For Durant Houses - 1973
1. The water lines shall be placed ata depth not less than 7 feet.
2. The fire stand pipe system may be installed in the same trench as
the 6" water line and the domestic water lines provided that the
line is at least 18" below the surface and at 1eas"c 2 feet adjacent
to the water lines. This line should have a drainage system located
at the "Y" where fire truck connections can be made to insure total
drainage of the dry.,system to pro'cect from freezing. This would
have a curb box valve below frost dep'ch which would be used to drain
the line.
3. Excavation on this site with machine equipment would take place only
within the 20 foot easement for the 6" water line.
4. In order to insure adequate soil absorption, roof drains shall be
installed and drain underneath the exposed section of each house.
5. 'Durant '73 houses will be ,constructed on concrete piers and will
require no excavating equipment that would damage the exiting vegeta-
tion.
6. Finish retaining structure at the base of the slope as discussed in
the 5th paragraph in Chen & Associates letter dated June 5, 1973.
7. Drainage by Wright~McLaughlin letter.
8. In paragraph 5, Chen & Associates letter dated May 22, 1973, Chen &
Associates believe it is safe to construct the proposed units in areas
where the general surface slope is less than 50%. Construction on
steeper slopes would require a more detailed analysis. Care should
be taken during construction to minimize cuts and to provide surface
drainage along noted drainage ways.

9. Chen & Associates Consulting Engineers should perform a site in-
spection of the excavation during construction to determine if the
soil is stable. This should be certified in writing to the Building
Inspector prior to placement of any footings.

Mr. Ellis, Mr. Hibbard, and a couple of other consulting people, we have
worked with, I feel under the circumstances, that what we have now put

Hibbard's proposal, as of this time.

Meeting was called to order at 5:15 by Vice Chairman Bruce Gillis with Charles
Collins, Victor Goodhard and Barbara Lewis, Also present CitylCounty Plan-
ning Staff members Herb Bartel, Fred Wooden, Conna Baer and City Engineer
David Ellis.

City Eng.ineer Ellis outlined his recommendations on this
subdivision which included comments by the Fire Chief.
Mr. Ellis outlined the following points: The site con-
ditions can be overcome but not without detrimental af-
fects to a substantial portion of the site asa whole.
No construction should be allowed on slopes that are
greater than 50%. Footers' shall be at a minimum of 6'.
Great amoun't of vegetation will be destroyed causing
erosion and drainage problems. A new 6" water main
will be required to adequately serve these sites which
will require crossing 100% grade.
Mr. Ellis gave the following recommendations: (1) Wright
and McLaughlin Engineers be retained to make specific
recommendations for drainage and storm water retention
for units proposed for 1973; (2) Chen and Associates
should perform a site inspection of the excavations dur-
ing construction to determine if the soil is stable.
(3) All cut and'fill areas should be controlled with
either concrete retaining walls or timber cribbing:
(4') A 6" ductile fire main be extended from the City's
12" main on Li.ttle Nell and a 6" fire hydrant be in:-,
stalled at the ground level of the existing units. A
20' easement be granted to the City for maintenance,
also a fire hydrant at top of site. (5) A system of
stand pipes and hose cabinets be installed as speci-
fied by the Fire Chief and City Engineer: (6) All
disturbed areas shall be revegetated with fast growing
trees, shrubs snd grass as per a landscaping plan:
(7) Developer shall dedicate the existing ski trail
below proposed site. Dedication should be by metes and
bounds description; 18) A detailed site plan be submitteC:
for the 1973 units showing existing structural locations,
proposed sites, utility and service plan, plus items
mentioned ,above: (9) Developer and home owners associa-
tion shall agree to maintain private fire protection
system; (10) Developer and home owners association shall
agree to join in future improvement districts: (11)
Developer shall provide bond for the cost of completing
all items listed ~bove.
Commission requested the technical requirements be
worked out with the City Engineer and Fire Chief.
Commission stated their main concerns were drainage and
steepness of slope. Question even if this project can bE
accomplished.

