On March 27, 1997, Amy Amidon, the City's Historic Preservation Officer, told me that the ISIS Theater, next door to the Fox Building, was being renovated and that an additional level was being added. After reviewing the ISIS plans, Nextel's project RF engineer expressed his concern to me that the increased ISIS height would block a portion of Nextel's planned coverage and requested that an alternative facility location be found. Nextel, subsequently, installed its facility to serve the Aspen area at 620 East Hyman Avenue. Amy and Julie Ann Woods reviewed that proposal for your department. I understand from our discussion that the subject property is zoned CC, Commercial Core and that it is within the Historic Overlay District. As I mentioned to you, I represented U S WEST NewVector Group, Inc., now doing business as AirTouch Cellular, in the Summer, 1991, when I worked with Bill Drueding, the City's Zoning Officer then, and with Roxanne Eflin, the Historic Preservation Officer, to approve an antenna installation similar to the proposed Nextel installation for the Mill Street Plaza building. At that time, we reached agreement that the "use" was "Permitted" as a use similar to a "radio or television broadcasting facility" (Land Use Regulations Section 26.28.140.11). I would hope that Nextel's "use" can be similarly approved. Although the height limit (i.e., 40 feet in the CC zone) can, apparently, be exceeded by "antennas" in the zone district, I understand that the Historic Overlay requirements will control the height and appearance of Nextel's three antennas. Each of the antennas, as noted on the Plan , are approximately 3-inches in diameter. They can be painted most any color. Nexte] at the referenced site, like U F WEST at Mill Street Plaza, desires to effectively-provide its wireless telecommunications services to Aspen's residents and visitors .. while, certainly, limiting its facility's visual impact on the community. Following our discussion about the length of the proposed "whip't (i.e., "3-inch dia. omni") antennas, shown as extending to a height of "14-feet, 6-inches" above the roof deck on the drawings I left with Sara Thomas on February 3, 1 talked with Nextel's construction manager and he agreed to use shorter antennas. As I stated in my subsequent voice mail message to you, Nextel agrees that the "14-foot, 6-inches~ dimension shown on the drawings will be reduced to "8-feet, 6-inches" as noted on the included, marked drawing. The steel frame to which the antennas will be attached will extend to about 2 feet above the roof and the "radiating elements" of the antennas will extend the balance of the total height, about 6-feet, 6-inches, above the frame. The remainder of the Nextel proposal, as shown on the drawings, would remain unchanged. In addition to reducing the height of the antennas, Nextel agrees that "no unpainted or reflective surfaces will be allowed" on the antennas or "steel angle frame" to which the antennas are attached. Further, Nextel agrees that the antennas, which are manufactured to be "sky-colored, light blue," will be painted "flat black" when initially installed and will, if requested by the City within 6 months of their installation, be repainted to a different color selected by the City to reduce their visual presence. The finally-selected color shall be maintained for the life of the installation. Feb-13-97 06:51P P.03 e . Nextel would like the City to know that the longer antennas originally proposed for the referenced facility were selected because they would provide a higher "gain," or transmit power, than the shorter ones Nextel has now agreed to install. Specifically, the shorter antennas will provide less "signal strength" along the Highway 82 corridor west of Aspen and in the County Airport/Aspen Airport Business Center with a resultant compromise in Nextel ' s services there. As the "signal strength" at a distance from a facility varies with many factors, including the presence or lack of ground snow cover and changes in vegetation (i.e.: leaves pine needle density, etc.) with the seasons, Nextel cannot currently-determine if the shorter antennas would or would not result in Nextel needing another site to serve that area. On the other hand, installing the longer antennas at the referenced site would not guarantee sufficient "signal strength" would be present, under all conditions, in the above-described area and, accordingly, Nextel does not know that another site would then never be required to serve that area. As you will remember from your experiences with "low power telecommunications facilities" in other jurisdictions, coverage prediction is far from an exact science! From our discussion, I understand that Nextel's revised proposal will be considered by the Director and staff in a staff meeting on Monday, February 17, 1997. If you would be so kind as to FAX me the Application Form that would relate to our request for "administrative approval" of Nextel's proposal, I will complete it and send it to you along with a check in the amount of $ 245.00 for the Application Fee and a copy of the Lease between Birkwood Associates, the owner of the referenced buildingu and Nextel Communications as evidence of the owner's approval of the Nextel facility. I look forward to hearing if the Director agrees to exempt Nextel's proposed installation from HPC review or if it will be necessary to have the HPC consider the proposal relative to its Development Review Standards. In accordance with the General Submission Requirements, I am enclosing the following: 1. The "applicant" is OneComm Corporation, a Delaware Corporation, doing business as "Nextel Communications," and I am a representative of Nextel Communications for land use matters. My address is included in the letterhead and my phone number is (303) 721-2148. Nextel Communications has entered into a Lease with the "property owner," M &W Associates, that allows Nextel, subject to securing necessary approvals, to install the described facility. A copy of the Lease is included as Exhibit 1 for the City's review. Note that M&W Associates, "agrees to cooperate with Lessee...in making application for and obtaining all licenses, permits..," pursuant to Paragraph 2 of the Lease. 