You will please find enclosed herewith a letter
which I received from the Pitkin County Treasurer with respect
to taxes paid to the City of Aspen on account of its mil levy
on the portion of Lot 6, Sunny Park Subdivision, owned by
Suzette Ann Jacobie. You will please note that the total amount
is $383.09. In addition, in accordance with my calculations and
the recitation on the Condominium Plat, the property as proposed
for subdivision into the Jacobie Condominiums contains 0.17S acres
which, under the provisions of the Subdivision Ordinance, would
mean that the Jacobies would be obligated in the amount of $6.12.
for final plat processing. We would ask that you deduct the
aggregate of the two sums above recited from the dedication fee
paid and remit the same. Please forward the check to me, and I
will transmit it to the Jacobies.

Dear Dave:
I am in receipt of your letter of December 5, 1977,
with r~spectto the above project. I would advise you that on
December Sth that the plat was executed by Suzette Ann Jacobie, and
the SUbdivision Agreement tendered with fees paid. As aconse-
quence, it is up to Karen now to. circulate the document for the
City's signatures. As I explained to her, the only item which
will be missing by way of signature on the Condominium Map will
be the statement of Stewart Title Guaranty Company that the ease-
ments are free and clear of all liens and encumbrances. As you
are aware, those are to be dedicated to the City for the purposes
intended. I h~ve in my possession releases of, the deeds of trust.
encumbering those easements, which will be tendered for release
of record at such time as the Plat is recorded. As a consequence,
I think that the final completion of this project can be coordinated
as between you, myself and Karen Smith.

referred to as "City"):

WHEREAS, owner and subdivider has submitted to the
City for subdivision approval, execution and recording, a
Final Plat of the Jacobie Condominiums Subdivision consisting
of that tract of land described in Exhibit A, attached hereto
and incorporated by this reference, and
WHEREAS, the City has fully considered such Final

virtue of the subdivision regulations of the City of Aspen, and
WHEREAS, the owner and subdivider is Willing to accept
these conditions and to enter into this agreement with the City
to provide for the same;
NOW, THEREFORE, in consideration of the mutual covenants
herein contained, the parties hereto stipulate and agree as
follows:

Owner and subdivider aCknowledges that the present
design provisions of the City's subdivision ordinance contain
requirements for street surfacing, sidewalk, curb and gutter
construction, drainage improvements, undergrounding of utilities
and other necessary improvements, to which the proposed sub-
division does not entirely conform.

Therefore, in lieu
of requiring owner and subdivider to install subdivision
improvements which mayor may not conform with similar improve-
ments that may subsequently be required in the general area,
the City, as a condition of approving the Final Plat, will
interest, grantees and assigns, to make certain covenants and
require owner and subdivider, for herself, her Successors in
agreements which will provide for such subdivision improvements
to be constructed and paid for in the future, all as specified
in paragraphs3 and 4 hereof.
3. Owner and subdivider, for herself, her heirs
in interest, grantees and assigns, covenants and agrees to
and with the City that she will affirmatively consent to and
join in the formation of any special improvement district,
encompassing all or any part of the subdivision, that may

hereafter be proposed or formed for the construction of any
improvement required by the City's subdivision ordinance as
now in force and effect respecting street improvements
(including paving, curb and gutter, and sidewalk), drainage
improvements, and buried electrical improvements. Further,
owner and subdivider waives and further COvenants and agrees
to waive any right of protest against the formation of any
such district for the enumerated purposes.
4. Owner and subdivider, for herself, her heirs
in interest, grantees and assigns, covenants and agrees that

procedures are hereby waived by the City.
6. Owner and subdivider agrees that the number of
parking spaces existing on the site shall be maintained, and
that no additional structures shall be constructed on the site
such as to reduce that area available for parking as shown on
the Final Plat.

certain conditions, to dedicate to public use, the sub~

Plat, as full payment of all obligations of owner and subdivider
under the land/cash dedication requirements of Section 20-18 of
the Aspen Municipal Code, the validity and application of which
ordinance the owner and subdivider contests.
11. The covenants and agreements of the owner and
subdivider herein shall be deemed Covenants that run with the
land, shall burden the land included within the Subdivision,
and shall bind and be specifically enforceable against all
present and subsequent owners thereof, including Owner and

Subdivider, her heirs, personal representatives, successors in
interest and assigns.
To adequately apprise successors in
interest of these Obligations, owner and subdivider will in-
corporate by reference within the Condominium Declaration of
Jacobie Condominiums appropriate references to the obLigations
assumed herein.
12. Upon execution of this Agreement by all parties
hereto, and receipt by the City of the payment referred to in
Paragraph 10, and appropriate recording fees, City agrees to
approve and execute the Final Plat and to authorize the record-
ing of the same in the real property records of Pitkin County,
Colorado.

the six-months minimum lease restriction with two exceptions for
short-term rentals, and the ninetY-day right of first refusal
respecting existing tenants of the bUilding.
Suzie Jacobie will be out of town for the next two
weeks. As soon as she is back, we will endeavor to get all of
the documentation executed by her. May I suggest that the final
plat for recording be circulated to all of the city department
heads for approval in anticipation of her return.

