Hopkins Ave., Aspen, CO 81611 LOCATION: ] 130 Black Birch Drive ZONING: Medium Density Residential, R-15 REVIEW PROCEDURE: A stream margin exemption maybe approved, approved with conditions, or denied by the Community Development Director, pursuant to Section 26.435.040(B), Stream Margin Exemptions. BACKGROUND: The applicant is requesting to repair an existing bank stabilization wall along the Roaring Fork River, just below its confluence with Castle Creek. The rock wall has fallen into partial disrepair and needs to be rehabilitated in order for the wall to function properly. The proposal includes removing the existing wall, saving the rock materials on site for reuse, laying a fabric liner against the soil bank, then replacing the rocks and using large "toe stones" set at the base of the wall for greater stabilization and to anchor the fabric. No additional "rip rap" material will be used other than the toe stones in rehabilitating the wall. (This is important because as it exists, the visual appeazance of the wall is very much in keeping with the woodland/stream margin setting. This would be significantly altered if large angular rip rap stones were introduced into the wall. The applicants have made application for a Nationwide Permit #3 to the U.S. Army Corps of Engineers. The work is to be done is detailed in the application attached as Exhibit "A". STAFF COMMENTS: This application for stream margin exemption entails a necessary repair of an existing bank stabilization wall, which is listed as a stream margin exemption pursuant to Land Use Code Section 26.435.040(B), Stream Margin Exemptions. Additionally, the ,.~. ,.,, .. .,., application has been reviewed by the Community Development Engineer and Parks Department regarding the proposed wall repairs and impacts to vegetation along the stream. The Community Development Engineer has indicated that he is satisfied that no alteration of Maroon Creek's watercourse will result from the repairs. Staff has also consulted with representatives from the City of Aspen Parks Department regarding the proposed repairs. The Parks Department has expressed that they believe the improvements are necessary in order to stabilize the bank and minimize erosion which causes particulate matter to enter the stream. Impact to the existing trees and grasses in the area of the repair work must be minimized to prevent siltation during the work which can be handled through the implementation of good construction practices. Staff finds that the proposed request meets the stream margin exemption review standards with the conditions discussed below. RECOMMENDATION: Staff believes that the proposed application meets the review standards for approving an administrative stream margin review exemption pursuant to Land Use Code Section 26.435.040(B), Stream Margin Exemptions. Therefore, Staff recommends that the Community Development Director approve the proposed stream margin exemption request to repair the existing stream bank stabilization wall. APPROVAL: I hereby approve this administrative stream margin exemption to allow for the stream bank stabilization wall located along the frontage of the Marcotte property at 1 ] 30 Black Birch Drive to be repaired as contained within the application filed with the Community Development Department, with the following conditions: 1. Before construction commences, the Applicant shall arrange for and conduct a site visit with the City of Aspen Parks Department and obtain verbal approval from department regarding how to protect the trees and minimize erosion along the stream bank caused by the repair work. 2. Work shall be completed during the low water stages of the river starting Nov. 1, 2006 and February 28, 2007. 3. Any existing natural vegetation negatively impacted by the proposed construction shall be replaced to the satisfaction of the City of Aspen Parks Department. APPLICANT understands and agrees that City of Aspen Ordinance No. 57 (Series of 2000) establishes a fee structure for Land Use applications and the payment of all processing fees is a condition precedent to a determination of application completeness. 3. APPLICANT and CITY agree that because of the size, nature or scope of the proposed project, it is not possible at this time to ascertain the full extent of the costs involved in processing the application. APPLICANT and CITY further agree that it is in the interest of the parties that APPLICANT make payment of an initial deposit and to thereafter permit additional costs to be billed to APPLICANT on a monthly basis. APPLICANT agrees additional costs may accrue following their hearings and/or approvals. