The approval for the installation of the tent at the end of December is not a guarantee of approvals in the future, The Community Development Department will observe the tent and take any impacts created by it into account in the review of future applications, 26.96.020 Authorization for temporary uses. No temporary use shall be permitted except upon review and approval by either the planning director or by city council in accordance with the procedures, standards and limitations set forth in this chapter. An insubstantial temporary use may be authorized by the planning director, An insubstantial temporary use shall be defIned as a temporary use that meets the criteria set forth below in Section 26.96,030, is limited to a period oftime not to exceed seven (7) days, the impact upon the immediate vicinity is determined to be minimal, and in the opinion of the planning director does not require the review and approval of the city council. 26.96.030 Criteria applicable to all temporary uses. When considering a development application for a temporary use, city council shall consider, among other pertinent factors, the following criteria as they, or any of them, relate thereto, A. The location, size, design, operating characteristics, and visual impacts of the proposed use. Response: The proposal is to install a 15' x 30' tent in front of the gallery. The tent will have sidewalls which will screen the activities inside, The tent corresponds to the size of the gallery's storefront and projects into an open courtyard on the site. ~ ,-, B. The compatibility of the proposed temporary use with the character, density and use of structures and uses in the immediate vicinity. Response: The proposal will not impact the use of other structures in the vicinity, C. The impacts of the proposed temporary use on pedestrian and vehicular traffic and traffIc patterns, municipal services, noise levels, and neighborhood character, Response: The proposal will not affect pedestrian or vehicular traffic. The Fire Marshall has discussed requirements for fIre safety with the applicant. Extinguishers and signage will be installed as represented on the attached application, D, The duration of the proposed temporary use and whether a temporary use has previously been approved for the structure, parcel, property or location as proposed in the application. Response: Staff is not aware of any previous temporary uses on this property, The tent will be installed on December 24, 1997 and removed by the end of the day on December 28,1997, E. proposed. The purposes and intent of the zone district in which the temporary use is Response: The proposal is not in conflict with the intent of the zone district. F, The relation of the temporary use to conditions and character changes which may have occurred in the area and zone district in which the use is proposed, Response: The temporary use is not related to changes in the surrounding area or zone district. It is intended to provide some extra space for a special reception and shelter from the weather. G. How the proposed temporary use will enhance or diminish the general public health, safety or welfare, (Ord, No, 5-1992, S 1: Code 1971, S 7-1203) Response: The proposal will not affect the public health, safety, or welfare, RECOMMENDATION: Staff recommends that the temporary use be granted from December 24, 1997 to December 28, 1997 for a tent as represented in the attached application. Hyman on December 26, 1997 for the purpose of invitation only artist reception. Disclosure of ownership provided by Pitkin County Title is attached. also vicinity map. No site improvement survey as it is not applicable. Find plan of site including placement of tent, entrance and fire marshal requirements. Be advised that Ed VanWolraven (sp? fire marshal) returned my call December 3, 1997 requesting his requirements for this event. He asked that we have a clear exit corridor, two fire extinguishers, emergency lighting and lighted EXIT sign. We will have all of these items and all except emergency lighting are marked. Emergency lighting will be provided but as of this time the location is not determined. Please note there will be no visual impact, light, sound or flow impact on any adjacent area. Tent structure will be erected the morning of December 24, 1997. Sides and structural elements installed morning of December 26, 1997. Tent to be dismantled no later than December 28, 1997, intended dismantle on morning of December 27, 1997. All tent items delivered via alley behind building. There will be no impact on pedestrian or vehicular traffic. We request that permission for this structure be granted for 7 one day uses per year rather than seven days for this one event. Summer use will not include sides, only canopy. All dates will be for one day only, with tent erection on day prior and tent dismantle on day after (for all dates not falling on holidays as December 26th does.) APPLICANT understands and agrees that City of Aspen Ordinance No. 43 (Series of I 996) establishes a fee structure for land use applications and the payment of all processing fees is a condition precedent to a determination of application completeness. 3. APPLICANT and CITY agree that because of the size, nature or scope of the proposed project, it is not possible at this time to ascertain the full extent of the costs involved in processing the application. APPLICANT and CITY further agree that it is in the interest of the parties to allow APPLICANT to make payment of an initial deposit and to thereafter permit additional costs to be billed to APPLICANT on a monthly basis, APPLICANT agrees he will be benefIted by retaining greater cash liquidity and will make additional payments upon notifIcation by the CITY when they are necessary as costs are incurred. CITY agrees it will be benefIted through the greater certainty of recovering its full costs to process APPLICANT'S application, 4, CITY and APPLICANT further agree that it is impracticable for CITY staff to complete processing or present sufficient information to the Planning Commission and/or City Council to enable the Planning Commission and/or City Council to make legally required fIndings for project approval, unless current billings are paid in full prior to decision, 5. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to collect full fees prior to a determination of application completeness, APPLICANT shall pay an initial deposit in the amountof$ 4 ~o which is for "3 hours of Planning staff time, and if actual recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings to CITY to reimburse the CITY for the processing of the application mentioned above, including post approval review. Such periodic payments shall be made within 30 days of the billing date. APPLICANT further agrees that failure to pay such accrued costs shall be grounds for suspension of processing.