2. The street address and legal description of the parcel are listed under "Project Location" on the Land Use Application Form, included as Exhibit 2. .. 3. The "property owner" is listed as item number 4 on the included Title Commitment, Exhibit 3, as "M & W Associates, a Colorado General Partnership," and its interest in the property is "fee simple," which gives the owners rights including the right to apply for this development review through Nextel Communications as a Lessee. 4. The building location id noted as "Site" on vicinity maps, included as Exhibit 4. In addition to the above information, I am enclosing another set of the photosimulations showing the building "before antennas" and after "omni antennas. " The proposal is for "roof mount" rather than "side mounts" in the photosimulation. I have also included another set of the marked (for shorter antennas) plans. Panel antennas are, typically, attached to a triangular frame which is place on the roof, such as is shown in Exhibit 1, or to two or three individual, freestanding frames, such as Exhibits 2 and 3, or to pipe columns which are attached to a parapet wall or to a penthouse, if any, such as Exhibit 4. As discussed in my voice mail response to you last night, the antennas must be above surrounding buildings and vegetation to function. As such, at the referenced Nextel facility building location, we must propose that the antennas, whips or panels, be mounted to a frame. Panel antennas, as you know, can be mounted to a building's exterior walls or to a penthouse, as depicted on Exhibits 5 and 6, when the resultant elevation provides the "antennas above surrounding buildings and vegetation" location described above. Again, the referenced Nextel facility building, Exhibit 7, does not offer that opportunity. If Nextel were to use panel antennas instead of whip antennas, as currently proposed, nine (9) DB 874 would be required. Those 4, antennas, described in Exhibit 8, are 12-inches wide by 48-inches high by 5-inches deep and they would need to be mounted on a frame similar to the one depicted in Exhibit 1 (without the whip antennas) with the center of the antenna at least 6-feet, 6-inches above the roof level. The top of the nine antennas, accordingly, would be about 8-feet, 6-inches above the roof. I believe the visual presence of the three whip antennas on the referenced building would be significantly less that the presence of the nine panel antennas. .. From your voice mail messages, I am not certain that you received my Application for an HPC Review Exemption, with Exhibits and a check, which I overnighted to you, Exhibit 9, on February 24. I had presumed you had that submittal, since I was called by Serina in your office on February 28 and asked to send another check for a different amount, which I did on March 2. Hopkins Ave. CC: Sara Thomas, Vicki Monge Larry Storms, with Nextel Communications is applying for an exemption from the Historic Preservation Commission Review in order to place three antennas on the Fox Photo Building at 400 E. Hopkins Ave. The building is a one-story building located within the commercial core and Historic Overly District; the building is not a historic structure. The applicant proposes to install three (3) three-inch diameter whip antennas that will be 8'-6" in height (see attached alley elevation). The antennas will be attached to a 2' high steel frame which will be located on the roof at the northeast corner of the building (see attached roof plan). Under section 26.28.140(D)(7), the maximum height of this zone district is 40'. The total height of the building and the antennas is 32'-10", well within the maximum height allowed by code. In addition, the applicant intends to locate a 6' x 10' prefab equipment cabinet immediately behind the building, adjacent to, but not located in, the alley. A transformer and dumpster are currently located in this same area (see attached roof plan). Under Section 26.72.010 (C) (2), "the community development director shall exempt awnings, canopies, fences, mechanical equipment or similar attachments to. . .provided, however, . . .none ofthe significant features of the structure are destroyed or permanently removed". Because this is not a historic structure, there are no significant features that could be removed. In 1991 a similar request to install whip antennas at the Mill Street Plaza Building on Hopkins was administratively approved by the HPO at the time (see attached letter). Staff recommends that the Community Development Director approve this exemption, subject to the following conditions: .. 1. That the whips be painted black matte, and should this color be determined to be inappropriate after six months, the applicant agrees to change the color at their expense. 