Cooper, Units 101 and 201, Park Place Condominiums, City and Townsite of Aspen. The property is located in the Commercial Core Historic District; and WHEREAS, all development in an "H," Historic Overlay District or development involving a historic landmark must meet all four Development Review Standards of Section 26.72.010(D) of the Aspen Land Use Code in order for HPC to grant approval, namely: 1. Cooper - Minor Review, Public Hearing DATE: October 10, 2001 SUMMARY: This non-historic structure is located within the Commercial Core Historic District. The applicant requests HPC approval to convert an existing window to a recessed, street-facing door with a more traditional awning and sign. The existing door would be converted to a window and all the tinted glass will be replaced with clear glass. APPLICANT: Jeff Gorsuch, store owner; represented by Alan Richman Planning Services and Tom Frye, Architect. LOCATION: 419 E. Cooper, Unit 101 and 201 Park Place Condominiums, City and Townsite of Aspen. ZONING: The property is zoned "CC, Commercial Core," with a historic district overlay. MINOR DEVELOPMENT No approval for any development in the "H," Historic Overlay District, or involving historic landmarks shall be granted unless the Historic Preservation Commission finds that all ofthe following standards (Section 26.415.010.B.4) are met: a. The proposed development is compatible in general design, scale, site plan, massing and volume with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in an "H," Historic Overlay District, or is adjacent to an historic landmark. For historic landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot, exceed the allowed floor area by up to five hundred (500) square feet, or exceed the allowed site coverage by up to five (5) percent, the Historic Preservation Commission may grant necessary variances after 1 .. making a finding that such variation is more compatible in character with the historic landmark and the neighborhood than would be development in accord with dimensional requirements. In no event shall variations pursuant to this Section exceed those variations allowed under Section 26.520.040(B)(2),for detached accessory dwelling units. Response: The existing building will remain essentially unchanged. The current doorway space will be replaced with a window of the same dimension. The existing window and awning will be replaced with double doors of the same dimension and a new awning. The proposed changes exemplify the traditional Victorian style of the Historic district with a recessed, street-facing entry way, kickplates below the windows, clear glass to replace the current tinted glass, a rectangular awning and a basic metal hanging sign above the entry way. Note that the owner submitted an alternate design for the door and awning which they prefer. The proposal is more compatible with the character of the district and Cooper Street than the current faGade, and therefore is recommended for approval. b. The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. Response: The proposed changes are consistent with the character of the neighborhood, and replacing the current fa~ade with the proposed one is an improvement. c. The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or adjacent parcels. Response: The proposal will not affect the significance of any designated structure. d. The proposed development enhances or does not diminish or detract from the architectural character and integrity of a designated historic structure or part thereof. Response: The proposal will not impact the architectural integrity of any designated structure. ALTERNATIVES: The HPC may consider any of the following alternatives: • Approve the application as submitted. • Approve the application with conditions to be met prior to issuance of a building permit. 2 .. • Table action to allow the applicant further time for restudy. A flat fee or deposit is collected for land use applications based on the type of application submitted. Referral fees for other City departments reviewing the application will also be collected when necessary. One check including the deposit for Planning and referral agency fees must be submitted with each land use application, made payable to the Aspen/Pitkin Community Development Department. Applications will not be accepted for processing without the required application fee. A flat fee is collected by Community Development for Administrative Approvals which normally take a minimal and predictable amount of staff time to process. The fee is not refundable. A deposit is collected by Community Development when more extensive staff review is required, as hours are likely to vary substantially from one application to another. Actual staff time spent will be charged against the deposit. Several different staff members may charge their time spent on the case in addition to the case planner. Staff time is logged to the case and staff can provide a summary report of hours spent at the applicant's request. After the deposit has been expended, the applicant will be billed monthly based on actual staff hours. Applicants may accrue and be billed additional expenses for a planner' s time spent on the case following any hearing or approvals, up until the applicant applies for a building permit. Current billings must be paid within 30 days or processing of the application will be suspended. If an applicant has previously failed to pay application fees as required, no new or additional applications will be accepted for processing until the outstanding fees are paid. In no case will Building Permits be issued until all costs associated with case processing have been paid. When the case planner determines that the case is completed (whether approved or not approved), the case is considered closed and any remaining balance from the deposit will be refunded to the applicant. Applications which require a deposit must include an Agreement for Payment of Development Application Fees. The Agreement establishes the applicant as being responsible for payment of all costs associated with processing the application. The Agreement must be signed by the party responsible for payment and submitted with the application and fee in order for a land use case to be opened. The current complete fee schedule for land use applications is listed on the reverse side. The legal description of the property is Units 101 and 201 of the Park Place Condominiums. The entire property on which the condominiums are located consists of approximately 8,454 square feet of land. The property is zoned Commercial Core (CC). It is located within the Commercial Core Historic Overlay District. The application is being submitted by the prospective tenant for the property, Gorsuch Ltd. (hereinafter, "the applicant"). The property is owned by The Continental Divide Company (see the warranty deeds, attached as Exhibit #1.) A letter from The Continental Divide