HomeMy WebLinkAboutresolution.council.071-07 RESOLUTION NO. 71 (Series of 2007) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, SUBMITTING TO THE ELECTORATE OF THE CITY OF ASPEN A CERTAIN QUESTION SEEKING AUTHORITY TO LEVY A NEW 0.15% SALES TAX AND 2.1 % USE TAX FOR CITY TRANSIT SERVICES AND PEDESTRIAN AMENITIES. WHEREAS, the City of Aspen currently operates eight transit routes that carry over one-million passengers annually; and WHEREAS the annual cost of providing quality transit services is outpacing current funding mechanisms; and WHEREAS a comprehensive transit network coupled with a safe pedestrian environment is key to Aspen's vitality and quality oflife; and WHEREAS, the City Council desires to continue meeting the Aspen Area Community Plan's goal of keeping traffic at 1993 levels in perpetuity; and WHEREAS, the current 0.25% sales tax for parking will expire on September 2, 2009 and City Council has determined that the fees for City parking services will be set so that parking services and facilities will be self-supporting; and WHEREAS, the grow1h in demand and cost of local transit services and equipment demonstrates the need for sustainable funding sources to continue to provide these services and replace transit vehicles with alternative fuel upgrades; and WHEREAS, the City Council desires to continue to enhance pedestrian crossings at strategic locations and complete segments of missing sidewalks to provide safe, direct and continuous connections between destinations and to transit; and WHEREAS, the City Council desires to continue to improve bus stops at high demand locations; and WHEREAS, the Section 12.1 of the City of Aspen Home Rule Charter requires voter approval to levy and collect taxes. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT: The following question shall be placed on the ballot at the November 6, 2007, SHALL CITY OF ASPEN TAXES BE INCREASED BY AN ESTIMATED $1,722,000 FOR THE FIRST FISCAL YEAR (2008) FOR CITY TRANSIT SERVICES AND PEDESTRIAN AMENITIES SHALL CITY OF ASPEN TAXES BE INCREASED BY AN ESTIMATED $1,722,000 FOR THE FIRST FISCAL YEAR (2008) AND BY SUCH AMOUNTS AS MAY BE GENERATED ANNUALLY THEREAFTER BY A NEW 2.1% USE TAX ON CONSTRUCTION AND BUILDING MATERIALS; PROVIDED THAT THE FIRST ONE HUNDRED THOUSAND DOLLARS ($100,000) OF EACH BUILDING PERMIT VALUATION SHALL BE EXEMPT FROM USE TAX; AND SHALL CITY OF ASPEN TAXES BE INCREASED BY AN ESTIMATED $870,989 FOR THE FIRST FISCAL YEAR (2010) AND BY SUCH AMOUNTS AS MAY BE GENERATED ANNUALLY THEREAFTER BY A NEW 0.15% SALES TAX BECOMING EFFECTIVE UPON EXPIRATION OF THE CURRENT 0.25% SALES TAX; AND PROVIDED FURTHER, THAT THE REVENUES DERNED FROM SUCH SALES AND USE TAXES SHALL BE USED TO PAY THE COST OF OPERATION, MAINTENANCE, CAPITAL REPLACEMENT, AND IMPROVEMENTS OF CITY TRANSIT SERVICE AND PEDESTRIAN AMENITIES; AND, PROVIDED, FURTHER, THAT THE FULL AMOUNT OF REVENUES DERNED FROM THE SALES AND USE TAXES MAY BE RETAINED AND EXPENDED BY THE CITY NOTWITHSTANDING ANY STATE REVENUE OR EXPENDITURE LIMITATION, INCLUDING THE LIMITATION CONTAINED IN ARTICLE X, SECTION 20, OF THE COLORADO CONSTITUTION? INTRODUCED, READ AND ADOPTED by the City Council of the City of Aspen on the 27th day August, 2007. I, Kathryn S.
