Concession stand at the M.A.A. Music Tent - Second Reading of Ordinance 36, Series 1992 RE: SUMMARY: The Planning Office recommends approval of this request to allow the sale of pre-packaged frozen concessions at the Music Tent during the MAA's 1992 summer Music Festival. PREVIOUS COUNCIL ACTION: First reading was held on May 11, 1992. BACKGROUND: The Applicant, TCBY / Ellen Randall, has made arrangements with the MAA to sell pre-packaged frozen confections during the Friday, Saturday, and Sunday concerts throughout the upcoming music season beginriing June 12 through August 23, 1992. The products will be sold from a booth located south of the Music Tent, away from the existing booths selling lemonade and souvenirs. Please see Exhibit "A" ror sketches of the proposed booth, its location, and letter from the Applicant. The Applicant and the MAA will split the profits from this venture, CURRENT ISSUES: The MAA parcel is zoned A - Academic. Retail sales are not listed as permitted uses within this zone district. The two existing booths operated by the MAA were approved during the Aspen Meadows Final SPA Plan reviews in June 1991. The TCBY proposal could be processed by either amending the SPA Plan or seeking a Temporary Use Permit. As TCBY intends to operate only for this season the Temporary Use Permit process was chosen. Ordinance 5, Series 1992 establishes the purpose and review criteria for Temporary Uses. Temporary Use approvals can be considered when "certain land uses not otherwise permitted within a particular zone district might be appropriately permitted if done solely on a temporary basis under certain specified conditions". In their review, the Council shall consider the nature of the operation, duration, impact, and compatibility of the surrounding uses and structures. The MAA will require the Applicant to maintain the area in a manner suitable toMAA standards. The Planning Office believes that the small temporary structure and 1 .r'\ ,~ limited duration of the operation will not negatively affect the surrounding neighborhood. Please refer to Exhibit "B" for review criteria and staff analysis. FXNANCXAL XMPLXCATXONS: Sales taxes will be collected on proceeds. The Applicant must obtain a business license to operate within the City limits, obtain a Sales Tax License, and collect the sales taxes, RECOMMENDATXON: The Planning Office recommends approval of the Temporary Use Permit to allow TCBY to sell pre-packaged frozen confections at the Music Tent during the 1992 summer Music Festival. The recommended conditions are: 1. The Temporary Use Permit shall be effective for sales during the Friday, Saturday and Sunday concerts from June 12, 1992 through August 23, 1992. 2. All applicable business and sales tax licenses shall be obtained prior to commencement of the temporary use. 3. All representations that are made within the submitted application and at the public hearing are incorporated herein and shall be adhered to. 4. Failure to comply with the above conditions of approval or representations made within the application and at the public hearing shall be cause for the suspension of the temporary use permit. ALTERNATXVES: If the MAA intends to have other vendors occupy this or another locations in the future, the Final SPA Plan should be formally amended so that further individual Temporary Use Permits will not be necessary. Council could require an SPA Amendment to be processed to address the TCBY request. The Temporary Use Permit is requested for June 12 - August 23, 1992. Profits from the frozen yogurt sales will be split with the Music Association. The design of the temPorary concession' reflects the desire of the Music Association to be. consistent with the surrounding neighborhood, both in style and materials, The "cart", which is actually stationary, will be built by Rick Lawrence of carbondale, 963-3366. The "cart" would be located at the edge of a grove of trees on the east side of the Music Tent, This site was chosen to alleviate the extremely crowded situation around the existing concession stand. No electricity or plumbing is required. The "cart" would be removed at the end of the festival. The frozen yogurt would be sold by two very reliable college men, David Middleton and Rives Nolen,and any additional people who may be needed. The pre-made frozen products will be brought in fresh from my "TCBY" store in Glenwood Springs. All garbage will be removed daily by Rives and David. They can be contacted after June 4 at 925-2548. Enclosed is a letter from Tom Eirman, General Manager of the Music Association. In his letter Tom states that the Association authorizes me to apply for a Temporary Use Permit on the Music Festival ground. The location, size, design, operating characteristics, and visual impacts of the proposed use. Response: The proposed sales of pre-packaged frozen confections will take place from a 6'x8' booth located south and east of the existing concession booths at the Music Tent. The booth is designed to look like a cart, and will be delivered to the site like a small portable building. No ne~ative visual impacts will result from the use, B. The c.ompatibility of the proposed temporary use with the character, density, and use of the str.uctures and uses in the immediate vicinity. Response: The design reflects the MAA's desire to maintain character, density, and use of the structures and uses in the tent area. C. The impacts of the proposed temporary use on pedestrian and vehicular traffic and traffic patterns, municipal services, noise levels, and neighborhood character.