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to collect full fees pri o a determination of application completeness, APPLICANT shall pay an initial deposit in the amount of $_ which is for 3 hours of Community Development staff time, and if actual recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings to CITY to reimburse the CITY for the processing of the application mentioned above, including post approval review at a rate of $220.00 per planner hour over the initial deposit. The property address is 1130 Black Birch Drive. A Site Location Map has been included as and appendix to this Pre-Construction Notice. Prot Site The property has historically been used for residential purposes and all adjacent properties aze residential. The property lies on the left bank of the Roazing Fork River and Castle Creek just below the confluence of these two water ways. Access to the project site will be from Red Butte Drive to Black Birch Road. Pre-construction photographs have been taken of the project azea, the rip rap wall to be removed and re-installed and existing vegetation. There is no wetland vegetation that will be impacted by the proposed work and wetland impacts aze limited to work completed below the ordinary high water mazk of the Roazing Fork River, which has been determined by Beach Environmental to be a waters of the United States. Project Description for NWP #3 The proposed activity and work to be completed includes removal of existing river rock rip rap wall, placement of a landscape fabric to retain soils, gravels and fines at the existing stream bank, and replacement of rip rap in the same location as the existing wall. All work is projected to be completed by November 1, 2006. The existing rip rap wall has been in place for more than 20 yeazs and has provided stability and erosion protection to the Mascotte property. Rehabilitation of the wall will allow continued stability and protection of the stream bank, reduction of erosion and stable water quality. The rehabilitated wall (see attached sketches of proposed work) will be slightly sloped from the anchor stone to the top of the existing wall. This will reduce the "slip" potential of the wall and allow for a more stable anchoring to occur. The rehabilitated rip rap wall will be substantially similaz to the existing wall in length, height and width and the purpose of the stabilization wall will not change. The only changes proposed include more angular shaped "toe stones" and the installation of a fabric liner behind the rip rap wall. The present wall is dry stacked and the reset wall will also be dry stacked. All removed rip rap will be temporarily stockpiled on land owned by the Applicant and reused to install the rehabilitated wall. No wetland vegetation is proposed to be removed as a part of this project and impacts to the stream will be limited to a wall length of one-hundred and forty feet. Armv Corns of Eneineers Permittin The proposed project qualifies for a Nationwide Permit #3 Maintenance. The following aze terms and conditions set by the Corps under this permitting process. Under each condition there is a written response verifying that our project falls under these conditions. (i) The structure to be repaired, rehabilitated or replaced must be a previously authorized structure that is currently serviceable and must not be put to a use differing from the original. The structure is an existing river rock rip rap wall that has been in place for more than twenty years. This wall has been in use each and every year since the date of its construction and has had a stabilizing effect on the stream bank and water quality in this reach of Castle Creek and the Roaring Fork River. The structure has recently slipped in several places and requires maintenance to protect its ability to stabilize the stream bank, prevent unnecessary erosion and to maintain the water quality and aquatic values the wall has protected for twenty years. The structure's use will not change, no substantial modifications to the structure are proposed, and no deviations from its original use are proposed or intended. We understand that minor deviations in configuration due to materials, construction techniques, current codes or safety requirements are permitted. (ii) Discharges of dredged or fill material, including excavation into all waters of the United States to remove accumulated sediments and debris in the vicinity of, and within, existing structures and the placement of new or additional rip rap to protect the structure, provided the Permitted notifies the District Engineer in accordance with General Condition 13. The stabilization wall will be accessed from an upland area adjacent to the Roaring Fork River. This project does not propose to remove accumulated silt and debris. The rip rap removed will be replaced and it is proposed that the project will result in a balance between materials removed and materials replaced below the ordinary high water mark of the river. Only the anchor stones will be placed below the ordinary high water mark of the river, all other rip rap will be placed at or above the ordinary high water mark. The only other protection required to be installed is the fabric liner, which will be placed to keep existing silts, sands and gravels in place behind the rehabilitated rip rap wall. This application is intended to serve as Notice to the District Engineer. (iii) Discharges of dredged or fill material, including excavation, into all water of the Untied States for activities associated with the restoration