Mr. Ellis stated that Wright McLaughlin drainage report
pstateS -that historically run off in this area is within
normal range because of the growth. When development

occurs, they request only 10' around each site be dis-
turbed, Just that amount of disturbance will increase
the run off by 200%. It is Questionable if re-vege-
tation can take place to take care of the drainage.
Mr. HibBerd stated he would excavate with very small
equipment and in some areas would excavate by hand.
Mr. Hibberd also presented a $4,000 bond to cover the
replanting. Mr. Hibberd also stated he would be willing
to redesign his plans to eliminate the foundations and
put the structures on columns.
Vice Chairman Gillis recommend only one unit be allowed
this year to see what the impacts to the land are. Mr.
Hibberd stated he would commit to having no excavation
equipment on de site.
Commission request Mr. Hibberd work out all technical
requirements with the City Engineer and Fire Chief and
their report be in writing.
Further Mr. Hibberd either redesign the structures
(3) sites) with no excavation or Commission will con-
sider only 1 site for 1973 with excavation.
View Planes
Vice Chairman Gillis opened the public hearing on view
plane from the Hotel Jerome and from Rubey Park.
Assistant Planner Wooden reviewed with the Commission
and citizens maps showing the view to be retained from
the Hotel Jerome frontage on Main of Aspen Mountain and
Shadow Mountain. Slides of the view were shown es-
tablishing the height of buildings in the view plane
of 20'. Feel this is a legitimate request because it
does start on public right-of-way; consideration is now
under way of designating the Hotel Jerome as a his-
toric site; and the Hotel Jerome plays a major part as
relates to meeting of people. Resolution approving
the view plane and recommending same to Council was
submitted.

Mr. Russ Pielstick stated he was against this proposal,
presently the architect on the proposed building for the
vacant lot across the street. By the time this proposal
was heard ,of, the design of the project was con~lete
and had met with the Building Inspector and met all
code requirements. Mr. Pielstrick showed to the Commis-
sion the plans of the building and what the view plane
does to the project. Stated this creates a zoning en-
velope, view of the back of the Opera House and further
feel the mountains are a part of the heritage of the
City and should be enjoyed by all by view corridors
from the mall, Chamber of Commerce steps, Paepcke Park,
etc.

William Dunaway ouestioned if there were any bonuses
given when there is a view plane involved. Mr. Wooden
stated the P & Z could recommend considerations, to
the Board of Adjustment. Vice Chairman Gillis stated
there will be additional planes established.

View Plane
Mr. Wooden pointed out the points from which the view
of Aspen Mountain and Independence Pass were estab-
ltshed. Height of buildings within the view plane of
Aspen Mountain would be 25' allowed and of Independence
Pass ranging from lq' to 30'. Slides and maps were
reviewed.
Barbara Lewis auestioned if the building height line,
could be lowered, i.e. change vertical angle to re-
late to the corner of the Alps Bldg.
Vice Chairman Gillis closed the public hearing.
Lewis moved to accept the view plan from the Hotel Je-
rome as outlined, and recommend same to Council in the
form of the resolution submitted. Seconded by Good-
.hard. All in favor, motion carried.
Rubey Park View. Plane was tabled, Mr. Wooden to revise
the description and slide as outlined by Lewis.
Goodhard woved to recess this meeting to Thursday at
5:00 p.m., seconded by Collins. All in favor, meeting
adjourned at 7:10 p.m.

'Collins moved to schedule a, public hearing on
April 3rd to consider, an ameridmentto the open
space requirement clarifying the intent of the
regulation. Seconded by Lewis. Allin favor,

Planner's Office submitted proposed resolution.
Lewis moved to adopt the resolution and recom-
mend same to the City Council. Seconded by Collins.

Fred Hibberd was present and stated the Board of
Adjustment had approved his variance relative
to height conditioned upon the Planning and
Zoning Commission approval of landscaping plan.

