The historic resource meets three of the six Landmark Designation standards. COUNCIL GOALS: Landmark Designation meets Council Goal #10, the preservation of our community's historic character. BACKGROUND: The Standards for Landmark Designation are found in Section 7-702(A). Any structure or site that meets one or more of the standards may be designated "H", Historic Landmark. The Planning Office finds that this historic resources meets three of the six standards, as follows: B. Architectural importance: The structure or site reflects an architectural style that is unique, distinct or of traditional Aspen character. Response: The principal structure is best described as a typical one story Aspen "miner's cottage", with gable and window proportions illustrative of traditional Aspen character. We find that the outbuilding, due to the extensive and incompatible modifications, does not contribute to the architectural importance of the parcel. E. Neighborhood character: The structure or site is a significant component of an historically significant neighborhood and the preservation of the structure or site is important for the maintenance of that neighborhood character. Response: The contribution this small scale residential structure and open space makes to the Commercial Core Historic District is considered to be a valuable cultural asset. Only 10 historic cottages remain in the District, each balancing and supporting the historic character and scale of Aspen's commercial neighborhood. The 300 block of East Hyman alone contains four residences, three of which have been adapted to commercial use. Adaptive uses of historic resources are considered significant components of the character of the Aspen community. F. Community character: The structure or site is critical to the preservation of the character of the Aspen community because of its relationship in terms of size, location and architectural similarity to other structures or sites of historical or architectural importance. Response: Aspen' s "miner' s cottages" are signatures of our town. The preservation of these small scale, vernacular resources is critical to the character and economic vitality of Aspen, and are particularly unique located within the Commercial Core Historic District. Generally, these are found in areas that are predominately residential The recent renovation of the corner outbuilding 1/2 block north to an architect's studio may support the importance to retain the outbuilding as a contributing . resource to the character of the neighborhood. The HPC should evaluate the loss of this building in terms of this Standard for Landmark Designation. Staff feels that even with the demolition of the outbuilding, the parcel retains its historic significance and meets this standard. F. Community character: The structure or site is critical to the preservation of the character of the Aspen community because of its relationship in terms of size, location and architectural similarity to other structures or sites of historical or architectural importance. Response: Aspen' s "miner' s cottages" are signatures of our town. The preservation of these small scale, vernacular resources is critical to the character and economic vitality of Aspen. The HPC may find that the outbuilding, which has been used for small business purposes in the past, contributes to the character of the alley. The recent renovation of the corner outbuilding 1/2 block north to an architect's studio may support the importance to retain the outbuilding as a contributing resource to the character of the neighborhood. MINOR DEVELOPMENT AND EXEMPTION FROM DEMOLITION DISCUSSION: Earlier this year, Council adopted Ordinance 9 which added an exemption provision to Sec. 7-602 of the Aspen Land Use Regulations. This exemption made it possible for non-historic resources, considered to be non-contributing to the character of the resource, to be approved for demolition HPC without having to meet the rigorous standards for demolition. The application requirements still must be met, which includes the approval of a redevelopment plan, if required. The HPC has determined that all demolition requests require a redevelopment plan for approval. RESPONSE: The outbuilding proposed for demolition is 300 sq. ft., with a 113 sq. ft. enclosed porch. It is not habitable according to code, and encroaches onto the property to the west (La Cocina). The structure itself has been altered significantly over the years, and retains very little of its original architectural integrity. The applicant argues that the demolition and removal of this structure in order to provide three parking spaces may enhance the economic viability of the more significant resource on the parcel, the historic cottage. Parking spaces are at a premium in the 4 .. commercial core, and the Planning Office feels that alley-accessed parking, screened by buildings, may be the most preferred way to provide space in the core. The HPC may argue that additional surface parking to provide for more automobiles downtown may not enhance the traditional character of the district or help to strengthens the city's auto-dissincentive goals. The "redevelopment" plan, included in the application, does not indicate any vegetative screening or materials. The Planning Office recommends that the HPC grant minor development approval subject to a detailed design submittal of the parking area, prior to the issuance of any building permit. Existing landscaping shall be identified, as well as proposed vegetation and all surface treatments. Finally, removing this structure entirely does not preclude the new construction of a secondary "cottage" style building in the future. Staff feels it is appropriate for the HPC to require, or strongly encourage, the applicant to restore the exterior siding and front porch within a defined time frame, in exchange for the demolition of the outbuilding. RECOMMENDATION: The Planning Office recommends that the HPC: 1) recommend Landmark Designation for the parcel at 316 E. Hyman Ave. 2) grant demolition approval for the non-historic outbuilding located at the alley at 316 E. Hyman, finding the structure to be exempt from meeting the Demolition Standards in Section 7-602. 