Company authorizing the applicant to submit this application is attached as Exhibit #2. The applicant is being represented by Alan Richman Planning Services and Tom Frye, Architect, for purposes of this application. A letter from the applicant confirming this arrangement is attached as Exhibit #3. The modifications proposed by the applicant are illustrated on the attached site plans and building elevations. They show that the following changes are planned: + Remove the existing storefront window and replace it with a new recessed entryway that is oriented directly towards Cooper Avenue. + Remove the existing door and replace it with a storefront window. + Install a new awning and sign for the business. I discussed these proposals with you, and you informed me that this application would be subject to minor development review by HPC. .. The standards to be used by the Historic Preservation Committee when considering an application for minor development in the "H", Historic Preservation Overlay District, and the applicant's response to these standards, are as follows: 1. The proposed development is compatible in general design, scale, site plan, massing and volume with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in a "If', Historic Preservation Overlay District, or is adjacent to a Historic Landmark. For Historic Landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot, exceed the allowed floor area by up to 500 sq. ft., or exceed the allowed site coverage by up to 5%, HPC may grant such variances after making a finding that such variation is more compatible in character with the historic landmark and the neighborhood than would be development in accord with dimensional requirements. Response: No changes are proposed to the scale, site plan, massing, or volume of the existing structure. The only change proposed is to the design of the front facade. To demonstrate that these changes will be compatible with the general design of development on adjacent parcels, the applicant has submitted a photo montage of surrounding structures located on the Cooper Avenue Mall. A comparison of these photos to the proposed design shows that the proposed design will be compatible with these structures. The design incorporates a recessed entry, oriented toward the street, a feature that is found in virtually all of the other structures on the mall. The windows that are proposed to be installed are similar to the store front windows on several other structures. Both the door and the area below the windows have raised panels, which are also found on many of the surrounding buildings. The design also includes an awning and sign, which will be compatible to the other awnings and signs found on the mall. 2. The proposed development reflects and is consistent with the character of the neighborhood proposed for development. Response: Chapter 13 of the recently adopted City of Aspen Historic Preservation Design Guidelines establishes the design guidelines for alterations to existing non-historic structures in the Commercial Core Historic District. The applicant has designed this proposal to be consistent with these guidelines. In preparing the design, the applicant has been directed by guideline 13.15, which states that: "A contemporary design that draws upon the fundamental similarities among historic buildings without copying them is preferred". The introduction to the chapter states that recessed entries are a typical design element in this District. The guidelines encourage the primary entrance to a commercial building to be a recessed entry way, set back approximately 4' from the facade (see guideline 13.19). The guidelines also suggest that the recessed entryway be oriented towards the street (see guideline 13.3). 2 .. The existing structure does not provide a recessed entryway that is oriented towards the street. Instead, its entryway is flush with the building facade and angled towards the side. The applicant proposes to change the entryway so it will be recessed by nearly 4', and so it will be oriented toward the street. New oak doors, with beveled glass and raised panels, will be installed. The doors will be similar to, but will not copy, the doors in neighboring historic structures, such as the Red Onion building. The guidelines also encourage large storefront windows, located at the street level (see guideline 13.16). The applicant proposes to install new windows where the door is now located. These windows are proposed to be as large as possible, considering that the dimensions of the existing opening will not be altered. No expansion of the size of this opening is proposed. The guidelines state that darkly tinted glass is an inappropriate material to use for street front windows (see guideline 13.17). The existing window and door use a tinted glass. This glass will be removed. The glass to be used in the new door and windows will not be tinted. The proposed awning will be made of fabric, with blue and white stripes. As recommended in the guidelines, the proposed awning will be compatible in size, shape, and type with those found on adjacent buildings located on the Cooper Avenue Mall. A sample of the proposed fabric will be brought to the HPC meeting. The proposed sign will be a small scale sign, mounted on the building (see guideline 14.25). It will be made of metal (see guideline 14.26). It has been positioned over the door, to emphasize the building entry (see guideline 14.27). It is expected to include the pictographic ski symbol used in the company logo (see guideline 14.28). 3. The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or adjacent parcels. Response: The proposal will not detract from the historic significance of designated historic structures located on adjacent parcels. In fact, the proposed modifications to this non-historic structure will allow the structure to better comply with the City's adopted historic preservation guidelines by repeating the historic building facade elements (recessed entryway, storefront windows, and raised panels) of surrounding structures in the Commercial Core. As a result, the structure will be more in context with the desired character of the Historic District and will enhance the historic significance of the area. 4. The proposed development enhances or does not diminish or detract from the architectural character and integrity of a designated historic structure or part thereof. Response: The subject property does not contain a designated historic structure, so this standard is not applicable to this project. 3 .. Conclusion The applicant has responded to all applicable criteria of the City of Aspen Land Use Code, pursuant to the direction you have provided. Sufficient evidence has been provided of the project's compliance with said criteria. The applicant will respond in a timely manner to requests by any reviewing agency for additional information, or clarification of the statements made herein.
