HomeMy WebLinkAboutordinance.council.058-00 ORDINANCE NO. ,~ Series of 200B AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, AMENDING SECTION 26.510.030(B) TO CHANGE THE REGULATIONS RELATING TO RESIDENTIAL SECURITY SIGNS AND RESIDENTIAL NAME AND ADDRESS SIGNS. WHEREAS, the City Council recognizes that there should be a "special respect for individual liberty in the home" (City ofLadue v Gilleo, 114 S.Ct. 2038 (1994)), and, thus, the United States Constitution affords signs displayed on private property special protection; and WHEREAS, there is a substantial governmental interest in promoting aesthetic and environmental quality of life in both residential and commercial areas of the City.of Aspen, and; WHEREAS, there is a substantial governmental interest in promoting the public health, safety and welfare and convenience by ensuring that persons may reasonably use the public streets, sidewalks, and rights-of-way, without being visually assaulted by unsightly signs, and; WHEREAS, the public health, safety, welfare and convenience require that the good appearance of the public streets and grounds be maintained; the uniquely historic nature of Aspen's neighborhoods be preserved; and, that the aesthetic beauty of the City of Aspen be preserved and protected; and, WHEREAS, the City Council has determined that the regulations proposed herein are narrowly tailored to achieve the governmental interests set forth above. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That Section 26.510.030(B)(20) of the Municipal Code which section regulates residential name and address signs, is hereby amended to read as follows: 20. Residential name and address signs. Every detached residential dwelling unit or duplex unit may have mailbox or wall signs with an area not to exceed two (2) square feet to identify the street address and the name(s) of the occupants. Section 2. That Section 261510.030(B) of the Municipal Code be amended by the.addition of a new subsection (21 which subsection shall read as follows: 21. Security signs. Every parcel may display security signs not to exceed an area of six inches wide by six inches long (6" x 6"). Security signs may contain a message, logo, or symbol alerting the public to the presence of a security system on the premises. Security signs shall be of a neutral color. Security signs may not be placed in the City right-of-way. Section 3. If any section, subsection, s~ntence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions hereof. A public hearing on the ordinance shall be held on the ~ day of ~,~ 2001, in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