Mr. Bartel explained as relates to the vegetation,
erosion, etc. ,the Commission would have to review
the site when weather permits. Also Mr.v Hibberd's
development falls under the new definition of a
subdivision which is condominiums and he must
follow the subdivision procedures. Planning and
Zoning will also require plat phases, applicants
position of construction methods to best preserve
the site, preliminary plat and geological report.
Public Hearing-Historic Preservation Committee was
present. Mr. David Finholm presented the findings
of the HPC: 1) "Because the Stallard House meets
the standards and criteria as outlined in the
City Zoning Code for designation as an H-Historic
Overlay District, (2) because it has significant
importance both historically and architecurally
as one, of the few remaining examples of fine..
Victorian architecture, and (3) because it h8s
both current and future importance as a his-
torical museum, HPC recommends that public hear-
ings be held to consider an H-Historic Overlay
District'zon~ for Lots A-G & K-S and portions of
the alley of Block 23 now zoned R-6 residential."

Chairman Dukes read the particulars of the case. Request states as follows:

easements on front property line without creating an extreme hardship to
the owner and excessive excavation into the existing hillside. Request to
have a setback of 15' from the edge of the existing road."

Mr. Starodoj stated he ownes the property on both sides of the road. Road
easement and pedestrian right of way and utility easement are 40'. This is.
a private road under the subdivision regulations. Building Inspector felt
that at sometime the City might want to widen the road to the 40' that is
why it was felt the house should be setback 25'. Mr. Meyring pointed out
under the zoning ordinance the structure has to set back 25' from the ease-
ment. Mr. Starodoj stated he interpreted the ordinance to mean from the
eenter line of the road. Further stated that in his deed there is a restric-
tion that the hill would not be excavated. Also wish to save the trees which
are now existing.

Board reviewed the plot plan. From review it was determinded a 7' variance
is all that would be required, not 15'. Board discussed 5' being sufficient
for the architect to work with.

Paterson moved that we grant Robert Starodoj a 5' varisnce from the easement
line which would be equal to 40' from the center line of the easement and
the Board does not feel there would be any adverse affect on the neighborhood
property that way and also grant the variance to protect the existing trees
and minimize excavation of the hill. Seconded by Smith. Roll call vote -
Paterson aye; Lavagnino aye; Colestock aye; Smith aye; Dukes aye. Motion
carried.

Chairman Dukes read the particulars of the csss. Application for building
pennit to build 16 one-family dwellings. The proposed one family dwellings
will be approximately 60 to 120 feet above the street refere~e point and
therefore the buildings would be considered 60' to 120: high. The maximum
permitted height for principal buildings is 28 feet. ~

Attorney Leonard Oates was present representing Colgate and stated they had
reviewed the new plans and met with Hr. Hibberd., At~tbis point the Colgates
have no objection but do endorae the plan if Mr. Hibbe~d will not generate
,more traffic by constructing steps acrosa Lot 15 and channel traffic so that
the tram through the Tipplewood Subdivision will not be used. The tram will
be posted as it is private property. ~ ~,

Mr. Hibberd submitted proposed site plan and stated he had met with adjacent
property ownera of Lots 14 and 15. ,.Reduced the density to 16 single family
dwellings and left additional open space. With separate dwellings will be
able to leave more vegetation and keep excavation down. Houses will be
built into the hillside and roofs wlll slope with the land. ." Copies of the
site plan and explanation sheets were sent to all owners of the 29 condomini-
ums. The main sccess will be between Buildings A and B of the Durant. Intend
to comply with the parking and will be providing a total of 50 spaces part
of which will be underground. Every space will be deeded and numbered. In
the condominium declaration of the Durant, It states under Section 36 tbat

Attorney Sandy Stuller was present representing Maxwell Aley who represents
the Andermans and stated they so support the variance with the understanding
that no variance will be requested for height on Lot 15.
Mr. Hibberd stated he would be building 3 houses per year over a five year
perIod. Would like to avoid coming in each yesr for approval for the next
years construction. Request the board, if the variance is granted, include
this in their approval. '
Question was raised as to access to the 16 units. Hr. Hibberd stated a ser-
vice tram will be constructed and deeded over as a common element. Question
as to fire access. Mr. Hibberd stated he will meet with the Building In-
spector and fire chief to go through the entire project and wlll provide all
the fire fighting facilities within the correct distance of all houses and
hydrants. Equipment will be stored in sheds next to the hydrants. Access
can be from the old county road at the top of the project. City Msnager
previously stated that water is available from the back side of the property
and the project is below the water tank. Project does comply with the pro-
posed greenllne.
Question wss raised if PUD had been investigated. Hr. Hibberd stated that
his architect for the project is Robin Maloy snd b~cau8e of the time and
confusion he decided this would be a better spproach.

