The Linza's appealed the City's policy to the Planning Director, contending that the temporary, 3 week, sale of live trees on their property was not inconsistent with the underlying zoning, Commercial Core, nor was it inconsistent with their historical use of the property which is the sale of Christmas trees during the holiday season. The Planning Director finds that the temporary sale of live trees in the Commerical Core in a location that has a pre-existing vending use during the holiday season is not incompatible with the city's general vending policy. The Linza's are allowed to sell live trees for a three week period during the summer months on their property, 406 East Hopkins. No sales of other items may be allowed. ,~\ ..--', MAY 20, 1994 Dominic Linza and Shae Singer Box 180 Aspen, CO 81612 Dear Dominic and Shae: Enclosed please find a check for Seven Hundred and Sixty Three dollars ($763.00) for a partial refund of a One Step Application for A30-94, F&M Tree Farm. APPLICANT understands and agrees that City of Aspen Ordinance No, 77 (Series of 1992) establishes a fee structure for Planning Office applications and the payment of all processing fees is a condition precedent to a determination of application completeness. 3, APPLICANT and CITY agree that because of the size, nature or scope of the proposed project, it is not possible at this time to ascertain the full extent of the costs involved in processing the application. They have inherited the Isis Theater property, Lots L, M and N, Block 87, City of Aspen, and at the current time it is in the Estate of Marjorie Jenkinson. It is anticipated that the property will be conveyed to Mr. and Mrs. Linza sometime within the next sixty to ninety days. The estate is taking the official view that the Linzas can treat the property as belonging to themselves at this point, so I believe they should be authorized to obtain whatever permits are required for the business activity they intend to engage in on the property.
