Councilwoman Markalunas moved to table this item until the City has a more acceptable plan on circulation taking into consideration the City's shuttle system. Seconded by Councilman DeGregorio. Council committee on buses stated they would have the cost figures within the week on insurance etc. LIQUOR CONSIDERATIONS Paragon Parlour, purchase and sale - Flle was submitted to Council. City -Attorney Stuller stated the Form lSE as required for remodeling of the pre- mises. was submitted just prior to the meeting. Councilwoman peclersen questioned that when the premises change in dimension to any large degree, would this constitute a new license? City ATtorney reported yes. Attorney Gruetter representing the applicants, stated the address remains as it was in the past and this is the determining factor. Mr. Gruetter stated they will be adding 500 sq. ft. of more seating area, adding additional restrooms. Councilman Behrendt pointed out the original license took in the entire area, Mr. Frank Ben. ng transferred only the bar area and a portion of the kitchen, now the applicant is asking for the entire area again. Mr. Gruetter stated there would not be two bars. It was pointed out the street address should be 423 East Hyman. Councilman DeGregorio moved to Seconded by Councilman Walls. woman Pedersen who voted nay. approve the transfer of liquor license. All in favor with the exception of Council- Motion carried. Assist- ant planmer Donna Baer pointed out the location of South Monar1~9 subdivision includes 6 units, 4 of which were complete prior to subdivision require- ments applying to condominiums. This application has been reviewed under Ordinance #19 for units 5 and 6 and was approved. Condition has been imposed of dedication of a trail easement which would compliment the one from Mountain Queen. Mayor Standley stated he was opposed based on the area and the lack of need for high priced units ($130,000). Applicant Wendell stated he would be willing to stipulate there would not be any further building beyond the 6 units. Councilman Behrendt moved to approve the subdivision agreement End plat with the stipulation that this constitutes full development of the pro- perty and no additional units can be added. RECORD OF PROCEEDINGS 100 Leaves Aspen Planning & Zoning October 16, 1973 to the Planning Office. Gillis made a motion to amend the original motion to read that the Commission would review the project under Ordinance #19, seconded by Johnson. All in favor, motion carried. Ms. Baer stated that this proposal was an addition of a garage and a studio, and would not increase the density. Gillis made a motion to approve the proposal, seconded by Johnson. All in favor, motion carried. Architect Larry Yaw was present and explained that this was a proposal to add a second floor above the Tom Mix Flying School for retail purposes. Stated that Tom Mix has agreed to buy two parking spaces and construct roof drainage according tb'specifications of the City Engineer- ing Department. Would be an additional 900 plus square feet. Yaw further pointed out that this addition would not in- terfere with the view. Ms. BAer submitted a diagram of the proposed addition, and stated that the Historic Preservation Committee had re- viewed the proposal and had approved it, Johnson made a motion to approve the addition, seconded by Gillis. All in ,favor, motion carried. Ms. Baer stated that the Historic Preservation Committee had approved the structure, but would like to review the color and the building material. Ms. Baer briefly explained the diagram of the Commission and explained that the City Council must grant approval to the covered walk. Gillis made a motion to approve the proposal on the con- dition that the drainage be satisfactory for the covered roof, seconded by Jenkins. Motion included that the requirement for parking space purchase be determined. All in favor, motion carried. Ms. Baer explained that this was a review of two units second phase of a new six unit condominium. Johnson made a motion to recommend for approval on con- dition that the applicant dedicate a ski easement along the southerly boundary of the property, seconded by Jen- kins. All in favor, motion carried. Ms. Baer pointed out that this was a project on ute Avenue at the Aspen Alps Road, a request for new 14 unit con- dominium. Further pointed out that the zoning in this area was mixed residential. The P & Z did in fact approve units 5 & 6 subject only to construction according to the plans filed with Clayton; and 2. The P & Z did in fact waive the performance bond and escrow requirements. Regarding the first, the language in both the agreement and resolu- tion are a guaranty of final plat approval for the 5 & 6 units. This makes me nervous if the P & Z did not in fact make such a decision. Please advise. October 2, 1973 Jenkins made a motion to approve the project on the following conditions: (1) owners pave the alley; (2) negot:iat:e an acceptable parking plan subject to City Engineer's approval; (3) supply drainage plan to be approved by the City Engineer; (4) supply a landscaping plan that also meets with the approval of the city Engineer; (5) write into sales contract a covenant restricting rental to not less than six months. Hotion seconded by Lewis. All in favor, motion carried. Mr. Murphrey, developer for the project, was present. Chairman Adams stated that he ,'lould like to see the review under Ordinance #19 go to the newly formed 1'.dvisory Board. Ms. Baer pointed out that the Planning Office had critical