COLUMBINE CONDOMINIUMS
SUBDIVISION IMPROVEMENTS AGREEMENT
THIS AGREEMENT, entered into and made this ~day of
~ ' 1976, by and between RICHARD J. MEEKER and
ALFRED C. NICHOLSON d/b/a RIVERVIEW ASSOCIATES C"Sub-
dividers"), and THE CITY OF ASPEN, COLORADO, a Municipal
Corporation ("City").
WITNESSETH:
WHEREAS, Subdividers are owners and subdividers of a tract
of land within Pitkin County, Colorado, consisting of Lots A and B,
Block 31, East Aspen Addition, County of Pitkin, State of Colorado.
WHEREAS, Subdividers have submitted to City for approval,
execution, and recording a subdivision plat of the above-described
property, such subdiviSion to be known and designated as "Columbine
Condominiums"; and
WHEREAS, the City has fully considered such subdivision plat,
the proposed development and the improvement of the subject property
shown thereon, and is willing to approve, execute, and accept said
plat for recordation upon the agreement of Subdividers to the matters
hereinafter described, which: matters are deemed necessary to
protect, promote, and enhance the public welfare; and
WHEREAS, Subdividers and the City wish to reduce said
agreement to writing,
NOW, THEREFORE, in consideration of the premises, the
mutual covenants herein contained, the parties hereto hereby agree as

that they will affirmatively consent to and join in the formation of any
special improvement district, encompassing all or any part of
Columbine Condominiums SubdiviSion, that may hereafter be proposed
or formed for the construction of streets, alley, and drainage improve-
ments or buried electrical improvements. Subdividers hereby waive
and further covenant and agree to waive any right of protest against
the formation of any such district.
2. Owner and subdivider, for itself, itscs.u.ccessors, in interest,
grantees"and assigns, covenants and agrees that in the event the City
undertakes street improvements (including paving, curb and gutter,
and sidewalks) without the formation of a special assessment district
when such street improvements include improvements in the right of
way abutting Lots A and B, Block 31, East Aspen Addition, it will pay
the actual cost of any such improvements abutting the boundary of said
Lots A and B such payment to be made to the City wi thin ninety (90) days
after completion of the improvements and on receipt of written notice
and demand for such payment.
3. The improvements shown on the Final Subdivision Plat
including curb, gutter, sidewalks, and landscaping shall be completed
as a condition for the issuance of the Certificate of Occupancy.
4. Subdividers agree to pay to the City prior to filing for record
of the subdivision plat, the sum of Six Thousand, Four Hundred
Eighty-eight Dollars and 63/100 Cert s ($6,488.63) as full payment for
all obligations for payment of cash in lieu of land dedication as required
by the provisions of Section 20-18 of the Aspen Municipal Code.
5. Upon execution of this Agreement by all parties hereto,
City agrees to approve and execute the final plat of the Colur:nbfneCcndo.,-;

miniums Subdivision and accept the same for recording in the real
property records of Pitkin County, Colorado, upon payment of record-
ing fees and costs to City by Subdividers.

6., The covenants and agreements of the Subdividers herein
shall be deemed covenants that run with the land, shall burden the
land included within the Columbine Condominiums Subdivision, and
shall bind and be specifically enforceable against all subsequent
owners thereof, incladi ng Subdividers, their heirs, personal repre-
sentatives, successors in interest and assigns.
IN WITNESS WHEREOF, the parties hereto have executed
this agreement as of the day and year first above written.

We aSk that you get approval of the subject Final Plat from the Planning
Office ancj refer it to the Director of Parks and Recreation and the Planning
Commission for their signatures.
In addition, per our letter to you of March 3, we ask you to cooperate with
the Planning Office in scheduling this Final Plat for submission to the City
Council on Monday, March 22, 1976.

Verbatim ended.
Clark explained, that this is a public hearing for the
Gentry-Perrault, ~ztec Condomini~s. Jack Wallsrepre-
sented the project. Conceptual approval of .the project
has been given. This is a hearing on the prelininary
plat. One of the concerns of some of the planning and
Zoning members and the Council members was Whether
there could be a possiblityof a ,door gain and there
is no possiblity without building additional stairways
of getting additional doors. The Planning ,Office
recommends approval of the prelininary plat of the
, ~ztec Condominiums. This is an existing building.
Jenkins opened the public hearing. Jenkins closed the'
public hearing.