of upland azeas damage by a storm, flood, or c o other discrete event including the construction, placement, or installation of upland protection structures and minor dredging to remove obstructions in water of the United States. As described in paragraph (ii) above, only the anchor stones will be placed within a jurisdictional waters of the U. S. to replace stones that now exist but which a portion have been moved by hydraulic forces. New angular stones will be set in the streambed at the toe of the slope of the wall to better anchor the wall. It is proposed that all work will be done in October 2006 when water levels in the river are low and most work can be accomplished above the low water mark. General Conditions requirements for NWP - 3 The following are terms and conditions set by the Corps as "general conditions". Under each condition there is a written response verifying that our project falls under these conditions 1) That the activity may not cause more than a minimal adverse effect on navigation. There are no proposed effects on navigation activities on Castle Creek or the Roaring Fork River. At the time of the proposed work, the river will have receded to a point below the work azea. 2) That the structure offrll will be properly maintained. The proposed activity is part of a normal maintenance program for stabilized banks in Colorado. Maintenance has been continuous over many years but the Applicant seeks to rehabilitate the wall at this time to correct rock movements and to preserve the wall's overall integrity into the future. 3) That appropriate erosion and siltation controls will be used and maintained during construction. The bulk of the work to be completed will be above the low water line of the river. Coconut wattles or straw bales will be used to control possible run-off from the wall work area. Much of the work will be completed by hand laying of the rip rap and wherever possible, small equipment will be used to set anchor stones from the top of the wall. 4) That any activity shall not substantially disrupt the movement ojindigenous aquatic species unless the primary purpose of the fill is to impound water. Proposed activities are not anticipated to disrupt the movement of any indigenous aquatic species nor to impact the quality of water during the project. The work is proposed to be completed in October 2006 during low river conditions and it is possible that all work will be above the low water mazk. 5) That heavy equipment must be placed on mats or other measures taken to minimize soil disturbance. Equipment used to dredge the pond will access the wall area via the owner's property. To the C O extent possible, equipment will be small due to limited access and need and work on the wall is proposed to be accomplished from the top of the bank to the extent possible. Minimal work may be required from stream side where an existing gravel bench exists above the average low water mark. ti) That the actively complies with regional and case specific conditions. This activity complies with all regional and case specific conditions. 7) That the activity will not occur in a component of the National Wild and Scenic River System, nor in a river officially designated by Congress as a "Study River"for possible inclusion in the system while the river is in an official study status. Castle Creek and the Roaring Fork Rivers are not part of the National Wild & Scenic River System, nor will this activity affect any wild or scenic river. 8) That the activity will not impair reserved tribal rights, including, but not limited to, reserved water rights and treaty fishing and hunting rights. This activity will not impair any protected federal reserved rights or tribal rights. 9) That in certain states and individual state water quality certification must be obtained or waived. All work will be done in low water conditions and is not proposed to create any impacts to water quality. Wattles and straw bales will be used to contain disturbed soils and no dispersion or sidecast of soils into the river will be made. 10) That an individual state coastal zone management consistency concurrence must be obtained and waived in certain states. Not applicable in Colorado Il) That the activity will not jeopardize a threatened or endangered species as identified under the Endangered Species Act, or destroy or adversely modify the critical habitat of such species and, if the presence or proximity of endangered species is known, non-Federal permittee must notes the Corps and wait for its approval No known Endangered Species reside in the area of this activity and no critical habitat will be impacted. 12) If the activity may adversely affect historic properties which the National Park Services has listed on, or are or may be eligible for listing on, the National Register of Historic Places, that the permittee shall notes the Corps and wait for its approval No historic places on the property will be adversely affected by the construction proposed under this permit. 