Gillis made a motion to amend the original motion to read that the COTI@ission would review the project under Ordinance #19, seconded by Johnson. All in favor, moti n carried. Ms. Baer stated that this proposal was an addition of a garage and a studio, and would not increase the densi y. Gillis made a motion to approve the proposal, seconded y Johnson. All in favor, motion carried. Architect Larry Yaw was present and explained that this was a proposal to add a second floor above the Tom Mix Flying School for retail purposes. Stated that Tom Mix has agreed to buy two parking spaces and construct roof drainage according tO'specifications of the City Engine r- ing Department. Would be an additional 900 plus square feet. Yaw further pointed out that this addition would not in- terfere with the view. Ms. BAer submitted a diagram of the proposed addition, and stated that the Historic Preservation Committee had re- viewed the proposal and had approved it, Johnson made a motion to approve the addition, seconde by Gillis. All in favor, motion carried. Ms. Baer stated that the Historic Preservation Committ had approved the structure, but would like to review t color and the building material. Ms. Baer briefly explained the diagram of the Commissi and explained that the City Council must grant approva to the covered walk. Gillis made a motion to approve the proposal on the co - dition that the drainage be satisfactory for the cover roof, seconded by Jenkins. Motion included that the requirement for parking space purchase be determined. All in favor, motion carried. . Ms. Baer explained that this was a review of two units second phase of a new six unit condominium. Johnson made a motion to recommend for approval on con dition that the applicant dedicate a ski easement alon the southerly boundary of the property, seconded by Je - kins. All in favor, motion carried. Ms. Baer pointed out that this was a project on Ute Av. at the Aspen Alps Road, a request for new 14 unit con- dominium. Further pointed out that the zoning in this area was mixed residential. Ms. Baer further pointed out that the Ordinance #19 Re view Committee had recommended denial of the project f r the fOllowing reason - use appears to be incompatable with the land use plan and mass of the proposed struel; re too great. -4- ...; ---" "" .. All in favor, motion carried. Bruce Kistler, attorney representing the developer, was present and requested the COlnmission clarify the grounds for denial. Chairman Adams stated that the use doesn't conform with the Land Use Hap. Hs. Baer stated that the Planning Office felt it was a tourist use in a mixed residential area. Kistler asked the Commission if they would classify mixed- residential as a land use which would prohibit second ho es. Chairman Adams stated that they were applying the defin"tion of permanent resident housing. Hs. Baer expressed the Council's concern for permanent housing. Chairman Adams stated that the second home takes up spa e in an area which he doesn't want to see devoted to that use. Bartel stated that Ordinance #19 requires that disappro be in writing and sent by the Building Inspector. Johnson made a motion that the Commission recommend the Planning Office write a Resolution giving the reasons for denial of the project and that this Resolution be returned to the Commission for approval. Hotion second d by Jenkins. All in favor, motion carried. J Coachlight Chalet Hs. Baer stated that this was a request for one additio al unit on the second floor of an existing lodge. Pointed out that this is mixed residential. Chairman Adams stated that he objected to any lodge ex- pansion in that area. Felt it would be inconsistent to not allow Stein Gantzel to build on to his lodge and al low this expansion. Hr. Eyemere's brother was present and st:ated that this addition had been approved by the Board of Adjustment a d the Advisory Board aad recommended approval. Chairman Adams pointed out that this was fairly far-re- moved from the core area and would create a transporta- tion problem. Gillis stated that sidewalks need to be considered for that area. Gillis made a motion to deny the project. Hotion faile for lack of a second. Johnson made a motion to approve the project. Hotion failed for lack of a second. It was pointed out that Hr. Eymere had initiated this b'- fore Ordinance jf19, and that the Board of Adjustment ha referred this to City Council, and that it had had ap- proval. .1-, ...-". Chairman Adams stated that he would like to see the revie,v under Ordinance #19 go to the newly formed Advisory Board. Ms. Baer pointed out that the Planning Office had critical concern with the drainage. POinted out that the ditch presently feeds the Glory Hole Park. Ms. Baer further pointed out that the Planning Office was requesting a setback of 20 feet. Murphrey stated that they already were set back l8 feet, and there would be no problem with a setback of 2 additional feet. Attorney Bruce Kistler was present, representing Mr. Murphrey. Felt the rerouting could be approved by the City Engineer. Discussion followed on the preservation of trees on the project. Murphrey stated that constr~otion would cause minimal removal of trees, and stated that trees would be added to the site. Murphrey stated that on their final plan, would sub- mit a detailed landscape plan. Johnson made a motion to approve the preliminary pla for the Ute Avenue Condominiums with the following conditions: (1) dedicate 10' of south side of the property for future street widening; (2) agree to affiliate with future street and drainage improvemen districts; (3) require an agreeable ditch maintenanc and lease arrangement be made with City Engineer; (4) City Engineer approve the drainage plan. Motion was sec,onded by Geri Vagneur. All in favor, motion carried. ! Ms. Baer pointed out that this project was located on South MOnarch str:eet, just below the Mountain Que n Development. The storm leaders will be collected under floor in a common storm drain and run to an exterior dry-well. Dry-well shall be located between Building A and driveway and shall have an overflow to drainage ditch. Dry-well shall be constructed of perforated concrete rings with gravel bottom and backfill. Top to be cast-iron manhole ring and cover. Building A to have 6" drain and Building B to have 5" drain. Parking lot to be sloped from buildings to center then out toward Ute Ave. This storm drainage shall be picked up in a catch basin and dry-well with overflow similar to above. Above system to be designed for a 4-inch per hour rainfall. Re-routed Ditch The existing ditch is to be re-routed as shown on the Preliminary Plan. No permanent structures are to be built withint 5-feet of either side of the ditch. Property located adjacent to the Aspe Alps. Project consists of 14 units with lower unit of 900 to 1000 square feet and upper units of 1000 to 1800 square feet. Will be utilizing the exist in landscaping that now exists. Requesting at this time consideration of an exempti n of Ordinance 4tl9 relating to density in this area so that the project does not have to be scrapped at a later date. Total square footage of the project is 23,975 square feet. Structures will require no variances, utilities are available and ditch on the east side of the property can be easily relocated. Ms. Baer stated it is vital that this ditch be look d at by an expert and it ties in with drainage off th mountain and durant mine. Commission stated they could not give an answer at this time, as density consideration for this area has not been definitely ascertained at this time.
