benedict are to look up appropriate numerals to present
to the groups and to the Lions Club for identifying houses. Mr.
Markalunas said he hoped for some conformity in location of the
numerals.
Mr. Walls brought up again the problem of the directional signs
at the Maroon Creek and Castle Creek junction. At present the
directional signs do not exist. He asked for clarification as
the process of approving any new signs. It was stated that any
new signs would have to be submitted in the form of a drawing to
the County Zoning Commission for approval.
Mr. Moore inquired about the proposed gas company building.
Mr. Walls also asked Mr. Bayer what the status of Mr. Weiner is
at present. and if he has started work on the Regional Plan first
phase. Mr. Bayer stated that Mr. Weiner has not started work
because he is waiting for a contraot. It was not clear whether
Mr. Stewart or Mr. J.K. Smith was preparing the contract for Mr.
Weiner.
