MEMORANDUM TO; FROM: RE: DATE: Aspen Plannin9 and Zoning Commission Colette Penne, Planning Office Aspen Recording Studios - Use Determination February 8, 1983 The Aspen International Association is asking for a use determination to determine the appropriateness of the following uses in the SCI zone - an audio production facility, a film and video production facility, support areas for both facilities and teleconferencing. (Teleconferencing involves person-to-person satellite communication.) The intention of the Service/Commercial/Industrial zone, as stated in the Municipal Code, is "to allow for the use of land and the preservation of limited commercial purposes and limited industrial purposes, with customary accessory and institutional uses, which do not require or generate high customer traffic volumes." There is no permitted or conditional use listed in the use tables which is directly analgous to this requested use. The permitted use section outlines that uses similar to those listed can be permitted. The closest use listed that compares to this application is a printing and publish- ing plant. In a sense, this facility is also a producer and dispenser of information, only throu9h a different medium and with the use of highly advanced technology. The permitted use listings include the provision that "no permitted uses create an unusual traffic hazard, noise, dust, fumes, odors, smoke, vapor, vibration, glare or industrial waste disposal problem; and provided that no permitted uses sell daily or frequently bought items to the general public." The facility proposed appears to fit the intention of this zone. It is a limited commercial operation with some aspects of it fitting into the "service" category, particularly the teleconferencin9 facility. It will not be a high volume traffic generator, nor will it create any of the problems outlined above and will not be selling frequently bought items to the general public. In light of the emergence of plans for a new Performing Arts Center for Aspen, a facility with the outlined capabilities of this production studio should be a valuable asset. It will require a considerable amount of space, which is more likely to be accessible and cost effective in the SCI zone. The Planning Office recommends approval of this request for an audio, video and film produci ng facility wi th associ ated support areas and a teleconferencing facil i ty. Teleconferencing involves person-to-person satellite communication. My client, the Aspen International Association, would like to pursue this studio concept in the SCI zone. I believe the use clearly conforms to the SCI intention, "to allow for the use of land and the preservation of limited commercial purposes and limited industrial purposes with customary accessory and institutional uses which do not require or generate high consumer traffic volumes". I believe the above enumerated uses fall within the intent of the SCI zone and a use determination would serve to confirm the Planning Office's feeling that they are permitted in the SCI zone. A production and post-production facility utilizing the latest advances in technology for communications, video, audio and film industries would be a beneficial addition to Aspen and a appropriate use within the SCI zone.