concern with the drainage. POinted out that the ditch presently feeds the Glory Hole Park. Ms. Baer further point.ed out that the Planning Office was requesting a setback of 20 feet. Murphrey stated that they already were set back 18 feet, and there would be no problem with a setback of 2 additional feet. Attorney Bruce Kistler was present, representing Mr. Murphrey. Felt the rerouting could be approved by the City Engineer. Discussion followed on the preservation of trees on the project. Murphrey stated that construction would cause minimal removal of trees, and stated that trees would be added to the site. Murphrey stated that on their final plan, would sub-- mit a detailed landscape plan. Johnson made a motion to approve the preliminary plat for the ute Avenue Condominiums with the following conditions: (1) dedicate 10' of south side of the property for future street widening; (2) agree to affiliate with future street and drainage improvement districts; (3) require an agreeable ditch maintenance and lease arrangement be made with City Engineer; (4) City Engineer approve the drainage plan. Motion was seconded by Geri Vagneur. All in favor, motion carried. Ms. Baer pointed out that this project was located on South MOnarch street, just below the Mountain Queen Development. Wendell furt:her point.ed out willingness to give 4% cash dedication to the City. Vidal pointed out his concern for the literal inter- pretation of the building permit. Stated that he fel t this vias an administrative problem, and that possibly the permit was valid. Ms. Baer stated that they proposed to add 2 units of 2,000 square feet per unit. Further pointed out that Aspen Metro Sanitation had already hooked up for 6 units. Geri Vagneur made a motion to approve the preliminary and final plat for the Caribou Condominiums on the following conditions: (1) owners agree to future transit, street, and drainage districts; (2) land- scape and drainage plans meet with the approval of the City Engineer; (3) offer a 4% cash dedication to the City. Motion was seconded by Johnson. All in favor, motion carried. Chairman Adams pointed out that the project would still have to go through Ordinance #19 Review by the Advisory Board. Ms. Baer distributed a letter from Ken Hubbard, at- torney representing Bergman. 'I'he letter contained information concerning uses and parking for the building. Bergman pointed out that the Commission had given approval of everything but the parking at a previous meeting. Discussion followed concerning the cost of buying out the needed parking spaces. Co~~ission concensus was that $4,000/space was reasonable. Jenkins made a motion to approve the building on the condition that they covenant the uses and that the City Council could negotiate the parking cost. Seconded by Johnson. Four of the units have been constructed in the past year and are now open for inspection. I wish to complete this structure and build the remaining two units, as per original plan. I encourage all who read this letter to come up to the Caribou at 701 Monarch, at the base of lift One,and see how the Caribou is a compliment and an asset to Aspen. On May 22, 1972 in Case (no. 72-11) the Board of Adjustment approved a building permit for a six unit multi-family dwelling, which would exceed the 20 foot height limit by 5.8 feet. In connection with this application Mr. Varouj Hairabedian achieved a density reduction from eight units to six units. After approval of the variance, I applied for a building permit for the first four units, which was issued well prior to the adoption of Ordinance 19, or the application of the subdivision regulations to condominiums. Similarly, I applied for a building permit #40-73 prior to the effective date of either, which permit has not yet been issued. The Caribou complies fully with the Aspen Land Use Plan, and falls into the category of recreation-accomodations transi~ tion. It blends in with the natural setting of the ski resort, allowing people to ski to their door. The natural materials, native stone and shingles, blend in with the mountain. We have spent thousands of dollars working around the nine trees on the property, thus building six units instead of eight, allowing ade- ~ .-., City of Aspen 9/19/73 page two quate open space, and keeping in mind the preservation of the environment. The units are priced between $130,000 and $140,.000, thus strenghthening the community's economic base in taxes per square foot of the complex. We have also taken measures to control the runoff. All of our roof drains and the swimming pool deck are connected to an adequate drywell under the drive- way with good perculation. We now have a fire hydrant abOVe our project approximately 20 feet away from the building. We have adequate water pressure. We tapped into the main water and sewer line approximately one year ago and paid the tap fees for all six units. Consideration has been given for adequate off-street parking and snow removal. The snow, after it builds up in the parking area, will be hauled away, At one time T owned the old Paul Wirth Cabin in which I held quiet title to the land underneath. The cabin, which has since been moved, was there for over 47 years. I conveyed the land through the Mountain Queen Corporation to the city for a skier's easement, allowing skiers to ski to Monarch Street. Also, when Monarch Street. connects to Mill Street, the transit problem will be solved. I feel that the Caribou Condominium is a prime example to other builders and developers in the Aspen area.