RE: An "Opinion of Value" for the
Susette Jacobie Property, North 1/2 of Lot 6, Sunny Park
Subdivision, Aspen, Colorado, for Park Dedication Fees.
Dear Mick:
Pursuant to the request of Mr. Lenny Oates, I have personally
examined the subject property, have gathered and analyzed
applicable market data for the purpose of estimating the Fair
Market Value of the subject site as if vacant, under the Sub-
division Dedication Fee requirement,
The subj ect site contains 7,500 'square feet and is improved with
a two-story frame building containing five, two-bedroom apart-
ments. The property is zoned residential-multi family and may
be developed as follows: seven studio units, six one-bedroom
units, three two-bedroom units, and two three-bedroom units.
Although the subject is currently over-improved, it was devel_
oped prior to the current zoning. This analysis concerns only
the land value if free and clear under current zoning.
My investigation of the most recent sales of residential_multi
family properties indicates a range of from $10-12 per square
foot. This further reflects values on a per unit basis in the
area of $21,000 to $25,000 per two-bedroom unit.
The subject site contains interior lots in a slightly less de-
sirable, crowded area which would fall near the lower range of
value, Therefore: $10 per square foot x 7,500 square feet
equals, say $75,000 ($25,000 per unit).

DATE: October 20, 1977
The Final Plat of the Jacobie Condominiumis on Park Circle is before you
for approval. The subdivision involves an existing building consisting
of five dwell ing units. The matter was considered by the Rlanning and
Zoning Commission on August 17th and recommended for approval subject
to the resolution of certain boundary descriptions and utility easement
locations. These have been reviewed by the City Engineer and resolved
to his satisfaction.
Dave Ellis does wish to condition approval of the Final Plat on correction
of two minor details as follows:
1. Reference to "Parks and Recreation"in the Parks Department
approval should be changed to "Parks."
2. Under the Recording Certificate, a notation should be
added for the recording information on the subdivision
agreement.
The subdivision agreement must be finally reviewed as well. Subject
to payment of the appropriate park dedication fee, we recommend approval.

The final plat is satisfactory except for a couple of minor details: the
reference to "Parks & Recreation" in the Parks Department approval should
be changed to "Parks" and a notation for the recording information on

No subdivision agreement was submitted but should include the standard
clauses for commitments to join street and drainage improvement districts

Final Plat of the Jacobie Condominiums which I would ask be
processed in accordance with Section 20-14 of the official
Code of the City of Aspen.
I am aware of the common boundary as between the Jacobie
Condominiums and that of Mr. James Costley, who has an
application pending for preliminary plat approval of the
16S Park Circle Condominiums. I am advised by our surveyor,
Mr. Kenneth Glenn of Gingery Associates, that Costley's plat
should conform to ours to constitute the proper common boundary.
With respect to any problems which may be encountered, you have
our assurances that the matter will be satisfactorily resolved
prior to final Council approval of the Final Plat. Also enclosed
is the $3S filing fee.

Dear Jeff and Lennie:
I have decided to address the common boundary line problem
On a joint basis since it appears ,that both parties will be
involved in the solution, My situation is simply that I
cannot simultaneously approve two subdivisions with a common
boundary when the surveys do not agree. From the work done
in this office it appears neither parcel description by it-
self closes mathematically but that the perimeter of the
combine~ parcels does close adequately, Thus, the problem
again is a matter of deCiding where the common boundary lies.

Having reviewed the preliminary plat of the Jacobi
Subdivision, the Housing Office has no further comments
except that to note the general comments raised under the
condominiumization of multi-family rental units.
As you remember, these considerations include the
displacement of tenants, the non-affordability of the
units by persons of low or moderate incomes, and the
gradual deterioration of the rental market in favor of
more expensive ownership housing.

Dear Sirs:
We have reviewed the plat of the "Jacobie Condominiums Subdivision"
and have found the utility easements to be inadequate. Mountain
Bell will require an utility easement Ten (10) feet in width adjacent
to and parallel with Unit I, traversing South to the property line
over the area designated as telephone and electric lines on the plat.
Also, an utility easement over the Southerly Ten (10) feet adjacent
to and parallel with the property line over the area designated as
telephone and electrice lines on the plat. The above requested
easements are shown on the attached plat.
All easements should be dedicated to the Public Utilities Companies
and designated as such on the final plat.

