SUMMARY:
This administrative determination identifies the second tier commercial space that is located within
the subject building located at East Hopkins Avenue (Parcel IDs 273707375001-005, and
273707375800). Second tier space is defined and described in Sections 26.104.100, Definitions,
and 26.412.080, Second Tier Commercial Space.
DETERMINATION:
The structure located at 304 East Hopkins Avenue is a three-story building (two stories above
grade with basement). See attached plans (Exhibit A).
Basement: This floor contains a commercial space that has been utilized as a restaurant but is
currently vacant. Access is through a below grade courtyard on the west side of the building.
SECOND TIER.
First Floor: This floor is currently occupied by a restaurant. Access is from the street level on East
Hopkins. NOT SECOND TIER.
Second Floor: This floor is currently occupied by a bar and is accessed through a set of stairs off
of East Hopkins, additionally there is a second staircase off the back alley providing circulation.
SECOND TIER.
DISCLAIMER:
This determination does not exempt existing or proposed development from other requirements
that may be applicable to this property, including but not limited to, requirements of previous
development approvals or other provisions within the Land Use Code. This determination is based
on representations provided by the applicant. Any changes to the existing building (including
interior remodels) will render this determination null and void and will require a new second tier
determination.

We submit this letter on behalf of 304 East Hopkins Holdings LLC, the owner of 304 East Hopkins Avenue
in its entirety, to request identification of second tier commercial space pursuant to Land Use Code
Section 26.104.100 Definitions and Land Use Code Section 26.412.080 Second Tier Commercial Space
adopted via City Council Ordinance No. 33, Series of 2016 and City Council Ordinance No. 30, Series of
2016. The subject property is located at 304 East Hopkins Avenue, Parcel IDs #2737-073-75-001 to -005,
and 2737-073-75-800.
The existing building is mixed use. There are three levels of commercial space within the two story
building, and two deed restricted residential studio units located on the upper floor. The recorded
condominium plat assigned Units 1, 2 and 5 to commercial use; and Units 3 and 4 are assigned to the deed
restricted studio units. Exhibit 1 illustrates the existing conditions and classification described below. The
commercial units are designated as follows:
Unit 1: Basement level (previously Square Grouper restaurant). Steps accessed from the sidewalk,
through at -grade courtyard, to the lower level. SECOND TIER.
Unit 2: Street level (currently Aspen Over Easy restaurant). At grade access from the sidewalk into the
main level. PRIME COMMERCIAL.
Unit 5: Upper level (currently Aspen Brewery bar/restaurant). Steps accessed from sidewalk, through at
grade courtyard, to the upper level. SECOND TIER.

The City of Aspen Land Use Code recently changed to require "second tier" commercial space in
development. Ordinances 30 and 33, Series 2016, address second tier space requirements. The
applicant is requesting an administrative determination regarding how the existing net leasable
space would be calculated under these new requirements. Administrative Determinations are a
land use application that must be submitted for consideration by the Community Development
Director. Existing floor plans, pictures, and the like, should be submitted to assist the Director in
making this determination.

DESCRIPTION:
The City of Aspen Land Use Code recently changed to require "second tier" commercial space in
development. Ordinances 30 and 33, Series 2016, address second tier space requirements. The
applicant is requesting an administrative determination regarding how the existing net leasable
space would be calculated under these new requirements. Administrative Determinations are a
land use application that must be submitted for consideration by the Community Development
Director. Existing floor plans, pictures, and the like, should be submitted to assist the Director in
making this determination.
Below are links to the Land Use Application form and the Ordinance referenced above. A full land
use application is not required, though an agreement to pay form and HOA compliance policy is.

Planning Fees: $325 — for one hour of Staff Review time.
Referral Fees: None
Total Deposit: $325 (additional/lesser planning hours are billed/refunded at a rate of
$325/hour; any needed referral hours are billed at a rate of $325/hour)
To apply, submit one copy of the following information:
❑ Attachments 1 and 2 of the Land Use Application (Agreement to pay and Land Use
Application form)
❑ Pre -application Conference Summary (this document).
❑ Applicant's name, address and telephone number in a letter signed by the applicant that states
the name, address and telephone number of the representative authorized to act on behalf of
the applicant.
❑ HOA Compliance form (Attached)
❑ Floor Plans of the existing net leasable area.
❑ Pictures or other visuals of the building and/or spaces
❑ Summary of existing spaces and uses.
Once the application is deemed complete by staff, the following items will then need to be
submitted:
❑ Total deposit for review of the application.
❑ A digital copy of the application provided in pdf file format.