3) grant minor development approval subiect to a detailed design submittal of the parking area prior to the issuance of any building permit. Existing landscaping shall be identified, as well as proposed vegetation and all surface treatments. 4) strongly encourage the restoration of the cottage wood horizontal clapboard siding and front porch. Minimum Submission Contents for all Development Applications. A. The Applicant's name is Margaret Johnson, Trustee of the Duane Robert Johnson and Margaret Whitfield Johnson Revocable Trust, and her address is c/o Brooke A. Attached as Exhibit 1 is a letter stating the name, address and telephone number of the representative authorized to act on behalf of the applicant. B. The street address and legal description of the parcel on which the development is proposed to occur is 316 East Hopkins, Aspen, Colorado also known as Lot O, Block 80, City and Townsite of Aspen. C. Attached hereto as Exhibit 2 is a title insurance commitment disclosing the ownership of the parcel on which the development is proposed to occur and listing names of all owners of the property, and all mortgages, judgments, liens, easements, contracts and agreements affecting the parcel. D. Attached as Exhibit 3 is a survey map locating the subject parcel within the City of Aspen. E. Attached as Exhibit 4 is the Historic Architectural Building/Structural Inventory Form for the residence located at 316 East Hopkins. F. Attached as Exhibit 5 is the Andrews and Anderson report on 1991 Inventory of Historic Sites and Structures. II. Specific Submission Contents and Review Standards. A. This is an application for exemption from demolition standards, for the proposed demolition of a non-historic outbuilding consisting of approximately 300 square feet and a covered and enclosed porch of approximately 113 square feet, located on the north (alley side) portion of Lot 0, Block 30, City and Townsite of Aspen. The Applicant proposes to demolish the existing outbuilding pursuant to the exemption from the demolition standards set forth in Ordinance No. 9, Series of 1991, as codified in Land Use Code § 7-602(E). B. The Applicant proposes to provide voluntarily a parking area on the north end of the subject parcel for three off- street parking spaces. The parking spaces are illustrated on the enclosed drawings, Exhibit 6. F 41 1- f'.1, ... c. The Applicant is applying for an exemption from the demolition standards pursuant to Land Use Code §7-602(E). The following information shows that the application meets the conditions for the exemption of §7-602(E): 1. The Applicant is simultaneously applying for Historic Landmark Designation of the miner's cottage located on the south end (Hopkins Street) side of the lot. The landmark designation has significant benefits to the City of Aspen for many reasons, including: ( 1) the prominence of the cottage on the north side of East Hopkins Street in the 300 block; and (ii) the cottage is located next to the similarly small scale miner's cottage housing La Cocina Restaurant. With the proposed redevelopment of the south side of East Hopkins Street in the 300 block, wherein the Lily Reid cottage is being relocated to the corner, the preservation of the 316 East Hopkins cottage will be important for the Aspen downtown commercial core area as well as the 300 block of East Hopkins. 2. The existing historic cottage requires substantial maintenance and repairs. In order to facilitate the preservation of the existing cottage, the Applicant proposes to demolition the 300 square foot non-historic shed located on the alley in order to provide alley parking. The continued viability of the historic cottage will be greatly enhanced by landmark designation and the enhanced financial ability of the new owners to maintain the most important asset located on the lot -- the historic cottage. 3. The present owner of the property is elderly and retired in Arizona. She recently suffered the loss of her husband and is anxious to sell her long-time Aspen property. Initially, the Bank of Aspen proposed to purchase the property for $350,000.00. The owners of the hair salon located in the historic cottage, Peter Rizzuto and Tuvia Stein, exercised their right of first refusal to acquire the property. The contract to purchase requires HPC approval for the demolition of the non-historic shed before the transaction can close. 4. The Applicant has conducted a study of the value of the property with and without the demolition of the non-historic shed. A ... report to be prepared by Scot Barringer of Barringer, Ryan and Vance Investment Counselors will illustrate the detrimental economic effect of not permitting any demolition of the shed. Although the economics of the transaction are not necessarily the concern of the HPC, this information illustrates the fact that the proposed owners of the property will be able to take care of deferred maintenance and maintain the historic cottage as an historic landmark. 5. The Inventory Form for the property describes the shed as: "single gable shed with shed addition; rolled asphalt and vertical board, new retail, modifications with fixed glass. "As to the date of that addition, the inventory states: "date unknown. " As stated in the Inventory Form, the historic significance of the property is not of those who owned it or lived in it, nor of its architecture, but rather the home-environment and life style of the average citizen in Aspen which was then dominated by the silver mining industry. Removal of the non-historic shed will not adversely affect the essential historic character of the property since the main cottage will remain and will become a local historic landmark. 6. The structure is not identified on the 1986 Inventory of Historic Sites and Structures. In addition, the structure is not proposed for addition to the 1991 Inventory. See Exhibit 5. The Report on the 1991 Inventory of Historic Sites and Structures prepared by Andrews and Anderson dated July 8, 1991 does not identify the non-historic outbuilding as a proposed addition to the 1986 Inventory. Accordingly, the City's expert consultants agree that the shed is non- historic and non-contributing. 