Vos Caudill, Pitkin County, CO RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION (HPC) MAKING A RECOMMENDATION TO THE COMMUNITY DEVELOPMENT DIRECTOR REGARDING THE PRESERVATION OF HISTORIC INTERIOR ELEMENTS FOR THE PROPERTY LOCATED AT 420 EAST COOPER AVENUE, UNIT 2 OF THE RED ONION CONDOMINIUMS, BLOCK 89, CITY AND TOWNSITE OF ASPEN, COLORADO RESOLUTION NO. 30, SERIES OF 2007 PARCEL ID: 2737-182-16-062. WHEREAS, the property owners, Red Onion Investors LLC, represented by Garfield & Hecht, P.C. and Poss Architects, requests a recommendation from the Historic Preservation regarding the preservation of historic interior elements for the property located at 420 East Cooper Avenue, Unit 2 of the Red Onion Condominiums, Block 89, City and Townsite of Aspen, Colorado. WHEREAS, 420 East Cooper Avenue is located in the Commercial Core Historic District; and WHEREAS, on December 12, 2006, the Aspen City Council adopted Ordinance 51, Series of 2006, imposing a six month moratorium on the acceptance of building permit applications by the City of Aspen for interior work in the Commercial Core Historic District, with specified exemptions; and WHEREAS, on February 26, 2007, the Aspen City Council adopted Ordinance 2, Series of 2007, adding an exemption from the restrictions of Ordinance 51, Series of 2006 for historic landmark buildings as stated in Section 1, part n, of the adopted Ordinance: (n) Building permit applications that meet all of the following criteria: The proposed interior changes must comply with the intent of Ordinance 51 Series of 2006 including but not limited to: the preservation of the unique historic nature and character of certain interior structures and their uses; the preservation of current vitality, character, history, and protection of uses and values of the land within the central business area of the City; and the preservation of current vitality and the tourist experience, as determined by the Community Development Director; and 2. The proposed use of the building preserves and contributes to Aspen's historic and community character, vitality, aesthetics, and/or tourist experience; and 3. One of the following is demonstrated: a. The interior space was physically vacant on December 12, 2006, the date that Ordinance 51 of 2006 was adopted; or b. The application returns and/or retains the building to an established business and/or use that is at least 40 years continuously running, and the building is a listed contributing resource on the Aspen Inventory of Historic Sites and Structures, or the interior changes directly involve and are physically connected to a contributing resource in the Commercial Core historic district; and 4. The applicant submits a written agreement to the Community Development Director addressing the following items: a. A list identifying and describing the method for protecting specific interior elements that are deemed historically significant; and b. A statement agreeing to the following review processes: i. The Historic Preservation Commission will have an advisory role, and make a recommendation to the Community Development Department regarding the preservation of significant historic interior elements; and ii. The Community Development Director will review the application and make a final determination regarding the preservation of significant historic interior features, and the proposed use of the interior and its compliance with items 1 through 3 above; and iii. Appeals from an adverse decision of the Community Development Director regarding the preservation of interior elements shall be reviewed by the City Manager. The decision rendered by the City Manager shall be the final administrative action on the matter. All other appeals from the moratorium shall follow the process set forth in Section 4 of Ordinance 51, Series of 2006; and iv. Potentially historic features uncovered during the construction process shall be immediately reported to the Community Development Department and the historic significance of these elements shall be determined, by way of illustration but not limited to, using historic photographs, personal accounts, and building permit files by the Community Development Department. WHEREAS, pursuant to part (n) 4.a of the exemptions from Ordinance 51, Series of 2006 listed above, the property owners requested a recommendation from the Historic Preservation Commission regarding specific elements; and WHEREAS, Sara Adams, in her staff report dated June 27th, 2007, made a recommendation to the Historic Preservation Commission based on historic documentation and site visits; and WHEREAS, at their regular meeting on June 27, 2007, the Historic Preservation Commission considered the application and made a recommendation to the Community Development Director by a vote of 5 to 0. NOW, THEREFORE, BE IT RESOLVED: That HPC hereby recommends that the Community Development Director impose the following conditions regarding the historic preservation of interior elements for the property located at 420 East Cooper Avenue, Unit 2 of the Red Onion Condominiums, Block 89, City and Townsite of Aspen, Colorado with the following conditions: 1. The booths located along the east wall of the historic bar shall not be retained. 2. Particular attention should be paid to the excavation of the openings. After investigating the size of the openings during construction/demolition, the applicant will mock up what they would like to see and work with staff regarding an opening size that is acceptable with staff. The shot gun feeling of the existing space should be preserved. 3. Preserve as much of the existing historic file as possible, and consolidate the salvaged file in a specific section of the floor where it will be appreciated by patrons. The remainder of the floor shall be covered with file of a similar pattern and type. [signatures on following page] APPROVED BY THE COMMISSION at its regular meeting on the 27th day of June 2007.
