MINUTES OF JANUARY 17, 2001
Meeting was called to order by Jon Busch with Eric Cohen, John Starr and
Bill Dinsmoor present. Terry Butler was excused.
PUBLIC COMMENTS
Bill relayed that Tom Yoder wrote a letter to Chris Nolan about the lack of
cleanliness and trash left in front of storefronts. He also has a concern about
maintenance trucks in the malls, plumbers, carpenters etc. Chris Nolan
suggested that he contact the CCLC.
Tom Yoder, owner ofKemo Sabe reported that trash is all over the city and
mall by store owners. Store owners cannot clean up their own messes
The quality of Aspen needs Jo be kept up. It takes all of us collectively to
keep Aspen clean.
Tom said right now, the mentality is if you have a truck you can park in the
mall. He sees numerous trucks on the mall and he confronts the repair
people. Six or eight people are on the mall weekly. Tom said he could use
a track parked on the mall. Something needs to be done.
Galen Bright, Baggage Claim relayed that his area is clean because he
cleans it himself. He got rid of his property manager as nothing was getting
done after numerous contacts.
Bill relayed management of stores do not care.
Tom said he doesn't understand why stores do not care and people do not
care.
Bill said ifa substantial fine and pier pressure are addressed maybe things
could change. In order to do that you have to have substantial evidence.
Tom said the Cos Bar is notorious for getting bubble wrap and peanuts and
letting it blow all over the town. ~
Bill said service vehicles can drop Off equipment but it is his assumption
that they are not allowed to park on the mall.

Tom said when he approaches individuals parking on the mall he makes a
lot of enemies.
Son Said there is a City component to this and what can CCLC do. There is
a bit o££alling down on the city's par~. He sees that the curbs are not being
cut regularly and snow and ice are building up. Maybe Streets is spreading
themselves out in the neighborhoods more rather than in the core.
$ohn said he read in the paper that an entirely new system was purchased by
the Streets Department.
Galen said Cooper Street was not cleaned until last week and it was two
months.
Staffwas directed to contact the Streets Department and get a schedule for
street cleaning for the next meeting.
Jon said lumber is piled up in the alley behind the David Flori gallery.
Jon directed Kathy to have the appropriate people to come to the next
meeting. Mall clean up Parks, Environmental Health, trash and Streets
Dept.
Galen Bright, Baggage Claim relayed in the spring and fall the streets do
not get cleaned enough. The streets need cleaned once a week.
Tom said on January 1st the streets and malls were horrible. The city needs
to have extra people to clean up during Peak times as we are a resort
community.
Bill interjected that individuals who do not clean up after their animals
should have to go around town for a month and clean up the town in
punishment.
John said the key issue on dog is enforcement. New York City has turned
around regarding dog clean up.

Kathy said any individuals can call the police, parking or community
service for the issuance of tickets.
Eric suggested that a letter be sent to businesses in the core stating that in an
effort to keep the downtown area clean we would like to see the
responsibility on the businesses themselves to maintain the beauty of their
storefront area and alleys.,When Violations or questions are needed please
call:
Tim Ware for parking etc.
Rebecca
Street Dept.
Environmental Health.
Eric said numerous calls reporting one person will get attention and a
response from the appropriate department.
Issues:
Trash, trucks and illegally parked vehicles, on the malls.
Eric also stated that Contractors, plumbers etc. should be notified what they
can and cannot do when they apply for a license. Possibly a letter should be
sent to them.
Jon said we should send to the businesses the information on heavy card
stock so it can be posted. Jon also suggested it should be written in
Spanish.
Eric said the impetus should be put on the owners and workers to police
their own area.
Bill said the ACRA involved with this information at their next meeting.
Tom Yoder volunteered to draft the information to the businesses for review
by the board.
Cath from the Ozzie Shoes inquired about the possibility of sidewalk sales.