7. The structure is non-contributing to the Historic District as shown by the 1986 and 1991 Inventory of Historic Sites and Structures. The out-building has no architectural significance because it is constructed of non-historic materials including "barn wood" vertical siding and has non-historic roof shapes and facades. Although the scale and small size of the shed may be compatible with the residential historic neighborhoods in Aspen, it is out of place in the downtown commercial core of Aspen. The structure does not have all utilities and is semi-habitable, although it has in the recent past been leased to the Log Furniture Company and is considered net leasable square footage. 8. The structure does not contribute to the overall character of the Historic District because it is located on the alley and is not visible from the primary facade. The demolition of the non-historic shed will not impact the character of the Historic District because the existing historic cottage will remain on the subject parcel and will be eligible for landmark designation. Although there are other structures located on the alley, the alley is predominated by the existing Bank of Aspen building which is non- historic and the non-historic addition to the Elli's building. 9. The alley structure is also located in the eC Commercial Core Zone District of the City of Aspen. The CC Zone District has the highest intensity of zoning uses, and a small scale shed, although attractive to some, conflicts with the underlying policy of the CC Zone District to allow intensive development. The CC Zone District has no minimum side yard set backs and development is typically lot line to lot line. Likewise, there is no minimum front yard or minimum rear yard setback, (with the exception of trash/utility service areas) so it is consistent with the underlying policy of the CC Zone District to permit the shed to be demolished. 10. The shed currently encroaches on the adjoining property occupied by La Cocina Restaurant as shown on the improvement survey plat enclosed as Exhibit 3. In all likelihood, the shed would be required to be demolished in the future since one of the primary bearing walls would be need to be demolished to remove it from encroaching on the adjoining property. 11. The demolition of the non-historic outbuilding is necessary for redevelopment of the parcel because the building is located directly on the alley where the Applicant wants to locate three off-street parking spaces. Although not directly an HPC historic concern, the City of Aspen desperately needs off-street parking in the commercial core, and the application deserves serious consideration even though the redevelopment is for parking spaces. The Applicant is voluntarily providing the parking spaces, and nothing in this Application should be construed as a binding commitment upon the Applicant or any subsequent owner to maintain the parking spaces shown on the drawing. 12. The redevelopment is being reviewed by the HPC pursuant to this Application. In addition, all future development of the property will be reviewed by the HPC since the property is located within the Historic Overlay District for downtown Aspen. 13. Photographs of the non-historic out building are enclosed with this application and illustrate the state of disrepair of the structure and the non-historic features of the structure. 14. The shed is presently not in compliance with the Uniform Building Code. An estimate of approximately $50 per square foot has been prepared by the Applicant's architect of a cost to bring the shed into compliance with the Uniform Building Code. The costs clearly illustrate the economic impossibility of saving the shed. The HPC should focus its concern instead upon preserving the historic cottage due to its prominent placement on the 300 block of East Hopkins Street. Landmark designation will insure that the cottage is never demolished. III. Review Standards for Minor Development For Voluntary Addition of Parking Spaces. A. The Applicant is voluntarily providing at least three off-street parking spaces which will be a substantial benefit in the downtown CC Commercial Zone District due to the present traffic and parking congestion. The proposed parking area is compatible in character with the historic cottage since it will simply be a flat parking area without any competing structure or improvements. The „. parking is compatible with development on adjacent parcels for the same reasons. B. The proposed voluntary parking area and spaces are consistent with the character of the neighborhood, which includes occasional off-street parking throughout the Commercial Core. C. The proposed parking does not detract from the cultural value of the historic cottage because it will not compete in architectural style, size, facade or placement with the historic cottage. The cultural value of the historic cottage will be enhanced if the application is approved since the owner will have additional funds with which to take care of deferred maintenance and repair of the historic cottage. D. The proposed parking does not diminish or detract from the architectural integrity of the historic structure since parking is associated with numerous historic structures in Aspen. Further, the parking will be located off-street and to the rear of the primary facade. Hopkins. I wanted to provide you with some additional information that I discovered before you complete your review of the development application. I am enclosing a copy of a 1972 survey by Jim Reser. It shows the shed and the encroachment onto the adjacent La Cocina property. In 1972, the shed had a square footprint. As you can see by comparing this survey with the current survey prepared by Ken Wilson, there have been substantial additions to the shed since 1972. It appears that both of the porches have been added and that the shed itself has been enlarged to the west. METHODOLOGY In January of 1991, the architectural studio of Andrews & Anderson was retained by the City of Aspen to update specific information for the 1991 Aspen Inventory of Historic Sites and Structures. lo sum, the 1991 Inventory was to survey all properties which were previously listed on the 1980 Inventory of Historic Sites and Structures and the 1986 Inventory Update, and was to identify and inventory any new sites noticed during the course of the field survey. 