RESOLUTION OF THE ASPEN HISTORIC PRESERVATION COMMISSION APPROVING AN APPLICATION FOR MINOR DEVELOPMENT LOCATED AT 450 S. GALENA ST, LOTS K, L, AND M, BLOCK 96, CITY AND TOWNSITE OF ASPEN, COLORADO RESOLUTION NO. , SERIES OF 2001 WHEREAS, the applicant, Franck Muller, has requested minor development approval for the property located at 450 S. Galena St, Lots K, L, and M, Block 96, City and Townsite of Aspen. The property is located in the Commercial Core Historic District; and WHEREAS, all development in an "H," Historic Overlay District or development involving a historic landmark must meet all four Development Review Standards of Section 26.72.010(D) of the Aspen Land Use Code in order for HPC to grant approval, namely: 1. Standard: The proposed development is compatible in general design, massing and volume, scale and site plan with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in a "H," Historic Overlay District or is adjacent to an Historic Landmark. 2. Standard: The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. 3. Standard: The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or on adjacent parcels. 4. Standard: The proposed development enhances or does not diminish from the architectural character or integrity of a designated historic structure or part thereof; and WHEREAS, Christina Amato, in her staff report dated September 26, 2001, performed an analysis of the application based on the standards, and recommended approval of the project; and WHEREAS, at their regular meeting of September 26, 2001, the Historic Preservation Commission considered the application, found the application to meet the standards, and approved the application by a vote of 7 to 0. .. NOW, THEREFORE, BE IT RESOLVED: That minor development for 450 S. Galena St, Lots K, L, and M, Block 96, City and Townsite ofAspen, be approved with the following conditions: 1. Confirm that egress requirements are being met. 2. If a second exit is required, it can be approved by staff and monitor. Galena St - Minor Review, Public Hearing DATE: September 26, 2001 SUMMARY: This non-historic structure is located within the Commercial Core Historic District. The applicant requests HPC approval to convert two existing door openings to windows, and change the exterior trim of the entire retail space. APPLICANT: Franck Muller, shop owner; represented by Robin Ferguson Woodworking Inc. LOCATION: 405 S. Galena St, Lots K, L and M, Block 96, City and Townsite of Aspen. ZONING: The property is zoned "CC, Commercial Core," with a historic district overlay. MINOR DEVELOPMENT No approval for any development in the "H," Historic Overlay District, or involving historic landmarks shall be granted unless the Historic Preservation Commission finds that all ofthe following standards (Section 26.415.010.B.4) are met: a. The proposed development is compatible in general design, scale, site plan, massing and volume with designated historic structures located on the parcel and with development on adjacent parcels when the subject site is in an "H," Historic Overlay District, or is adjacent to an historic landmark. For historic landmarks where proposed development would extend into front yard, side yard and rear yard setbacks, extend into the minimum distance between buildings on the lot, exceed the allowed floor area by up to five hundred (500) square feet, or exceed the allowed site coverage by up to five (5) percent, the Historic Preservation Commission may grant necessary variances after making a finding that such variation is more compatible in character with 1 .. the historic landmark and the neighborhood than would be development in accord with dimensional requirements. In no event shall variations pursuant to this Section exceed those variations allowed under Section 26.520.040(B)(2), for detached accessory dwelling units. Response: The existing building will remain essentially unchanged. The proposal only involves switching out doors for windows and changing the trim on these openings to match the adjacent retail space. This structure that does not reflect the architectural characteristics of the Victorian era downtown. It would not be appropriate to require the new windows to match the 19th century models because these features are unrelated to the overall design of the building. Nor would it be necessary for the changes to reflect the style of adjacent historic structures as there are none. The project will meet the following design guideline: 13.16 Develop the ground noor level of all projects to encourage pedestrian activity. b. The proposed development reflects and is consistent with the character of the neighborhood of the parcel proposed for development. Response: The proposed changes will not affect the character of the neighborhood. There are no historic structures on the block of, or the block across the street facing, 450 S. Galena St. c. The proposed development enhances or does not detract from the historic significance of designated historic structures located on the parcel proposed for development or adjacent parcels. Response: The proposal will not affect the significance of any designated structure. d. The proposed development enhances or does not diminish or detract from the architectural character and integrity of a designated historic structure or part thereo£ Response: The proposal will not impact the architectural integrity of any designated structure. ALTERNATIVES: The HPC may consider any of the following alternatives: • Approve the application as submitted. • Approve the application with conditions to be met prior to issuance of a building permit. 2 .. • Table action to allow the applicant further time for restudy. (Specific recommendations should be offered.) • Deny approval finding that the application does not meet the Development Review Standards. ATTACHMENT 1 ASPEN/PITKIN COMMUNITY DEVELOPMENT DEPARTMENT City of Aspen Development Application Fee Policy The City of Aspen, pursuant to Ordinance 57 (Series of 2000), has established a fee structure for the processing of land use applications. A flat fee or deposit is collected for land use applications based on the type of application submitted. Referral fees for other City departments reviewing the application will also be collected when necessary. One check including the deposit for Planning and referral agency fees must be submitted with each land use application, made payable to the Aspen/Pitkin Community Development Department. Applications will not be accepted for processing without the required application fee. A flat fee is collected by Community Development for Administrative Approvals which normally take a minimal and predictable amount of staff time to process. The fee is not refundable. A deposit is collected by Community Development when more extensive staff review is required, as hours are likely to vary substantially from one application to another. Actual staff time spent will be charged against the deposit. Several different staff members may charge their time spent on the case in addition to the case planner. Staff time is logged to the case and staff can provide a summary report of hours spent at the applicant's request. After the deposit has been expended, the applicant will be billed monthly based on actual staff hours. Applicants may accrue and be billed additional expenses for a planner's time spent on the case following any hearing or approvals, up until the applicant applies for a building permit. Current billings must be paid within 30 days or processing of the application will be suspended. If an applicant has previously failed to pay application fees as required, no new or additional applications will be accepted for processing until the outstanding fees are paid. In no case will Building Permits be issued until all costs associated with case processing have been paid. When the case planner determines that the case is completed (whether approved or not approved), the case is considered closed and any remaining balance from the deposit will be refunded to the applicant. Applications which require a deposit must include an Agreement for Payment of Development Application Fees. The Agreement establishes the applicant as being responsible for payment of all costs associated with processing the application. The Agreement must be signed by the party responsible for payment and submitted with the application and fee in order for a land use case to be opened. The current complete fee schedule for land use applications is listed on the reverse side. ..