2. That the antennas and equipment cabinet be located as shown in the roof plan dated 1/23/97 and the elevation, modified by Larry Storms on 2/13/97. All of Lessee's construction and installation work shall be performed at Lessee's sole cost and expense and in a good and worknianlike manner. Title to the Lessee Facilities shall be held by 1..essee. All of Lessee Facilities shall remain Lessee's personal properly and are not fixtures. Les.see has t.he right to remove all Lessee Facilities at its sole expense on or before the expiration or earlier termination of the Agreement; provided, Lessee repairs any damage to the Premises caused by such removal, and return the Premises to its original cotifiguration. ( b) Lessee shall pay for the electricity it consumes in ils operations at the rate charged by the servicing ulility company. Lessee shall obtain separate utility service from any utility company that will provide service to the Property (including a standby power generator for Lessee's exclusive use). Lesser agrees to sign such documents or easements as may be required by said ulilily companies to provide such service to the Premises, including the grant lo Lessee or to the servicing utility company at no cost to the Lessee, of ati easement in, over across or through the Land as required by such servicing utility company lo provide utility services as provided herein. Any easement necessary for such power or other utilities will be at a location acceptable to Lessor and the servicing utility company. Lessor grants to Lessee, and ils agents, employees, contractors, guests and invilees, a non-exclusive right and easement for pedestrian and vehicular ingress and egress across that portion of the Land described in Exhibit B. 7. Inlerference. (a) Lessee shall operate the Lessee Facilit.les in a manner that will not: cause interference to Lessor and other lessees or licensees of the Property, provided that their installations predate thai of the Lessee Facilities. All operations by Lessee shall be in compliance with all Federal Communications Commission ("FCC") requirements. ( b) Subsequent to the installation of the Lessee Facilities, Lessor shall not permit itself, its lessees or licensees to install new equipment on the Property or property conliguous thereto owned or controlled by Lessor, if such equipment is likely to cause interference willl Lessee's operations. Such interference shall be deemed a material breach by Lessor. In the event interference occurs, Lessor agrees lo lake all action necessary lo elinlinale such interference, in a reasonable time period. in the event I,essor fails lo comply wilh this paragraph, Lessee may terminate this Agreement and/or pursue any other remedies available under this Agreement, at law, and/or at equity. 8. Taxes. If personal properly taxes are assessed, Lessee shall pay any portion of such taxes directly attributable to the Lessee Facilities. Lessee agrees that it will not use, generate, store or dispose of any Iiazardous Malerial on, under, about or within tile Land in violation of any law or regulation. Lessor represents, warrants and agrees (1) that neither Lessor nor, to Lessor's knowledge, any third party has used, generated, stored or disposed of, or permitted tile use, generation, storage or disposal of, ally Hazardous Material on, under, about or within the Land in violation of any law or regulation, and (2) that Lessor will not, and will not permit any third party to use, generate, store or dispose of any Iiazardous Material on, under, about or within the Land in violation of any law or regulation. Lessor and [.essee eacli agree lo defend, indemnify and hold harmless the other and the other's partners, affiliates, agents and employees against any and all losses, liabilities, claims and/or costs (including reasonable attorneys' fees and costs) arising from any breach of any representation, warranly or agreement contained in this paragraph. As used in this paragraph, "Iiazardous Material" shall mean petroleum or ally petroleum product, asbestos, any substance known by the state in which the Land is located to cause cancer and/or reproductive toxicity, and/or any substance, chemical or waste that is identified as hazardous, toxic or dangerous In any applicable federal, state or local law or regulation. This paragraph shall survive the termination of this Agreement. 18. Liability and Indemnity. Box 91211 Bellevue, WA 98009-2211 RE: CO3ASPEN/Aspen Cell Site; Mill Street Plaza Dear Mike: I have included the revised CAD drawing that we delivered to Roxanne Eflin, with the Aspen Planning Department, on June 20 for her "administrative approval" relative to the Historic Overlay District ("HOD") and the referenced site. I have not yet heard if she has set the "minimum distance" from the northwest corner of the parapet (40-feet?) or if she has approved the installation as proposed/depicted. I have also included the sketches for the Lily Reid Project next door to our facility to the west for your use. As discussed with you, as to zoning approval distinct from the HOD matter, I talked (again) with Bill Drueding, Aspen's zoning officer, on June 17 and he confirmed that the Mill Street Plaza is in the CC zone district and that as a "radio or television broadcasting facility", NewVector's proposed use is "permitted". The height limit (10-feet above the specified maximum height limit...40-feet...for the district) is addressed under the "height" definition in the Land Use Regulations. Storms Consultants 1384 Snowberry Dr. Golden, CO 80401 Re: New Vector cellular antenna installation in CC district Dear Larry: This is to confirm staff approval of the installation of three (3) eight foot whip antennas within the Commercial Core Historic District in Aspen. A full HPC review is not required under current code regulations. Thee antennas are to be attached to the inside west parapet wall of the Mill Street Plaza building on Hopkins Street, and are to be located as-far to the rear of the building as possible (within 2' of the rear property line at the alley). The antennas are to a maximum height of eight (8) feet each, placed a distance of no more than eight (8) feet apart, painted matte black, and shall not be attached with guy wires or additional supports, which you state will not be necessary anyway.
