(SERIES OF 2008) AN ORDINANCE OF THE CTTY COUNCIL OF THE CITY OF ASPEN, COLORADO, AMENDING THE CITY OF ASPEN HOME RULE CHARTER BY AMENDING SECTION 2.2 CHANGING THE DATE FOR GENERAL MUNICIPAL ELECTIONS FROM MAY TO NNE BIENNIALLY. WHEREAS, the City Council desires to amend Section 2.2 of the City of Aspen Home Rule Charter to change the date of the general municipal election from the first Tuesday after the first Monday of May to the first Tuesday after the first Monday in June 2009, and biennially thereafter; and WHEREAS, Section 13.10 of the Home Rule Charter authorizes the City Council to propose amendments to the City Charter in accordance with the State Constitution; and WHEREAS, the State Constitution requires Home Rule Charter amendments to be made by the adoption of an ordinance and thereafter approved by a majority of the voters voting thereon. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF ASPEN CITY COUNCIL AS FOLLOWS: Section 1• That Section 2.2 of the Home Rule Charter of the City of Aspen shall be and hereby is amended to read as follows: 2.2. Municipal elections. A general municipal election shall be held on the first Tuesday after the first Monday in June of 2009, and biennially thereafter. Any special election maybe called by resolution or ordinance of the council at least sixty (60) days in advance of such election. The resolution or ordinance calling a special municipal election shall set forth the purpose or purposes of such election. Polling places for all municipal elections shall be open from 7:00 a.m. to 7:00 p.m. on election day. Page 1 of 3 Section 2• This ordinance shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such prior ordinances. Section 3: If any section, subsection, sentence, clause, phrase, or portion of this ordinance is for any reason held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and shall not affect the validity of the remaining portions thereof. Section 4• That this ordinance shall become effective only upon approval of the electorate of the City of Aspen at the special municipal election to be held on November 4, 2008, pursuant to Section 13.10 of the Home Rule Charter of the City of Aspen. A public hearing on this ordinance shall be held on the day of , 2008, at a meeting of the Aspen City Council commencing at 5:00 p.m. in the City Counci] Chambers, Aspen City Hall, Aspen, Colorado INTRODUCED, READ AND ORDERED PUBLISHED as provided by law, by the City Council of the City of Aspen on the day of , 2008.
