The property is zoned 0- Office. Pertinent facts of the project are as follows: 1. Land area - 14,949 square feet. 2. Building area A. Offi ce , 11 ,211 B. Employee Housing 3,738 14,949 square feet 3. Parking spaces (3/1,000 sq.ft.) = 37 The comments of the planning office are as follows: 1. The property slopes to the west and north which will present certain design contraints for the parking area. 2. We support the alternative of allowing the employee housing units to be determined by the .25 F.A.R. requirement rather than the RMF densities. This would allow the construction of six (6) long term housing units which would be constrained by minimum six (6) month lease provisions. 3. We wish to further review the configuration of the parking structure to visually soften its appearance and provide more usable open space for the deveJop- ment. This can be accomplished at the preliminary plat review stager. 4. We are recommending a change to the parking require- ments for the office zone which would allow by Special Review the reduction of the parking requirement to 1.5 spaces per 1,000 square feet of building. Such reduction would allow the parking structure design to be significantly changed by the creation of open additional park area adjacent to Aspen Street. This amendment is part of a more comprehensive amendment to the Office zone now pending before the Aspen P & z. Since this is not a P.U.D. we have no ability to waive the existing requirement of 3 spaces per 1,000 square feet of building. The developer is willing to reduce the parking to 23 spaces upon adoption of the Office zone changes. 5. The Engineering Office recommends conceptual approval with no conditions (letter in file). 6. The Planning Office recommends conceptual approval of Park Central West conditional upon the above considerations. .-... .-.... Parking Space: 26 spaces Required Minimum Total 17 units commercial 6 units residential 23 units The comments of the Planning Office are as follows: 1. The City Engineer has recommended approval subject to certain technical plat amendments. 2. Tfi,Lnew Office zone requires conformance with an "approved housing plan" as same fully described in the memo from Sandy Stuller, dated October 13, 1976, and attached hereto. We have asked the developer to work out such a plan with Brian Goodheim for your consideration at Tuesday's meeting. 3. We would recommend reducing the parking request from 26 to 23 spaces by the elemination of two spaces on the corner of the alley and Aspen Street and the parking space to the east of the building adjacent to the stairs. Three spaces should be included as landscaped areas and "shown on the landscaping plan. 4. The reduction of aprking spaces is justified due to the improvement in the site plan by increasing landscaping and by reducing the massing effect of the two level parking structure. - " ~veRY1eWassociates r. As we discussed last night, the Council adoption of Ordinance No. 49 creates, in the "0" Office District, the potential for a density bonus for "accessory dwelling units recog~ized as moderate income housing by an approved housing plan". The ordinance goes further and defines "~oderate Income Housing" as ,,/ ,: ./ /' That housing recognized by an approved housing plan as satisfying the community need for low and moderate housing; criteria for such housing shall be established by such a plan, have as its objective the supplying of permanent moderate . cost housing, and may include the creation of buyer/lessee qualifications, rent/sales price guidelines, rent controls, limitations on resale, or other appropriate regulations. The comments of the Planning Office are as follows: 1. The City Engineer has recommended Preliminary Plat approval subject to certain technial plat amendments. 2. The Council has not acted on the new Office Zone which allows .75 FAR commercial and .25 accessory housing units. However, the project is in compliance with existing zoning requirements. Upon Council adoption of the new office zone the parking require- ment may be reduced from 39 to 23 spaces. We en- dorse this reduction as it would eliminate the second story parking structure and thereby soften the visual appearance of the bUilding. 3. The developer must show compliance with our adopted housing policies before compliance is obtained with the new office zone. 4. Only 37 parking spaces are shown, while 39 are re- quired by the present office zone regulations. 5. The property is zoned 0- Office. Pertinent facts of the project are as follows: 1. Land area - 14,949 square feet. 2. Building area A. Office , 11,211 B. Employee Housing 3,738 14,949 square feet 3. Parking spaces (3/1,000 sq. ft.) = 37 The comments of the planning office are as follows: 1. The property slopes to the west and north which will present certain design contraints for the parking area. 2. We support the alternative of allowing the employee housing units to be determined by the .25 F.A.R. requirement rather than the RMF densities. This would allow the construction of six (6) Tong term housing units which would be constrained by minimum, six (6) month lease provisions. 3. We wish to further review the configuration of the parking structure to visually soften its appearance and provide more usable open space for the develop- ment. This can be accomplished at the preliminary plat review stage'., 4. We are recommending a ~hange to the parking require- ments for the office zone which would allow by Special Review the reduction of the parking requirement to 1.5 spaces per 1,000 square feet of building. Such reduction would allow the parking structure design to be significantly changed by the creation of open additional park area adjacent 'to Aspen Street. This amendment is part of a more comprehensive amendment to the ,Office zone now pending before the Aspen P & z. Since this is not a P.U.D. we have no ability to waive the existing requirement of 3 spaces per 1,000 square feet of building. The developer is willing to reduce the parking to 23 spaces upon adoption .of the Office zone changes. 5. The Engineering Office recommends conceptual approval, with no conditions (letter in file). 