Sidewalk sales:
Bill reiterated the intent of the side walk sales for the public. CCLC is
reviewing the ordinance that covers the use of public space by private
businesses i.e. farmers market, sidewalk sales. The idea was broached with
the ACRA and Lily Garfield who represented some of the retail stores and it
~vas relayed that sidewalk sales cheapen the image of Aspen. The idea is to
do a marketing paradigm like Cherry Creek to bring people in.
Some of the CCLC members disagree and feel business opportunities would
be welcomed. Cherry Creek has sidewalk sales all the time. Cherry Creek
is a lively shopping experience.
John said we need to have the proper parameters regarding sidewalk sales.
Sales might be viable for some businesses and not others. John said it may
be determined after the meetings that this is not viable for Aspen.
Cath said she remembers when businesses could do outside sales years ago.
Personally she does not like it. The policy should be consistent for '
everyone. Her idea is to do a sale during off-season in order for the owners
to make it through.
Tom Yoder said if owners want to have a sale they can do it inside their
store. He feels people will abuse the idea of the sales on public property.
John Starr said he still is in favor of the sales tax di~cotmt idea.
Eric said in the middle of Sept. (off season) woUld be a good time to have
the event and the sales tax concept should be included. He feels it should
include hotels and retail, Possibly the extra sales tax collected could go to
the non-profits.
Kathy was directed to check into the SALES TAX ISSUE.
John said it is not the tax itself it is the idea that you are getting something.
Eric said the sale should be at the same time every year for promotional
issues.

Bill said the genesis of it is there anything more that the City of Aspen can
do by ordinance to allow opportunities for the retail community to flourish
that is being restricted now. The entrepreneurs should figure out ways to
sell themselves and sell the town at a time when we have little business. It
would be fun for our local community. The Aspen height is being picked
up and used as a marketing ploy.
Cath said a lot of businesses are out of New York. Small businesses like
Uriah Heeps are being pushed out of Aspen.
Bill said Aspen needs marketed in a different way and manner.
Tom Yoder said there is a store in town that runs an incredible sale because
they work at it. That is Cath at Ozzies.
Eric said if the third or fourth weekend in Sept. coincides with the Golden
Leaf Marathon and it is a big weekend he sees potential for retailers.
Charlie Tarver was contacted and he is totally against side walk sales as it
cheapens Aspen.
Shea from Sachet was interested in a sale at Iow peak times but indicated
the farmers market needs re:visited. She suggests that local florists could
rotate per weekend or per month and should be allowed in the farmers
market. She said the flowers being sold at the market are not all from
Colorado. Local vendors such as herself should be permitted in the market.
Heathe~ Isberian is against the sidewalk sales. She suggests the City should
protect what businesses they have. Many hotels including the Inn at Aspen
do trunk sales AT PEAK TIMES XMAS that compete with local businesses
and all they pay is $150.
Tom Yoder said a temporary vending permit or business license permit for
such shows should cost $10,000.

Cath relayed that the rems are going up and nothing can be done about it.
The rose man competes with local business just like trunk shows.
Galen asked what happens if people have sales next to me and I cannot get
into the my store. It should be all or nothing or no sidewalk sales.
The Board thanked the public for attending the meeting and for giving their
input.
COMMENTS
John Starr relayed that he feels the CCLC should be their energy in the
DEPP Phase II project.
Tom Yoder and Galen Bright are very much in favor of Galena Street for
Phase II and will help with promoting the idea.
Staff was directed to get the survey on DEPP from Ed Saddler, Asset
Manager.
Bill and Eric talked about infill and updated the board. An idea was brought
up that exactions would pay for the nest DEPP project.
Staff also commented that Heather relayed that the City has no enforcement.
Staff reiterated that it is the policy of the city to be complaint driven.
Bill said if you enforce then the problem goes away.
John Starr asked staff to get the figures from finance what the hit (cost)
would be in off-season if we loose two days of sales tax monies. That
would include hotels.
Motion: Bill moved to adjourn; second by John Starr. All in favor, motion
carried.