Dear Bill:
Pursuant to Section 20-11 of the Official Code of
the City of Aspen submitted herewith are twenty-one(21) copies
of the Preliminary Plat of Suzette Ann Jacobie for the Jacobie
Condominiums Subdivision. I have reviewed the plat and am
satisfied that it contains all of the information required by
Section 20-12 of the Code.
You will also find enclosed a check from the
Jacobie's in the amount of $280.00 as required by Section 20-20
(a) (~) of the Code.
We request that this matter be set before the Plan-
ning Commission for public hearing as early as possible after the
required twenty-eight(28) day period.

DATE: May 18, 1977
This is a request for conceptual subdivision approval by Suzette Jacobie
for the condominiumization of the Jacobie Apartments which are located
on a portion of Block 6, Sunny Park Subdivision. The project consists
of an existing five two (2) bedroom unit apartment complex which is
proposed for condominiumization. The property is zoned RMF P.U.D.
The Planning Office and Planning and Zoning Commission recommend
conceptual subdivision approval subject to technical review of the
project at the preliminary plat state; a minimum six (6) month lease
restriction; and a 90 day notice to existing tenants giving a
non-assignable right of first refusal to purchase the units at
market price.

Ladies and Gentlemen:
Since the City Planning and Zoning Commission wishes
further to discuss the matter of policy as to mUlti-family condomin-
ium conversion, and since it is our understanding Planning and
Zoning will do so again on April 26, in order not to waste Council's
time, we withdraw Our request for specific hearings on the Jacobie
and AEM applications for your Council meeting on April 2S, which
was requested by Lennie Oates at your April 11 meeting.
Naturally we feel obligated to state, to protect our
clients, that (1) we waive no legal rights we may have including,
but not limited to, under all of Chapter 20 of the Aspen City Code;
(2) we believe we have the right to a hearing on the specific appli-
cations; (3) the City's administrative delay is illegal and arbitrary;
and (4) the City is legal estopped from denying or denying further
processing these two pending applications.
Other than the necessary legal jargon and reservations

Gentlemen:
We represen~nd the Jacobies, .which have two
of the only three pending multi-family condominium conversion
applications on file. AEM received conceptual subdivision approval
from you many months ago as did the Jacobies. As you know, in the
meanwhile, the City Council has more or less adopted administrative
delay with regard to the processing, first of duplex conversions and,
second, of mUlti-family conversions, pending obtaining data from
Brian Goodheim, the Pitkin County Housing Director. We supplied
substantial data to City Council ,that hopefUlly helped them to
resolve the duplex condominium conversion issue.
As you are aware from the materials we sent to you for
this meeting, we have also assembled some data and tried to provide
some input to City Council with regard to multi-family condominium
conversions.
We understand that Brian's memo and the matter of
multi-family condominium conversions are on your agenda as a study
item this evening. We do not wish to take your time by making oral
presentations. We have presented written data and are hopeful that
you will have considered it.

impair the economic situation of the employees in town (our
applications are for an eight unit and a five unit bUildings
and some of our clients' tenants wish to purchase the condomin-
iums if condominiumization is approved);
2. That you recommend to the City Council that they
at least grant us conceptual subdivision approval while their
present study is pending so that we can proceed to the preliminary
subdivision approval stage with you, that will involve additional
work by us, so that we will not have wasted significant time, if
the City alternately agrees with us that these particular pending
applications ought to be granted, or that multi-family conversions
should be granted generally; and/or
3. That you recommend to the City Council that they
impose a specific time limit upon Brian to complete the data that
he feels necessary, namely the survey of all of the condominiums
in town, etc. in order to make his report. While with regard to
the duplexes and some of the multi-family matters we spent con-
siderable lawyer time, and money on consultants, we are not in
the position now to continue that work as AEM and the Jacobie
applications involve local people with very little funds rather
than developers. Hence, they can't hire further consultants to
assist Brian and the City in the study as we otherwise would
offer.
Thank you once again for your consideration of our
problems. The Jacobies and the AEMpartners whom we represent
are local people, who we believe will be meeting local needs by
condominiumization. With regard to AEM, they went through
complete Ordinance 19 review when they originally built the
bUilding, and as I have repeatedly stated to all concerned, it
surely would be unfair to process and to impose considerable
administrative delays upon them and the Jacobies when at the
time they applied, the City's policy was clearly to grant
subdivision exemptions for such conversions.