11 was Aspen's responsibility to combine 1991 survey data, collected by A & A with previously-recorded inventory information on a ne,&, more comprehensive inventory form created by the Aspen Historic Presen'ation Omce. The specific portions of the new form for which Andrews & Anderson had responsibility are highlighted on a blank form on pages 5-6. In general, the pur'view of Andrews & Anderson included field survey and photography for approximately 300 sites in 10 geographicany-distmct areas of the City and its environs. The 10 areas included: the Community Church district, the Commercial Core Historic District, East Aspen Townsite, Hallam Lake, the Main Street Historic District, Shadow Mountain, Smuggler Mountain, Ute Avenue, the area west of Castle Creck and the West End. For each site, Andrews & Anderson provided the following: 1. photography and pboto-cataloguing 2. architectural and/or site description 3. USGS toI,ographic map location 4. Seld survey information on the extent of site and/or architectural modifications 5. a recommendation' for a 1991 local Kignificance rating , The process listed below describes the order of work undertaken during the course of the project: 1. initial recoonnaisance and photography of the sites is performed by Andrews & Anderson Z architectural and/or site descriptions are checked for accuracy and consistency back at the Golden, Colorado studio of Andrews & Anderson; photographs and negatives are labeled according to Colorado Historical Society standards; reviewed forms and attached photographs are returned to Roxanne Efiin, Historic Preservation Officer for Aspen/Pitkin : 3. in Aspen: forms are entered onto the computer file; data from previous inventories (Le. 1980 and 1986) is entered onto the same flle 4. forms are returned to Andrews & Anderson for a second check; AkA reviews the portion of the forms for which they are directly responsible before returning the forms to Aspen for fnal typing of this phase of the project Andrews & Anderson recognizes that through the above-stated process, a major portion of the 1991 Aspen Inventory of i Historic Sites and Structures was accomplished. It is important to note that there is still research and coordination to be undertaken, outside of A & A's purview, before the Inventory is complete. SUMMARY OF DATA AND OBSERVAMONS The 1991 Aspen Inventory of Historic Sites and Structures yielded survey forms representing a total of 267 properties which remain on, or were recommended to be added to, the inventory. This is a net decrease of 4 from the 1986 inventory count of 273 forms*. The following is a breakdown of the 307 sites surveyed by Andrews & Anderson: 234 revisions and upgrades of the 1986 Inventory Update forms _32 recommended for addition to the Inventory 266 SUBTOTAL 13 recommended Inventory'drops"* (see page 8); (Andrews & Anderson recommendations) 28 verified demolitions (sce page 7) 309 PROJECTTOTAL: SITES INVENTORIED IN 1991 The majority building type on the inventory is single-family residential. In key residential districts, Le. the Community Church district Hallam Lake, Smuggler Mountain; the West End and Ealt Aspen Townsite, this is virtually the only building type. In the Main Street Historic District, the majority of buildings, though largely originally single- family residential, are now commercial conversions. In the Commercial Core Historic District, the majority of buildings were and remain commercial storefront. Properties from the outlying districts, Le. Ute Avenue and the area west of Castle Creek include buildings and site features from Aspen's mining era (Le., farm buildings as well as cemeteries, brewery ruins, power plants, railroad bridges, and mine sites). The Shadow Mountain area includes early ski-era lodges and Boat-Tow #1, in addition to its mostly residential buildings . Some general observations can be made, based on the limited time expended in updating this inventory: 1. The overall Historic Resource for the City of Aspen can be considered to be at risk due to economic pressures which are unique to the City's current ski-resort persona. 1 The general pressure is towards both commercial and residential expansion. The I pressures manifest themselves in alterations to an invidual building's style/materials/ detailing, to its scale, to its context, and finally as a threat to its very existence. These pressures also manifest themselves as a parallel force affecting and altering the style, 1 scale and contenural characteristics of any given district. 2. An immediate focus of the Aspen Planning Department's Historic Preservation Officer over the past three years has been to close gaps in guidelines and to address clear and cohesive preservation goals. The development of a loophole-free system of legal and economic incentives is vital for the management of the above referenced erosion of historical conten and of individual resources. 3. The degree of threat and speed of erosion differs from survey district to survey district. Those districts which remain relatively stable (although by no means unaffected) include the Commercial Core, Main Street, and the outlying areas (if only because these areas are not yet in the path of development pressures). The most at risk areas include the East Aspen Townsite (eight demolitions and seven recommendations to drop due to loss of historic integrity since 1986), and the West End (twelve demolitions and four recommendations to drop). The remaining districts can be considered to fal] somewhere in the middle range of this continuum. ' Please note that two 1986 Inventory sites were not resurveyed (The Aspen Institute and Riding Ring Rodeo Grounds) "Properties recommended to be dropped were evaluated qualitatively based on the following criteria: (1) Integrity of material, de:ailing- style features; (2) Integrity of massing and scale; (3) Integrity of conten and contribution to conten. 2 -- -- ----- '--- .