DEVELOPMENT ORDER ofthe City of Aspen Community Development Department This Development Order, hereinafter "Order", is hereby issued pursuant to Section 26.304.070, "Development Orders", and Section 26.308.010, "Vested Property Rights", of the City of Aspen Municipal Code. .. STAFF COMMENTS: The applicant. Karen Woodard. is requesting approval for a minor development to replace an existing 1960s glass door with wood frame with a solid glass door resembling the current door located at Amen Wardy. The door to be modified is located in the Aspen Block building which fronts both South Galena Street and Hyman Avenue. The building received landmark designation via Ordinance 57, Series 1981 by City Council. This building, zoned CC. is also located in .Aspen's Historic District. Staff and members of the HiSIOriC Preservation Commission have conducted site visits t6 the property. The request to improve the current appearance of the existing entryway with replacing the existing door that is in poor condition with a more contemporary solid glass panel door will enhance the current entryway to the store. Staff has no concerns with the door replacement as it does not face the street and is a marked improvement to the existing entranceway. The Historic Preservation Commission. upon review of this application may consider the following decision alternatives: > Approve the application as submitted; > Approve the application· with conditions to be mei prior to issuance of a building permit: > Table action to allow the applicant further time for restudy. NOTICE OF DECISION TO: Karen Woodard FROM: Fred Jarman, (Acting) Historic Preservation Officer RE: The Baggage Claim - TUMI in Aspen DATE: November 2,2000 SUMMARY: Karen Woodard, current owner of the Baggage Claim located at 307 South Galena, City and Townsite of Aspen, is requesting to make minor modifications to the entranceway to an adjoining building located at 427 E. Hyman Avenue. (The former L'equipe building) This building is slated to be occupied by a TUMI store in the near future. The project entails several modifications to the entranceway on the Hyman Avenue entrance. Karen Woodard met with Amy Guthrie prior to her departure for maternity leave. The end result was that several of the modifications were so insignificant as to not require formal review by the Historic Preservation Commission. These modifications are described below. NATURE OF THE PROPOSED PROJECT: Karen Woodard is requesting to make the following modifications: 1) Remove the carpeting and glue on the exterior on the steps and landing in the entranceway and to restore the steps to a solid gray cement finish. (See attached picture) In the event of attempting to remove the glue from the steps. it was found that the steps must be removed and replaced with new concrete /cement. Staff has found this to be an appropriate solution; 2) Insert a "grate" style door mate to be placed in the cement floor of the landing in front of the proposed new door. Staff has found this to be an appropriate solution; 3) Modify and repaint the existing "fire exit" door at the back wall of the landing in the entrance way to blend the door into the wall, remove exterior door knob and door trim, repaint (slick) the wall and door with one tan color so that the door blends in with the back wall and still maintains the function of a "fire exit" door as required by the Universal Building Code (UBC). This repainting will also include the painting of lettering of TUMI on the back wall. Staff finds this modification to be appropriate; STAFF COMMENTS: The Historic Preservation Officer, current acting Historic Preservation Officer, and the Zoning Officer for the City of Aspen met with Karen Woodard at different times at the locations where the proposed entranceway improvements are to occur in order to understand the intentions and proposed modifications to the entranceway. Amy Guthrie, at an earlier site visit, indicated to Karen Woodard. that these minor modifications to be conducted by Roger Moyer (a former Historic Preservation Commission member) were 12
. .. appropriate and insignificant as to not require formal review by Historic Preservation Commission for minor modifications to a building entranceway located at 427 E. Hyman Avenue (The former L'EQUIPE building), City and townsite of Aspen, Pitkin County. Colorado. Currently, Staff continue to maintain the same understanding with the following conditions: 1. That the applicant shall agree to the described terms in this Memorandum and that, in the event the applicant wishes to deviate from the approved modifications represented in this memorandum, the applicant shall return to the City of Aspen Historic Preservation Officer with any request to modify the terms of this request prior to taking any action on the building; 2. That the contractor to perform the work as indicated shall be Roger Moyer. If, in the event that Roger Moyer of"Aspen Painting" is unable to conduct the work, the applicant shall notify the City of Aspen Historic Preservation Officer about the change in contractors prior to the commencement of any work on the building; 3. The color chosen for the sticking ofthe exit door at the rear of the entranceway shall be a tan color as agreed upon by Amy Guthrie and the color o f the cement for the steps and landing shall be a color of gray as agreed upon by Amy Guthrie; and 4. That the applicant agrees to comply with provisions iIi the City of Aspen Municipal Code as they apply to this proposed development. Snyder Realty Services, ~ 304 South Galena Street Aspen, Colorado 970-925-2450 970-544-0996 (fax) November 14, 2000 The Historical Preservation Commission Community Development Department City of Aspen Attn: Fred Jarmen Dear Commission; As managing agent for The Aspen Block Building Partnership, owners of the Aspen Block Building, I would like to express our complete support for the door change request at the former L'Equipe space that will come before you at the November 15, 2000 meeting. The existing door in the recessed entry of 427 E. Hyman Ave. is in very poor condition and has been in need of replacement for some time. We are in support of replacing this door with an all glass door very similar to the front door of the Amen Wardy store. The existing door is not historic and was put into service sometime in the late 1960's or early 1970's during one of the renovations that was completed during that time. The entries to both stores on Hyman Street 'were completely re-done in the late 1960's and early 1970's to