This request addresses the relocation of activity envelope from one portion of the property to an area adjacent to the building envelope, allowing for requisite grading and site treatment within the City of Aspen and Aspen Highlands Design review guidelines and requirements. All areas net out to no increase. This request is also for the swap and relocation of a small portion of building envelope to accommodate the overhangs of the proposed structure only. Note: The entire footprint is within the existing building envelope. Also, this amendment amends an exiting but non-defined access easement on the Final Plat. This purported easement, upon information and belief, was for the benefit of the Aspen Fire Protection District. To accommodate the slight adjustment in Building Envelope, a very slight reduction of the purported Access easement was required. This re-defined easement has been memorialized in a Deed of Easement, executed by both the Aspen Fire Protection District and by Harry Sloan, the owner of Lot 5, the parcel subject to this Minor Plat Amendment. Under Aspen City Land Use Code Section 26.445.100 (A) PUD Insubstantial Amendments: An insubstantial amendment to an approved development order for a final development plan may be authorized by the Community Development Director (as long as minimum criteria are met). This minor amendment application is in accord with the submittal standards for a minor amendment as it does not change any of the following criteria: 1. A change in the use or character of the development. There is no change in the use or character of the development. 2. An increase by greater than three (3) percent in the overall coverage of structures on the land. There is no increase at all in the overall coverage of the structure as proposed. This application is to accommodate the overhangs only, that they will fall within the Building Envelope as required by the City of Aspen and Aspen Highlands PUD. 3. Any amendment that substantially increases trip generation rates to the proposed development, or the demand for public facilities. There will be no additional trips generated or demand for public services as a result of this application. 4. A reduction by greater than three (3) percent of the approved open space. There will be no reduction in the area of approved open space. The activity and building envelopes in this application net out. 5. A reduction by greater than on (1) percent of the off-street parking and loading space. There will be no reduction of off-street pazlcing as a result of this application f"T 4.V 6. A reduction in the required pavement widths or rights-of--way for streets and easements. There is no reduction in the required pavement widths or rights-of-way for streets and easements. Additionally, the fire depaztment has reviewed and approved this insubstantial plat amendment for their access requirements. 7. An increase of greater than two (2) percent in the approved gross leasable floor area of commercial buildings. N/A. This application pertains to residential property within the PUD. 8. An increase by greater than one (1) percent in the approved residential density of the development. The residential density will not be affected by this application. 9. Any change which is inconsistent with a condition or representation of the project's original approval or which requires granting a variation from the projects approved use or dimensional requirements. The project's approved use or dimensional requirements are not changed by this application. Additionally, the Aspen Highlands Design Review Boazd (DRB) has reviewed and approved this application. Amend the proposed building envelope so that there is not an increase in the size of the building envelope over what currently exists. The plat currently shows that there would be a slight increase in the size of the building envelope over what currently exists. The City's administrative building envelope adjustment policy does not allow for an amendment to be approved at a staff level that increases the size of a building envelope or an activity envelope on a parcel. ,/ 2.