-Il- - --I. ---.4 ....4. m . I .. . - 3- .... RECOMMENDAnONS The recommendations resulting from the completion of this inventory fall into the follov*ing categories: 1. COMPLETION OF THE 1991 INVENTORY ; 2. ONGOING INVENTORY MANAGEMENT 3. HISTORIC RESOURCE PLAN AND INTERFACE WITH OVERALL PLANNING DEPARTMENT GOALS 1. Completion of the 1991 Inventory should include: i a. Completion of the 1991 Inventory forms (possibly by a summer intern) as soon as possible. Attached is a sample inventory form highlighting the areas for which A&A was specifically responsible. The remaining areas require review, coordination and completion. b. Assembly of missing National Register Nomination Forms as well as identification of new properties which may be eligible (see A & A'& 1991 rating recommendations on 'Master List, pages 9-15) and a strategy for completing nominations for those properties. c Update of the City of Aspen Historic Inventor) Map, preferably with a graphics revision to improve legibilit> and usability. Ideally, this mapping would be easily overlayed with the Cily Planning and Zoning mapping system. i i A 1991 or 1992 summer project to inventory and map the City irrigation ditch system so that it can be incorporated into the inventory and into the Historic Resource Plan. e. A summer 1991 documentation of Aspen Grove Cemetery, Ute Cemetery, and the Durant Mine, all of which were inaccessible at the time of this inventory due to snow. 2. An ongoing inventory management program is recommended so that properties and districts can be better tracked over time, and more informed decisions can be made regarding the fate of an individual property, or the course of the overall Historic Resource Plan. a. Assignment of permanent control numbers to each inventoried property would allow tracking of any given property through its "life'. Some of the data to be tracked could include: the site's significance rating, contiguous historic resources, dates of changes in status, date of entry onto the inventory, number of sites on the inventory, etc Note: A system other than or in addition to the property address system is suggested. b. Every 5 years the inventory and inventory map should be completely updated. c The inventory tracking system should be tied to the Building Permit system so that resource updates occur on a continual basis and so that "red flags" are raised when a resource is threatened. 3. A Historic Resource Plan is recommended which would dovetail with overall City of Aspen Planning and Zoning Goals. The Plan would be incorporated into and reviewed at the time of any master planning. This Plan could address, but not be limited to the following: a. A Goal Statement which is consistent with overall Planning Goals, but specific to Aspen's Historic Resource b. A Statement of Objectives which derive from that Goal Statement and which are time- specific c Provisions for ongoing coordination with Planning and Zoning d A statement for and description of a historic property ranking (Le. landmark significant, contributing; and supporting) which would include the implications of that rinking on any legal and economic controls and/or incentives c. Attached as Exhibit 5 is the Andrews and Anderson report on 1991 Inventory of Historic Sites and Structures. II. Specific Submission Contents and Review Standards. A. This is an application for exemption from demolition standards, for the proposed demolition of a non-historic outbuilding consisting of approximately 300 square feet and a covered and enclosed porch of approximately 113 square feet, located on the north (alley side) portion of Lot 0, Block 30, City and Townsite of Aspen. The Applicant proposes to demolish the existing outbuilding pursuant to the exemption from the demolition standards set forth in Ordinance No. 9, Series of 1991, as codified in Land Use Code § 7-602(E). B. The Applicant proposes to provide voluntarily a parking area on the north end of the subject parcel for three off- street parking spaces. The parking spaces are illustrated on the enclosed drawings, Exhibit 6. C. The Applicant is applying for an exemption from the demolition standards pursuant to Land Use Code §7-602(E). The following information shows that the application meets the conditions for the exemption of §7-602(E): 1. The Applicant is simultaneously applying for Historic Landmark Designation of the miner's cottage located on the south end (Hopkins Street) side of the lot. The landmark designation has significant benefits to the City of Aspen for many reasons, including: ( 1) the prominence of the cottage on the north side of East Hopkins Street in the 300 block; and (ii) the cottage is located next to the similarly small scale miner's cottage housing La Cocina Restaurant. With the proposed redevelopment of the south side of East Hopkins Street in the 300 block, wherein the Lily Reid cottage is being relocated to the corner, the preservation of the 316 East Hopkins cottage will be important for the Aspen downtown commercial core area as well as the 300 block of East Hopkins. 2. The existing historic cottage requires substantial maintenance and repairs. In order to facilitate the preservation of the existing cottage, the Applicant proposes to demolition the 300 square foot non-historic shed located on the alley in order to provide alley parking. The continued viability of the historic cottage will be greatly enhanced by landmark designation and the enhanced financial ability of the new owners to maintain the most important asset located on the lot -- the historic cottage. 3. The present owner of the property is elderly and retired in Arizona. She recently suffered the loss of her husband and is anxious to sell her long-time Aspen property. Initially, the Bank of Aspen proposed to purchase the property for $350,000.00. The owners of the hair salon located in the historic cottage, Peter Rizzuto and Tuvia Stein, exercised their right of first refusal to acquire the property. The contract to purchase requires HPC approval for the demolition of the non-historic shed before the transaction can close. 