the current configuration so I would not think this door we are asking to replace would have any historical significance. We have recently completed Part One of the application process to add the Aspen Block Building to the National Register of Historic Structures. The Architectural Officer, Mr. Joseph Saldibar of the Colorado Historical Society has no objection to this change of the door but suggested that we keep the existing door in storage to prove it date of manufacture if requested by the National Park Service who will review both the exterior of the building and interior rehabilitation within the next 30 months. The new proposed glass door will "disappear" when open during the summer months and closed during the winter and not be visible at all from a front elevation perspective. The concrete step is going to be replaced in the spring when weather and contractors scheduling will permit. Thank you for your consideration of this request. ATTACHMENT 5 DEVELOPMENT REVIEW STANDARDS No approval for any development in the "H," Historic Overlay District, or involving historic landmarks shall be granted unless the HPC finds that all of the following standards are met: 1. The proposed development is compatible in general design, scale, site plan, massing and volume with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in a "H," Historic Overlay District, or is adjacent to a Historic Landmark. For Historic Landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot, exceed the allowed floor area by up to 500 sq.ft., or exceed the allowed site coverage by up to 5%, HPC may grant such variances after making a finding that such variation is more compatible in character with the historic landmark and the neighborhood, than would be development in accord with dimensional requirements. 2. The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development; and 3. The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or adjacent parcels; and 4. The proposed development enhances or does not diminish or detract from the architectural character and integrity of a designated historic structure or part thereof. "HISTORIC DISTRICT AND HISTORIC LANDMARK DESIGN GUIDELINES" HAVE BEEN ADOPTED BY THE CITY AND ARE AVAILABLE AS A FURTHER EXPLANATION OF THE INTENT OF HPC AND GENERAL PRINCIPALS OF HISTORIC PRESERVATION. .. ATTACHMENT 6 GENERAL SUMMARY OF ONE STEP HPC APPLICATION PROCESS 1. The following are the types of development applications which are processed in one step by the HPC: • Minor development review • Partial demolition • On-site or temporary relocation 2. Development review procedure summary. The one step HPC review procedure is as follows: • Attend a pre-application conference. The purpose of this one-on-one meeting with the historic preservation planner is to determine the review process into which your development proposal fits and to identify the materials staff will need to review your application. • Submit development application. Based on your pre-application conference, respond to the appropriate portions of the application package and submit the requested number of copies, and fee if applicable, to the Community Development Department. • Determination of completeness. Within five working days of the date of your submission, the application package will be reviewed by Staff to determine if all required information has been included. You will be notified in writing when additional materials are necessary. • Complete notice requirements. • Review of development application. Once the application is determined to be complete, the item will be scheduled on the soonest HPC agenda available. The submission due date is a minimum of nine days prior to the HPC meeting date to allow for staff review and memo preparation. It is the planner's task to review the application with respect to it's compliance with land use regulations and to write a memo to the Historic Preservation Commission. In the memo, the planner will recommend approval, approval with conditions, tabling, or denial of the application. The memo is normally available at the end of the week prior to the HPC meeting. The planner will call the applicant or representative when the memo is ready and can also provide the expected agenda time for the item.
.. 3. At the meeting, staff will make a brief presentation of the case and then the Chair will ask the applicant or representative to make a presentation or to clarify any aspects of the project. HPC members will comment on the proposal and then vote on an action. 4. Receipt of building permit. Once the approval of HPC has been received, a building permit application may be submitted. At this time the proposal will be reviewed for compliance with the Uniform Building Code and zoning regulations. Fees for water, sewer, park dedication fees, and employee housing will be collected if due. Any document, such as a plat, deed restriction, or other agreement which is required to be filed, must be recorded before the building permit will be issued. 5. HPC assigns a member of the Commission to be the "project monitor" for each project. The monitor (and Staff) may periodically visit the site as work is under construction. If any aspects of the project change after the HPC approval, the applicant, Staff, and the project monitor will attempt to address them without returning to HPC.

ATTACHMENT 7 DEFINITION OF MINOR DEVELOPMENT Minor development shall be defined as follows: • Remodeling of a structure where alterations are made to no more than one element of the structure, including but not limited to a roof, window, door, skylight, ornamental trim, siding, kickplate, dormer, porch, staircase, and balcony; • Expansion or erection of a structure wherein the increase in floor area of the structure is two hundred fifty (250) square feet or less; or • Erection or remodeling of combinations of, or multiples of no more than three (3) of the following features: awnings, canopies, signs, fences, and other similar attachments; or windows, doors, skylights, and dormers. Erection of more that three (3) of the above listed features may be defined as minor if there is a finding that the cumulative impact on such development is minor in its effect on the character of the existing structures. • Unless the community development director determines that the development is to be reviewed as a significant development, the erection of street furniture, signs, benches, public art, or similar development which is to be placed in the Commercial Core or Main Street Historic Districts.
