HomeMy WebLinkAboutcclc.min.032101 COMMERCIAL CORE & LODGING COMMISSION MINUTES OF MARCH 21, 2001 Chairman Jori Busch called the meeting to order at 8:30 a.m. Members in attendance were Bill Dinsmoor and Eric Cohen. Terry Butler and John Starr were excused. Jon relayed that the mid-priced lodges are not full. The high ends are and possibly the ACRA should be using some of the tourist tax for marketing the mid-priced lodges. Heather Isberian relayed that the ACRA was to send out information regarding this meeting and it Was never followed through. Retail should be involved in the enforcement discussions. James Lindt, Temporary Community Development enforcement office for the city stated that the he takes informal complaints and anonymous complaints. A site visit is done once a month unless the violation is a life and safety issue. Non-anonymous complaints are responded within two days. Complaints need addresses and specific places. There is one zoning officer and that person reviews plans also. Engineering, Zoning, Parks/Environmental Health, Parking, Police have enforcement policies. Jon said across from Carl's pharmacy there is a neon sign that says Verison which is in violation. James will follow up. The building side of the zoning officer has increased incredibly throughout the years, If the CCLC feels there is a lack of enforcement possibly the city should have another office and the position split. James said they have 30 days to comply and then it goes to the city attorney and they decide whether to site them into court. Stefan Isberian said there is a flaw in the process and 30 days is too long. Jon said owners say they hire students etc. to place hand bills around town and that is not allowed. James said the city could do some newspaper adds. Stefan said twice a week a site visit should be done. Bill said it is clearly not a priority to do site visits for violations in town as the community development budget does not allow that amount of time to be spent outside the office. Bill also relayed that the philosophy of government is not reactive until enough calls are made and they know exactly where to go. Council also believes in that philosophy. Bill also said the businesses that are over the edge are a problem and they know they can get away with it. Jon said the need for government services has grown. Bill inquired of James if existing enforcement individuals could be allowed to have more direct enforcement and have reporting ability across the board with different departments. James suggested that the board discuss this idea with Engineering and the Parking Dept. Staff relayed as a city team this could work. Jon said it is not a great time consuming job to look at different violations throughout town. Once the system is established and it is timely the violations will be less and less. Heather said get rid of the grandfather phrase. So much of this has been here for years illegally and this is not right. 2 COMMERCIAL CORE & LODGING COMMISSION MINUTES OF MARCH 21, 2001 Bill said illegal encroachments are numerous. The Engineering Dept. makes decisions as to what they are going to enforce or not enforce. More fact finding is needed. Jon said at one time the CCLC was a review board. When stream lining came in the CCLC was dropped out of the loop. A good example is the Katie Reid building with the street lights in the wrong place. Streetscape guidelines were part of what the CCLC approved. He feels the streetscape review should be brought back into the CCLC review. James said that concept might give Corn Development a better heavier hand regarding enforcement. Bill said a lot of the business community thinks there is preferential treatment in town depending on who you are. Stefan Isberian stated that the ordinances are on the books but it is discouraging and confusing for the people who do have a complaint and is the enforcement going to occur or not. Stefan said the Inn ,at Aspen had a sale which is in the county and it took three calls and everyone including the Police Dept. said it was not in their jurisdiction that it was CDOT's. CDOT said they were too far away. Heather said no one in the county enforces anything. They do not even know who the enforcement officers are. Bill suggested that Tim Ware's employees could be ambassadors of the city including the enforcement individuals. Jon suggested that staff contact the City Manager and let that the parking control people be charge if they are out on the street observing a violation of a code or encroachment. They could cover two departments clearly. They should be empowered to ticket. 3 COMMERCIAL CORE & LODGING COMMISSION MINUTES OF MARCH 21, 2001 Jon said CCLC feels the 30 day letter of notification is not needed. Bill said our present enforcement happens in a delayed fashion. There are immediate resolutions. Heather said she hates calling on enforcement's but she is not going to do it any longer as she has better things to do and the city doesn't care. Bill said he doesn't want James spending his valuable time out on the street but possibly other departments can help that are out on the street. Heather said the music in town is conflicting. She said she has complained about jewelry sales and reports complaints when the city does not look good. She is concerned about the town. Staff relayed that the next meeting is April 4, 2001. Staff will invite Bentley's, Little Bear Antiques, Zona and the Engineering and Parking Departments. MOTION: Bill moved to adjourn; second by Jon. All in favor, motion carried. 4