Dear Mr. Hibberd:
In continuation of our Jetter of May 22, 1973, we are providing
our opinion on t.he proposed construction.
Based on our continued inspection and observations at this site
and further consideration of the data we have previously collected, we
bel ieve the slope underlying this development is stable. The material
comprising .the subsoi 15 consrsts of vel~Y granular material, and the
water table is well below the surrace or bedrock and appears to be
ralrly stable, In a dry condition, this material will stand on 1:1
slopes that vii 11 eventually ravel to approximately 1,\-: I slopes.
As mentioned in our previous ietter, we bel ieve tne areas where
the slopes are steeper than 50% should be avoided for construction.
This is not so much for stability as it is for construction difficulty
,and the possible difficulty in revegetating the slope if it is disturbed.
Fig, I indicates the general areas where we believe it is suitable for
construction. The locations can be determined In the field by the
break in slopes, These areas were roughly marked in the field on
June 1, 1973.
The dry and granular n~ture of these subsoils indicates that
subsurface drainage is good, They should have a fair capacity for
absorbing moisture as long as they are not excessively saturated. As
mentioned above, excessive saturation would affect stabil ity.
We bel ieve that the retaining structure at the base of the slo~e
may be constructed in a manner similar to that which is now under way,
This consists of timber wood cribbing which is tied into the back
slope. The purpose of this cribbing would be to prevent surface

sloughing and erosion of the steep cut behind the present Durant Apart-
ment bUIlding. A fe\.v areas of surface runoff ItJere noticed here, and
these should be improved so as not to cause erosion,
Revised figures are attached. These Include Fig, I showing the
,ocation of the sites, although we understand the buIlding locations
have been revised to conform with acceptable areas of construction.
Fig, 2 is logs of exploratory holes, and Figs. 3 ano,4 are cross
sections of the slope.
Other details discu$sed in our previous reports also remal;; val ld.
We bel ieve that site inspection of the foundation areas will be required
during construction. Careful construction techniques will be required
because .of the steep terrain. If there are any questions or unusual
conditions which arise during construction, we should be advised. In

Introduction: A previous report was submitted by us on April 2, 1973,

maximum soil pressure ror the building and stability or the steep slope
upon which they were to be placed. We have not rinished the investigation
but are providing you with what we bel ieve will be the final conclusions.
Additional observations are needed to substantiate the conclusions.
~roposed Construction: The proposed construction is similar to that
described previously, A small shallow excavation wi,ll be required ror
the lower level. The length parallel to the'slope will be about 34 fee,
and the width perpendicular to the slope Vlil1 be about 15 reet. It is
proposed to util ize both cut and fill to minimize the depth or excavation
required. Footings Vlill be stepped down to be placed on natural soils.
The buildings are to be relatively light construction,
Field investigation: Two test holes were drilled near the east property
boundary or the site, The purpose or these test holes Vias to determine
the depth and type Or soils overlying bedrock,'the type or bedrock
underlying the site, and the depth to rree water. Logs or these test
hOles and a previous test pit are shown on Fig. 2. The two test holes
indicate that bedrock I ies at a depth or 20 to 40 reet below the present
ground ~urface. In Test Hole 1, no water was measured to a depth of
72 reet, and in Test Hole 2 water Vias measured at 50 reet eight days
arter drilling.
Subsoil Conditions: The subsoil conditions described in our previous
report remain val id. The depth to bedrock indicated in the test holes
and,exposure behind the Durant Apartment Building varies rrom 20, feet in

