PRELIMINARY REPORT
ON
SMUGGLER TRAILER PARK
I. HISTORY OF SMUGGLER MOBILE HOME PARK TO ASPEN
MOUNTAIN PlL~KASSOCIATES.
Smuggler Trailer Park was established in the mid 1960's
by George Strong and Jesse Maddalone. From its inception
the rationale behind the Park was that it would provide
much needed low and moderate income housing. The Park
was opposed by its neighbors and was the subject of
at least one lawsuit, which resulted in a Consent Decree
approved by the District Court of Pitkin County on April 19,
1965. This decree required that the owners of the park meet
at least the following standards within the Park:
"A. The proposed Trailer Court must comply with all
zoning regulations governing mobile homes contained
in Pitkin County Zoning ~esolutions and Regulations
issued pursuant thereto with the minimum lot size for
trailers within the subject area being 40 by 70 feet.
B. ,The Defendants, Maddalone and Strong, will install
a recreation area in the north-westerly quadrant of the
subject area, Which will ,contain a picnic area and ball
fields with the necessary improvements and appurtenances
as originally promised to be installed at the Board of
Adjustment hearings preceding the granting of the vari-
ance to the Defendants, Maddalone and Strong.
C. The boundary of the subject area, with the exceptions

hereafter noted, shall be bordered with a planting strip
containing two (2) rows of evergreen trees, spacing of which
is ~not more than fifteen (15) feet apart measured from the
trunks. The trees will be planted in a staggered fashion
and will be not less than four (4) feet in height at the
time of planting."
ALTHOUGH the Court records indicate that Mr. Maddalone's
bond for the performance of these obligations was returned
to him in October of 1965, the records of the Board of the
County Commissioners, Planning and Zoning Commission and
the Board of Adjustment reveal that throughout the late
1960's and the earlv to mid 1970's, the Park was the subject
of numerous complaints and that the owners' compliance
with the Consent Decree was also a matter of grave concern.
The records of Pitkin County indicate that the problems with
the Park were never finally rectified or addressed.
The evidence indicates that this situation within the
Park was an unpleasant one as well, as there is a letter
to the Commissioners from at least one of the residents
wherein she voiced her complaints about snow removal, the
conditions of the roads, safety and junk cars.
II. HISTORY OF SMUGGLER MOBILE HOME PARK SINCE SALE. TO
TOM POLLOCK AND ASSOCIATES
On January 4, 1979, Smuggler Trailer Park was purchased
by Aspen Mountain Park Associates, a partnership. Mr.
Thomas Pollock has been the manager of the Park since that
time. The name of the Park was changed to Aspen Mountain
Park and the rents were raised from Ninety Five Dollars
($95.00) a month to Two Hundred Fifty Dollars ($250~00)
a month plus Twenty Dollars ($20.00) for each dog. Mr.

Pollock and his attorneys also prepared some Eighteen (18)
pages of rules and regulations for the operation of the
Park. In spite of a highly unsuccessful meeting with Mr.
Pollock and lengthy negotiations between the attorneys, the
final draft of these Rules and Regulations still have not
been completed and distributed to the residents. The
Homeowners' Associations was given an option to purchase
the six (6) acres on which the mobile homes are presently
located for a price of Two Million Eight Hundred Thousand
Dollars ($2,800,000.00). A condition of this sale was that
Mr. Pollock and his partners be able to develop the vacant
three (3) acres of the Park. The City and County Planning
staff was opposed to the development of the acreage. A
great deal of time and effort exploring the financing
possibilities for the purchase of the six (6) acres with
both private and public lenders, as well as the feasibility
of the development of the other three (3) acres. The
response to those proposals were essentially negative due
to the amount of the purchase price and to the already
crowded conditions in that area, respectively, When
it was determined that the back three acres could not be
seperated and developed, the price for the entire Park was
raised to Four Million Dollars ($4,000,000.00), an equally
unlikely possiblility given the economic status of the
residents of the Park.
Mr. Pollock seems to be trying to make some improvements
but his tactics are making enemies of the residents. Mean-
while, the prices of the mobile homes themselves have gone
down and nothing is selling. The people in the Park have a
sense of insecurity about the future. At present, there is
a grave mistrust toward the owne~and a tremendous concern
about future rent increases.