4. The Applicant has conducted a study of the value of the property with and without the demolition of the non-historic shed. A .. report to be prepared by Scot Barringer of Barringer, Ryan and Vance Investment Counselors will illustrate the detrimental economic effect of not permitting any demolition of the shed. Although the economics of the transaction are not necessarily the concern of the HPC, this information illustrates the fact that the proposed owners of the property will be able to take care of deferred maintenance and maintain the historic cottage as an historic landmark. 5. The Inventory Form for the property describes the shed as: "single gable shed with shed addition; rolled asphalt and vertical board, new retail, modifications with fixed glass. "As to the date of that addition, the inventory states: "date unknown. " As stated in the Inventory Form, the historic significance of the property is not of those who owned it or lived in it, nor of its architecture, but rather the home-environment and life style of the average citizen in Aspen which was then dominated by the silver mining industry. Removal of the non-historic shed will not adversely affect the essential historic character of the property since the main cottage will remain and will become a local historic landmark. 6. The structure is not identified on the 1986 Inventory of Historic Sites and Structures. In addition, the structure is not proposed for addition to the 1991 Inventory. See Exhibit 5. The Report on the 1991 Inventory of Historic Sites and Structures prepared by Andrews and Anderson dated July 8, 1991 does not identify the non-historic outbuilding as a proposed addition to the 1986 Inventory. Accordingly, the City's expert consultants agree that the shed is non- historic and non-contributing. 7. The structure is non-contributing to the Historic District as shown by the 1986 and 1991 Inventory of Historic Sites and Structures. The out-building has no architectural significance because it is constructed of non-historic materials including "barn wood" vertical siding and has non-historic roof shapes and facades. Although the scale and small size of the shed may be compatible with the residential historic neighborhoods in Aspen, it is out of place in the downtown commercial core of Aspen. The structure does not have all utilities and is semi-habitable, although it has in the recent past been leased to the Log Furniture Company and is considered net leasable square footage. 8. The structure does not contribute to the overall character of the Historic District because it is located on the alley and is not visible from the primary facade. The demolition of the non-historic shed will not impact the character of the Historic District because the existing historic cottage will remain on the subject parcel and will be eligible for landmark designation. Although there are other structures located on the alley, the alley is predominated by the existing Bank of Aspen building which is non- historic and the non-historic addition to the Elli's building. 9. The alley structure is also located in the CC Commercial Core Zone District of the City of Aspen. The CC Zone District has the highest intensity of zoning uses, and a small scale shed, although attractive to some, conflicts with the underlying policy of the CC Zone District to allow intensive development. The eC Zone District has no minimum side yard set backs and development is typically lot line to lot line. Likewise, there is no minimum front yard or minimum rear yard setback, (with the exception of trash/utility service areas) so it is consistent with the underlying policy of the CC Zone District to permit the shed to be demolished. 10. The shed currently encroaches on the adjoining property occupied by La Cocina Restaurant as shown on the improvement survey plat enclosed as Exhibit 3. In all likelihood, the shed would be required to be demolished in the future since one of the primary bearing walls would be need to be demolished to remove it from encroaching on the adjoining property. 11. The demolition of the non-historic outbuilding is necessary for redevelopment of the parcel because the building is located directly on the alley where the Applicant wants to locate three off-street parking spaces. Although not directly an HPC historic concern, the City of Aspen desperately needs off-street parking in the commercial core, and the application deserves serious consideration even though the redevelopment is for parking spaces. The Applicant is voluntarily providing the parking spaces, and nothing in this Application should be construed as a binding commitment upon the Applicant or any subsequent owner to maintain the parking spaces shown on the drawing. 12. The redevelopment is being reviewed by the HPC pursuant to this Application. In addition, all future development of the property will be reviewed by the HPC since the property is located within the Historic Overlay District for downtown Aspen. 13. Photographs of the non-historic out building are enclosed with this application and illustrate the state of disrepair of the structure and the non-historic features of the structure. 14. The shed is presently not in compliance with the Uniform Building Code. An estimate of approximately $50 per square foot has been prepared by the Applicant's architect of a cost to bring the shed into compliance with the Uniform Building Code. The costs clearly illustrate the economic impossibility of saving the shed. The HPC should focus its concern instead upon preserving the historic cottage due to its prominent placement on the 300 block of East Hopkins Street. Landmark designation will insure that the cottage is never demolished. III. Review Standards for Minor Development For Voluntary Addition of Parking Spaces. A. The Applicant is voluntarily providing at least three off-street parking spaces which will be a substantial benefit in the downtown CC Commercial Zone District due to the present traffic and parking congestion. The proposed parking area is compatible in character with the historic cottage since it will simply be a flat parking area without any competing structure or improvements. The parking is compatible with development on adjacent parcels for the same reasons. B. The proposed voluntary parking area and spaces are consistent with the