Test Hole I, 40 feet in Test Hole 2 to about 7 reet in the cut exposure,
The upper soils consist of a heterogeneous mixture of cobbles, gravel
and sand with a silt matrix. Swell-consolidation tests indicate the
upper soi15 wIll settle and the bedrock has a low swel1 potential, see
Fig. 4. The results or a gradation test on the small sized portion of
this mixture are shown in Fig. .5. The bedrock is tentative1y identified
as the Belden formation of Pennsylvanian origin. !t is quite hard and
dry.
Preliminary Construction Areas: Based on our investigation to date, we
believe it is safe to construct the proposed units in the areas \"here
the ground surrace slope is less than 50%. These areas are shown on
Fig,), Construction on steeper s]opes viould require a more detai led
analysis. Care should' be taken during construction to minimize cuts
and to provide surrace drainage along natural drainage ways or orr the
project area where there are natural drainage ways. This must be done
both during and after construction.

Frorn a stabi 1 it"y point of vievJ, of more concern is the steep cut
behind the present Durant lI,parthlent Bui lding, \1e bel ieve this steep
cut should be provided with some type of retaining structure. The
structure may be-either reinforced concrete or gravity. The reinforced
concrete type structure will require less working space than the gravity
wall. Lateral earth pressure design should be based on an equivalent
rluid weight of 60 pcf. The soils in place have a dry unit weight of
about 130 pcf with moisture content of about 10%. The wall will be 10 to
15 feet high,
Foundation Recommendations: Based on the soils revealed in our test
pit and drill holes, we bel ieve spread footings would be the most
desirable type foundation. Spread rootings can be designed for a
maximum soil pressure or 3,000 psf. Continuous foundation walls should
be heavily reinrorced to span an unsupported length or at least 12 reet
and to resist lateral earth pressure based on an equivalent fluid weight
of 60 pcf, All footings should be placed below frost depth, We also
recommend that the excavation be inspected by a competent soil engineer
to determi~e i( the footings are placed on rirm soil capable or support-
ing the recommended design pressures.
Surrace Orainage: Provision must be made to provide adequate surface
drainage so that water passing onto and OVer the site will not cause
erosion or excessive saturation or the upper soils, We suggest that a
drainage study be made to determine the most desirable way to handle the
runorr. Runoff should be kept ofr or the present cut slopes as they
are unvegetated and erode very easily, Particular care wil I be needed
during construction to prevent the excavations from becoming excessively

the building in all directions, Final grading shouid provide a slope

well away from the buildings.
Final Report: As mentioned above, we bel icve that additional observations
are required to determine the suitability of the entire site for construc-
tion. We will continue this investigation and report the results to you
as soon as possible, In the meantime, if we can provide additional
information or discuss the results of our investigation). please let us

Service prior to the meeting of December 18th.
2. The parking plan - I believe that you told me that
parking had been worked out and I assume if it has, it will
appear on the plat. If r am mistaken about this, please let

I believe you told me that you have a plat that satisfies
most of the requirements of the preliminary plat. That plat
should show topographical deliniation and should show the8Q-40
line and the trial to be dedicated to the City.
According to Donna, we will only have to go through the
initial conceptual stage of Ordinance 19 and then we can pursue
only the sUbdivision regulations.
In reviewing the exceptions or exemptions to subdivision
and Ordinance 19, it appears to me that you probably don't comply.
We should be able to have a final decision of approval or dis-
approval no later than the second thirty day period provided
for in the Subdivision Regulations, which I would interpret to
be around February 2Qth. If you wish to formally pursue exemp-
tions or exceptions, we can discuss this when you are here later
this month.

Mr. Fred Hibberd contacted us this morning as he was concerned about
the second sentence of our December 7, 1973 letter:
"The solution we have arrived at directly implies the
difficulty of developing this site."
This comment was made because we feel that the construction of runoff
detention tanks and similar facilities is an extreme measure in order to
deve I op a site.
However, the solution discussed does provide a workable way of detain-
ing and managing increased runoff from the site.