6. The Planning Office recommends conceptual approval of Park Central West conditional upon the above considerations. . . It is my understanding that your official recommendation to the Planning and Zoning Commission for their July 6 review of the Conceptual Presentat10n will include: 1. Conceptual Plan '2 will be used as a basis for approval; 2. The west side of the upper level parking deck will be landscaped in lieu of providing 5 parking spaces indicated in the plan; 3. The number of employee housing units will be determined by .25 to 1 FAR and not the RMF densities. This will allow us to DUTld approxi- mately 6 one bedroom units instead of 3 and would seem to complement current philosophy of providing more employee housing. This is the propos.ed complex being dev610ped by Rlvervlew Associates on the five lots Immediately west of where our current Pari< Central Office Building is under construction on the south half of Block 75, Aspen. I Please note we ha~ enclosed two different Conceptual Presentations on thll 88me project. We have done this based IJpon a memorandum to Sill Kane from John Stanford dated Iv\ay 4th, ... copy of which Is enclosed. I In Conceptual Presente.tlOI1 '* 1, We have built our office space e.t the allowed. 75 to 1 FAR. We have built the employee housing at FAR .25 to 1. This .25 to 1 bonus will anew us to build apprvximately six one-bedNXlm employee units. Parking is being provided to accommodate twenty-three cars. [This parking wtll allow us to provide in excess of 1.5 spaces tor each tho<...sand square feet of office space and illso have one parking space for each employee housing unit. \Nhen you consider the duplication of employees of the building living in the housing provided in the building, the actual ratio exceeds two spaces per thousand square re..t of building. I The significant benEiftt from Plan .1 Is the fact that the massive and obviOU$ parking structure associated with Our current complex will be eHmlnated and al most one- half of the cars In the COI'1ceptual Plan 11!1 will be screened from view, giving the complex much less visual Impact. I I I , iii . """" ,..,,.., Mr. Hal Clark June 15, 1976 Page two I The other benefit is that in giving an Interpretation to the density bonus of .:25 to 1 for employee housing, we lire able to double the number of employee units within the Prvject and 5tHI be within the 1: 1 FAR that is granted by Ordinance and proposed by the P & Z. A third advantage to Plan.1 Is that more area can be devoted to landscapIng. I Conceptual Plan #2; is a very straightfor"Ward presentation based upOn the currer'lt zoning and the changes most recently recommended to t~ zoning code by the Planning and Zoning Commission. Theslgnlf'lcant polnt$ of thl$ plan are:, I 1. .75tol.FARforo1'ftce; , :2. Three employee housing units based upon the RMF density; 3. Thirty-seve n parking spaces based upon thr-ee space$ per thousand square feet of building. I We have taken the time to develop these two Conceptual Presentations for th8 express purpose of providing more employee housing and reducing the vlsval and actual impact of parking in the O-Office zone as well as devoting more. ljlpen space to landscaping. Council Members City of Aspen City Hall Aspen, Colorado 81611 Dear Mayor Standley & Council Members:, Before your bi-monthly meeting on Monday in which the merits of further downzoning are scheduled to be discussed I feel compelled, as a property owner and one who was just downzoned last April, to present you with my views on a particular piece of property as well as other comments relevant to downzoning. , / It is my understanding the primary rea~on precipitating council cC)ncernover growth and building, primarily in the commercial core and contiguou;;, areas, has been because of the number and mass of the buildings being constructed this, summer. I think it imperative you comprehend, however, all but one of these buildings (petite Victorian Squ"re) is being built under Ordinance19,0ld zoning and old densities. As a result you have yet to see the impact or l"ck of impact from the recently adopted Building Code "nd Subdivision Regulation;; you, the Planning Office, Planning & Zoning Commission and City Attorney worked so hard to adopt. As an example I call your attention to the enclosed plot plan for the old VanGaevernitz property across from the Crystal Palace which Riverview is attempting to develop in two independent phases. You will note we have 27,000 square feet of land in the half block. Of this area less than 7000 square feet (25%) will be occupied by buildings. The balance of 20,000 square feet (75%) will be devoted to open space and landscaped parking. By way of comparison our small development will have parking for over eighty automobiles, more than now provided by City Market and the Durant Mall combined. The Code wisely required this parking in the Office District and our owners, tenants and their clients will appreciate this amenity more, and more as the years go by. ~ , . .~ ,- I", Standley & Council Members Page 2 For those of you who favor an immediate moratorium or think building and growth should be brought to an absolute halt I really cannot present a terribly strong argument. However, especially for the newly elected council members, I think it should be noted the City has had more than a passing interest in acquiring the Von Gaevernitz property. We offered the land to the City before and after acquiring it. We have proceeded expeditiously and with direction from the City Attorney and Planning Office in planning the land while strictly complying with all ordinances. 'For the Council to now downzone the land, thus decreasing its economic value and use, while perhaps a legal action, one could hardly view it as equitable and fair in light of all that has preceded. In conclusion let me just say that after the Planning Office has presented you with a building inventory and all relevant data on densities, build-out and growth you will be confronted with the tough decision of what to do. However, please consider the Building Code and Subdivision regulations under which we now operate have yet to show you how effective they are. While they may now and then need a little grease and oil I think you should at least give them time to be broken in and tested before you go in lOr a major overhaul.