III. PROFILE OF OCCUPANTS OF' SMUGGLER MOBILE HOME PARK
AND RECOMMENDATIONS
The survey was conducted between Thursday, August 2,
and Saturday, August 4, 1979. Sixty Nine (69) out
of Eighty' Eight (88) units responded. Enclosed herewith
is a copy of the survey and a tally of the results.
There is an even distribution as far as how long the
residents have been in town, but the majority of the
people have moved in to the Park fairly recently., These
are the people who have been working in town for years
and were forced into lower priced housing. By the time
they were ready to buy housing, Smuggler was the only
thing in reach. Most of these people paid a "Blue Sky"
value for their units, in excess of Ten Thousand Dollars
($10,000.00) above fair market value per unit. This
factor alone is of major concern to owners of Smuggler
units.
The types of jObs Smuggler residents hold represent a
broad cross section of our community. They are as
follows:

Please note the matching statistics concerning whether
these respondents would have to leave Aspen and whether
or not they would be interested in purchasing their lots.
Next, please note the salary ranges. The numbers do not
quite agree with the number of units because some reported
income individually while others reported household income.
In either instance, however, it is apparent that salaries
are not commensurate with the costs of housing in the Aspen
area. Lo~ing these working people would be a clear loss
to ou~ community, one which we cannot afford.
In the section concerning what action should be taken,

a large majority checked 'yes for numbers 1,2, and 3;
all of these alternatives involve some controls on the
Park. One respondent who was renting and had been in
town for two months checked yes for number 4. There were
many extra comments enthusiastically encouraging alternative
number 3, that the City acquire the Park and somehow sell
it back to the tenants. The people in the Park are willing
to go along with almost anything that will stop the rising
cost of living here, or at least hold it in line. They are
willing, but not anxious to accept price controls upon the
individual units if the City will step in and take some
Positive action.
The Board of Directors of the Homeowners' Association
reCOmmends that the City take the Park through condemn-
ation and either manage it or sell it back to the Home-
owners' Association with the hope of condominiumizing
or cO-oping the spaces. Should the City not wish to condemn
the property, the Board would also be in Lavor of some sort
of trade-off with the present owners; perhaps allowing
more mobile homes to be added to the back three (3) acres in
exchange for rent controls.
In summary, most people in Aspen Mountain Park own their
own homes. They work in and love Aspen. If they are forced
to leave, it is estimated that most will take at least
a Ten Thousand Dollar ($10,000.00) loss on the purchase
price of their units. In this day of Lone Pine and the
Water Plant Projects, losing Smuggler would be a huge step
backwards, as the Park provides approximately Two Hundred
Twenty Five (225) bedrooms to the community. It is rumored
(and probably true) that Mr. Pollock will raise rents
again this January. Many would be forced to leave the
Park and perhaps Aspen if that happened. The main concern

of the residents is that they be able to keep their
homes and to remain in Aspen. They are weary of not knowing
if they have a place to live or not from one day to the next.
The assistance of the City Council is essential to the pre-
servation of Aspen Mountain Park as a residential area for
the working class people of our community.

WE ,FEEL THAT MUCH WAS ACCOMPLISHED AT OUR GENERAL MEETING OF
JULY 15TH. NOW WE HAVE A GREAT DEAL OF WORK TO DO AND vIE- ARE
RUNNING OUT OF TIME.
THS POSSIBILITY EXISTS THAT SMUGGLER WILL NOT GET THE ZONING
VARIANCE NEEDED FROM THE CITY TO CONTINUE TO OPSRATE AS A MOBILE
HOME PARK. WITHOUT THIS ZONING WE WILL BE PHASED OUT,. BROOKE
PETERSON, OUR ATTORNEY, HAS PUT US ON THE AGENDA TOMEST WITH
THE CITY COUNCIL ON MONDAY, AUGUST 13TH (MEETING STARTS AT 5: 00 P.M.).
IT IS IMPERATIVE THAT EVERYONE ATTEND. TALK TO YOUR NEIGHBORS
AND FRIENDS INSIDE AND OUTSIDE THE PARK. . WE NEED A SHOW OF FORCE,
WE MUST SHOW UP IN MASS IF WE liRE GOING TO SAVE OUR PARK. WE HAVE
