Mayor Ireland called the special meeting to order at 5:03 p.m. with Councilmembers
Devilbiss, Johnson, Skadron and Romero present.
RESOLUTION #91, SERIES OF 2007 Contract Cinema Vertige Historic Preservation
Ben Gagnon, community development department, told Council staff sent out RFPs for a
documentary on historic preservation. Five proposals were received, all out of the azea.
Gagnon told Council one application stood out and staff is recommending a $40,000
contract with Cinema Vertige LLC to make a documentary on historic preservation in
Aspen.
Councilman Skadron asked if the ultimate purpose is an informational piece like the
entrance to Aspen video. Chris Bendon, community development department, told
Council the idea for this came as a recognition there is a lack of understanding of the
historic preservation program, where it has been, what it means to the property owner and
to the community. Councilman Romero commended the continued effort to build
awareness. Councilman Romero said this should be coordinated with HPC for their
input. Mayor Ireland asked if it makes sense to finish the historic preservation code
amendments first. Gagnon said they plan on interviewing citizens and community
members involved with historic preservation since its inception in the 1970's.
Councilman Johnson agreed this can easily be sepazated from the current historic code
amendments.
Councilman Johnson moved to approve Resolution #91, Series of 2007, contract with
Cinema Vertige LLC and to spend $40,000 on a historic preservation documentary;
seconded by Councilman Romero. All in favor with the exception of Mayor Ireland;
motion carved.
ORDINANCE #47, SERIES OF 2007 - Extension of S/C/I Moratorium
Ben Gagnon, community development department, requested approval of a 6 month
extension on the moratorium in the S/C/I zone. Gagnon explained to Council when the
general moratorium was lifted in May 2007, Council felt the S/C/I zone had not received
enough attention, that it was a different zone and left the moratorium on S/C/I. Gagnon
said this ordinance cannot go through P&Z and Council review and be in effect by
November 30`h. Gagnon noted this languished as the new Council came into office and
there were other priorities.
Gagnon said staff has been making progress on the S/C/I zone. There was a work session
August 20th with Council, at which time Council requested an overview of the
Obermeyer project. Gagnon said there are 3 areas zoned S/C/I and each aze very
different; different in zone, topography, what exists on the parcel. Gagnon told Council
they need to give P&Z time to hold several hearings on any proposed code amendment.
Mayor Ireland said the commercial mix and S/C/I zone aze inter-related. Mayor Ireland
stated he has reservations about the city's ability to affect much in the CC zone for
locally serving businesses other than owning the property and leasing it to businesses.

Gagnon noted the most recent direction from Council was to continue outreach with
businesses in the community. Councihnan Romero stated he feels the moratorium is
unnecessary. Outreach with businesses, reviewing and updating the code is part of the
day to day activities of the community development department. Councilman Johnson
said that may be right but he is unwilling to take a chance and lift the S/C/I moratorium.
Councilman Johnson said he is willing to go for another 6 months. Councilman Johnson
said because the S/C/I zone is so different from the other zones, there is a lot of education
required. Councilman DeVilbiss agreed with continuing the moratorium.
Councilman Romero noted he had first hand experience with Obermeyer Place as an
example of what the S/C/I zone could produce. Councilman Romero aid he feels
Obenneyer Place achieved many of the goals of the AACP.
Councilman Johnson moved to adopt Ordinance #47, Series of 2007, on second reading,
extending the S/C/I moratorium six months; seconded by Councilman DeVilbiss.
Mayor Ireland stated he will reluctantly support this as the city of Aspen is under
pressure from rapid changes and market forces and staff is pressed to cope with a lot of
issues at one time. Mayor Ireland said the S/C/I zone is critical as one of the few tools to
keep locally serving businesses. Mayor Ireland said it is important that the city have a
good design of the zone district.
Mayor Ireland opened the public hearing.
Janet Garwood, resident of North Mill street, said the S/C/I zone needs more time and
consideration; it is very important to the community.
Mayor Ireland closed the public hearing.
Roll call vote; Councilmembers Romero, no; Skadron, yes; DeVilbiss, yes; Johnson, yes;
Mayor Ireland, yes. Motion carried.
Councilman Romero moved to adjourn at 5:50 p.m.; seconded by Councilman DeVilbiss.
All in favor, motion carried.

Mayor Ireland called the special meeting to order at 4:40 p.m. with Council members
Johnson, Skadron and Romero present.
Councilman Johnson moved to go into executive session at 4:40 p.m. pursuant to C.R.S.
24-6-402(4)(a)(b) and (e) (a) The purchase, acquisition, lease, transfer, or sale of any real,
personal, or other property interest; (b) Conferences with an attorney for the local public
body for the purposes of receiving legal advice on specific legal questions and (e)
Determining positions relative to matters that maybe subject to negotiations; developing
strategy for negotiations; and instructing negotiators; seconded by Councilman Skadron.
All in favor, motion carried.
Alsopresentwere Greg Hunter, Paul Menter, Bentley Henderson, Steve Barwick, Jim
True and Kathryn Koch. Councilman DeVilbiss was not in attendance.
Councilman Johnson moved to come out of executive session at 5:00 p.m.; seconded by
Councilman Romero. All in favor, motion carried.
Councilman Johnson moved to adjourn at 5:00 p.m.; seconded by Councilman Romero.