character of the neighborhood, which includes occasional off-street parking throughout the Commercial Core. C. The proposed parking does not detract from the cultural value of the historic cottage because it will not compete in architectural style, size, facade or placement with the historic cottage. The cultural value of the historic cottage will be enhanced if the application is approved since the owner will have additional funds with which to take care of deferred maintenance and repair of the historic cottage. D. The proposed parking does not diminish or detract from the architectural integrity of the historic structure since parking is associated with numerous historic structures in Aspen. Further, the parking will be located off-street and to the rear of the primary facade. METHODOLOGY In January of 1991, the architectural studio of Andrews & Anderson was retained by the City of Aspen to update specific information for the 1991 Aspen Inventory of Historic Sites and Structures. In sum, the 1991 Inventory was to survey all properties which were previously listed on the 1980 Inventory of Historic Sites and Structures and the 1986 : Inventory Update, and was to identify and inventory any new sites noticed during the course of the field survey. It was ? Aspen's responsibility to combine 1991 survey data, collected by A & A with previously-recorded inventory information on a new, more comprehensive inventory form created by the Aspen Historic Preservation Office. The specific portions of the new form for which Andrews & Anderson had responsibility are highlighted on a blank form on pages 5-6. In general, the purview of Andrews & Anderson included field survey and photography for approximately 300 sites in 10 geographically-distinct areas of the City and its environs. The 10 areas included: the Community Church district, the Commercial Core Historic District, East Aspen Townsite, Hallam Lake, the Main Street Historic District, Shadow Mountain, Smuggler Mountain, Ute Avenue, the area west of Castle Creek, and the West End. For each site, Andrews & Anderson provided the following: 1. photography and photo-cataloguing 2. architectural and/or site description 3. USGS topographic map location 4. field survey information on the extent of site and/or architectural modifications 5. a recommendation* for a 1991 local significance rating The process listed below describes the order of work undertaken during the course of the project: 1. initial recoonnaisance and photography of the sites is performed by Andrews & Anderson 2. architectural and/or site descriptions are checked for accuracy and consistency back at the Golden, Colorado studio of Andrews & Anderson; photographs and negatives are labeled according to Colorado Historical Society standards; reviewed forms and attached photographs are returned to Roxanne Ellin, Historic Preservation Officer for Aspen/Pitkin 3. in Aspen: forms are entered onto the computer file; data from previous inventories (i.e. 1980 and 1986) is entered onto the same file 4. forms are returned to Andrews & Anderson for a second check; A&A reviews the portion of the forms for which they are directly responsible before returning the forms to Aspen for final typing of this phase of the project Andrews & Anderson recognizes that through the above-stated process, a major portion of the 1991 Aspen Inventory of Historic Sites and Structures was accomplished. It is important to note that there is still research and coordination to be undertaken, outside of A & A's purview, before the Inventory is complete. SUMMARY OF DATA AND OBSERVATIONS The 1991 Aspen Inventory of Historic Sites and Structures yielded survey forms representing a total of 267 properties which remain on, or were recommended to be added to, the inventory. This is a net decrease of 4 from the 1986 inventory count of 273 forms*. The following is a breakdown of the 307 sites surveyed by Andrews & Anderson: 234 revisions and upgrades of the 1986 Inventory Update forms _32 recommended for addition to the Inventory 266 SUBTOTAL E i 15 recommended Inventory 'drops"** (see page 8); (Andrews & Anderson recommendations) 28 verified demolitions (see page 7) 309 PROJECT TOTAL: SITES INVENTORIED IN 1991 The majority building type on the inventory is single-family residential. In key residential districts, i. e. the Community Church district, Hallam Lake, Smuggler Mountain, the West End and East Aspen Townsite, this is virtually the only building type. In the Main Street Historic District, the majority of buildings, though largely originally single-family residential, are now commercial conversions. In the Commercial Core Historic District, the majority of buildings were and remain commercial storefront. Properties from the outlying districts, i.e. Ute Avenue and the area west of Castle Creek, include buildings and site features from Aspen's mining era (i.e., farm buildings as well as cemeteries, brewery ruins, power plants, railroad bridges, and mine sites). The Shadow Mountain area includes early ski-era lodges and Boat-Tow #1, in addition to its mostly residential buildings. Some general observations can be made, based on the limited time expended in updating this inventory: 1. The overall Historic Resource for the City of Aspen can be considered to be at risk due to economic pressures which are unique to the City's current ski-resort persona. The general pressure is towards both commercial and residential expansion. The 2 pressures manifest themselves in alterations to an invidual building's style/materials/ detailing, to its scale, to its context, and finally as a threat to its very existence. These pressures also manifest themselves as a parallel force affecting and altering the style, scale and contextural characteristics of any given district. 2. An immediate focus of the Aspen Planning Department's Historic Preservation Officer over the past three years has been to close gaps in guidelines and to address clear and cohesive preservation goals. The development of a loophole-free system of legal and economic 1 incentives is vital for the management of the above referenced erosion of historical context and of individual resources. 