'Clark mentioned that the Planning Office recommendations
would include the conditions pf the City Engineer
which are: 1) zoning was incorrect on the plat, 2) five
foot easement would be necessary for the sidewalk
on Monarch street, 3) landscaping plan is needed and
4) cash dedication would be required '
Hunt moved preliminary plat of the ~ztec Condominiums
subject to the park dedication fee and the conditions
of the City Engineer; seconded by Otte. All in favor,
Collins abstained. Motion carried.
J.enkins 'opened the public hearing.
Clark explained that this is to request conceputal
subdivision approval for the Columbine Condominiums.
Conceptual approval was given by the planning and Zoning
on October 7, 1975 and Council gave Conceputal approval
on October 27, 1975. This project consist of 5 one
bedroom units and is located on the corner of Original
and Hop~~ns Streets. Planning Department is recommending
approval of the project, subJect to the conditions of
the City Engineer.

Hunt moved to approve the preliminary plat of ColUlllbine
Condominiums subject to the conditions of the City
Engineer and park dedication fee; seconded by Collins.
All in favor, motion carried.
Clark mentioned that they are reporting to the subdivi-
sion regulations. The final plat approval has expired
and is necessary for them to go back toP&Z for
preliminary and final plat re-approval. The Planning
Office recommends that ,it be approved. We are offering
an extension of the final plat deadline of another 90
'days.

final plats; seconded by Dobie. All in favor, motion
carried.

4) Existing storm drains and inlets adjacent to
the property be shown.
5) A plan with calculations be presented for handling
parking area and building rUnoff.
6) Survey ties and control must be shown.
7) Landscaping proposal is needed.

site be relocated by subdivider.
Since there is no land for a dedication itis presumed
that there will be a cash dedication equivalent to the'

Clark explained that this is an application for Columbine
Condominiums consisting of 5 one bedroom condominiums to
located on the corner of Hopkins and Original, across the
street from the Larkspur. Zoning is RMF, 5 units are
allowed, 1 unit per 1200 sq.ft. and is a total of 6,000
sq.ft. , on the property and our recommendation is for
appx:ovalof the application at this time.
Hunt moved to approve conceptual subdivision for Columbin
Condominiums; seconded by Patrick Dobie. All in favor,
motion 'carried. Clark asked applicant to bring floor'
plans for p&Z members to see.
Clark explained that this' application of the condominimiz
tion of the existing Scott Hedical Buildings consisting 0
8 ,condominium units, 70t which are apartments and 1 a
medical office. . The building \'lil1 be between third and
fourth ,streets. Clark said that it is a non-conforming
use and is an R-6 zone. Planning Office had one concern
and that is adequate parking be provided for the entire
building. There are 11 parking spaces available now.
Jenkins felt that since there is a medical office they
will need sufficient parking for the office plus the
bedrooms in the apartments. Jenkins also felt that if
the eXisting apartments in which locals are now living in
are condominimized and bought by non-local people that
it would be defeating the purpose.
Goodheim made a motion to deny subdivision for the Scott
Condominiums on, the basis that weare in the midst of
formulating a policy concerning the merits or condomin-
imization existing structure and admittedly the applicant
has no existing need to condominimize right now;
seconded by Abbott.
. Jenkins asked if there was any.discussion.. Clark felt
that there were two ractors which were unclear those
being he hadn't crossed checked with the plans in the
building department and feels that it would be approprial
to get a list of, tenants and unites that they own and
would be appropriate to be tabled until submitted.
Goodheill' made a motion to withd)~aw first motion; Abbott
seconded. Goodheim amended the motion to read the
conceptual sUbdivisio'n approval' of Scott. Condominiums

1. Park Central Office Building The Engineering Dept.
has no objections with this project. The tabulateg
data indicates 34 parking spaces required while the
sketch plan indicates 44 spaces; the latter is correct.

II. Columbine Condominiums The only comment on this
sketch plan is that they have shown the zoning west of
S"SPJ::ing St. as being NC,instead of C-:-l.
III. Scott Building This is an existing building which
originally wa's built as a medical office and four apart-
ments. The building permit plans include a sheet show-
ing a future conversion from medical office to apartments
on the first floor. However; since the apartments were not
built, I'm not sure whether the alternate scheme was checked
for density. Under the alternate scheme there would have
been 5 units with 15 bedrooms; the current proposal is for
8 units with 16 bedrooms. I feel the density matter should
be considered as a planning review. Should the 16 bedroom
proposal be acceptable, then the project would need an add-
itional 8 spaces assuming the garage remains.