3. The degree of threat and speed of erosion differs from survey district to survey district. Those districts which remain relatively stable (although by no means unaffected) include the Commercial Core, Main Street, and the outlying areas (if only because these areas are not yet in the path of development pressures). The most at risk areas include the East Aspen Townsite (eight demolitions and seven recommendations to drop due to loss of historic integrity since 1986), and the West End (twelve demolitions and four recommendations to drop). The remaining districts can be considered to fall somewhere in the middle range of this continuum. * Please note that two 1986 Inventory sites were not resurveyed (The Aspen Institute and Riding Ring Rodeo Grounds) **Properties recommended to be dropped were evaluated qualitatively based on the following criteria: (1) Integrity of material detailing, style features; (2) Integrity of massing and scale; (3) Integrity of context and contribution to context. 2 j RECOMMENDATIONS The recommendations resulting from the completion of this inventory fall into the following categories: 1. COMPLETION OF THE 1991 INVENTORY 2. ONGOING INVENTORY MANAGEMENT 3. HISTORIC RESOURCE PLAN AND INTERFACE WITH OVERALL PLANNING DEPARTMENT f GOALS 1. Completion of the 1991 Inventory should include: i a. Completion of the 1991 Inventory forms (possibly by a summer intern) as soon as possible. Attached is a sample inventory form highlighting the areas for which AkA was specifically responsible. The remaining areas require review, coordination and completion. b. Assembly of missing National Register Nomination Forms as well as identification of new properties which may be eligible (see A & A's 1991 rating recommendations on "Master List", pages 9-15) and a strategy for completing nominations for those properties. c. Update of the City of Aspen Historic Inventor> Map, preferably with a graphics revision to improve legibilit) and usability. Ideally, this mapping would be easily overlayed with the City Planning and Zoning mapping system. 1 d. A 1991 or 1992 summer project to inventory and map the City irrigation ditch system so that it can be incorporated into the inventory and into the Historic Resource Plan. e. A summer 1991 documentation of Aspen Grove Cemetery, Ute Cemetery, and the Durant Mine, all of which were inaccessible at the time of this inventory due to snow. 2. An ongoing inventory management program is recommended so that properties and districts can be better tracked over time, and more informed decisions can be made regarding the fate of an individual property, or the course of the overall Historic Resource Plan. a. Assignment of permanent control numbers to each inventoried property would allow tracking of any given property through its "life". Some of the data to be tracked could include: the site's significance rating, contiguous historic resources, dates of changes in status, date of entry onto the inventory, number of sites on the inventory, etc. Note: A system other than or in addition to the property address system is suggested. b. Every 5 years the inventory and inventory map should be completely updated. c. The inventory tracking system should be tied to the Building Permit system so that resource updates occur on a continual basis and so that "red flags" are raised when a resource is threatened. 3. A Historic Resource Plan is recommended which would dovetail with overall City of Aspen Planning and Zoning Goals. The Plan would be incorporated into and reviewed at the time of any master planning. This Plan could address, but not be limited to the following. a. A Goal Statement which is consistent with overall Planning Goals, but specific to Aspen's Historic Resource b. A Statement of Objectives which derive from that Goal Statement and which are time- specific c Provisions for ongoing coordination with Planning and Zoning d. A statement for and description of a historic property ranking (Le. landmark, significant, contributing, and supporting) which would include the implications of that ranking on any legal and economic controls and/or incentives e. Provisions for the development of a comprehensive package of controk incentives, public relations and public education, which will be supportive of the best preservation and utilization of Aspen's Historic Resource and consistent with the community' s vision of its future. 3 .,0 .1. -'. As the owner of the adjacent property to the west, I am pleased to see that you are going to demolish the alley shack that encroaches on my property. The demolition of the shack will resolve the encroachment problem to my satisfaction. I have reviewed the potential problem of the encroachment with my attorney and we believe that there will be a problem keeping the shed if the HPC does not approve the demolition. Although I have worked with you in the past regarding the encroachment, if the HPC does not approve the demolition I will need to ask you to remove the encroachment. I certainly do not want my property encumbered with a shack that the HPC will not allow to be demolished, since I will need all of my property free from any HPC approved shack. I believe that you will find that removal of the encroaching wall of the shack will probably result in demolition anyway since the shack does not appear to be structurally sound. Although I do not know when the shack was built, there have been additions and changes since 1972 when Jim Reser surveyed it. I am sending a copy of this letter to the HPC to let them know that I am in support of the demolition for several reasons. First and foremost, it will resolve the encroachment problem. Second, I do not believe the shack is historic in any respect. It does not have the historic shape or roof of the traditional carriage houses in Aspen, the windows are all relatively new, and there have been additions to the shack in the past years that are clearly not historic (such as the plywood sheets that were put on the west wall that encroaches on my property). -0 0 Margaret Johnson November 21, 1991 Page Two In summary, I will be forced to ask you to remove the shack from my property if the HPC does not permit it to be demolished.