13) Where notification is required, that the permittee has compiled with the specific notification provisions, including a delineation where required. A proposed mitigation plan may also be submitted with the "Pre-Construction Notification" or PCN. This is the notification for this project. I4) Compliance Certification - The permittee who receives a Nationwide Permit Verifzcatron must submit a signed certification regarding the completed work and any required mitigation. N/A. The project does not require a Nationwide Permit Verification but photographs will be taken prior to work being undertaken and upon completion of work. All documentation of work undertaken and completed will be maintained by Beach Environmental. I S) Use of Multiple Nationwide Permits -The use of more than one NWP for a single and complete project is prohibited. Not applicable for this project. Only work under an NWP no. 3 will be completed. 16) Water Supply Intakes - No activity, including structures and work in navigable waters of the U.S. may occur in the proximity of a public water supply intake except where the activity is for repair of the public water supply intake structures or adjacent bank stabilization. The activity will not be in the proximity of a public water supply intake. I7) Shellfish Beds - No activity may occur in areas of concentrated shellfish populations. The activity does not occur in areas where shellfish are present. I S) Suitable Material -Fill materials may not consist of unsuitable material such as trash, debris, car bodies, asphalt' etc.. Materials used for construction must be free from toxic pollutants. Fill placed in any waters of the United States will consist only of angulaz rock to support the stabilization wall. 19) Mitigation -The project must be designed and constructed to avoid and minimize adverse effect to waters of the US to the maximum extent practicable. Mitigation will be required when necessary to ensure that the adverse effects to the aquatic environment are minimab The project will be completed to minimize impacts to waters of the U.S. No mitigation is necessary for this project. 20) Spawning Areas -Activities including structures and work in navigable waters of the United States or discharges of dredged or fill material, in spawning areas during spawning seasons must be avoided to the maximum extent practicable. This activity does not affect any spawning azeas and is proposed to occur outside of normal spawning seasons. 21) Management of Water Flows - To the maximum extent practicable, the activity must be designed to maintain pre-coustructiou downstream flow conditions. Furthermore, the activity must not permanently restrict or impede the passage or normal or high flows. The project will not affect downstream flow conditions or restrict normal or high water flows. 22) Adverse Effects from Impoundments - If the activity ,including structures and work in navigable waters of the US or discharge creates an impoundment of water, adverse effects to the aquatic system caused by accelerated passage of water shall be minimized to the maximum C extent practicable There aze no adverse effects by this project on any other impoundments. 23) Waterfowl Breeding Areas -Activities into breeding areas shall be minimized to the maximum practicable extent. This project does not affect waterfowl breeding azeas. 24) Removal of temporary fills -Any temporary fills must be removed in their entirety and the affected areas returned to their preexisting elevation. No temporary fills are proposed. Fill used to create a foundation for the stabilization wall will approximate the material removed from the existing wall so minima] or no change will occur. 25) Designated Critical Resource Waters -Projects are not authorized in critical resource waters without public approvaG This azea of the Roazing Fork River does not qualify as "critical resource waters." 26) Fills within 100 year Floodplains -Above grade fdls within the 100 year floodplain are not authorized by NWP 29, 39, 40, 42, 43, and 44. For NWP 12 and 14, the permittee must notify the District Engineer in accordance with General Condition 13 and document that any permanent above grade fills in waters of the US within the 100 year floodplain comply with FEMA construction requirements. No additional impacts to the floodplain are proposed and therefore no permit is necessary. Material removed from the floodplain will be replaced with similaz quantities so a balance is created. Proposed Modifications to the Structure After review of the Mascotte stream bank stabilization wall, two minor modifications to the exiting wall are proposed. A brief description of each follows. Anchoring Stones: Existing anchoring stones (a.k.a. toe stones) are rounded by river action and will be replaced with angular stones. These stones will be set at the same elevation as the existing anchor stones and will be similaz in size to those removed. Additional rip rap above the ordinary high water mazk may be changed to incorporate more angular rock in place of rounded river rock to establish a more secure wall. Fabric backing: The wall does not currently have any protective barrier to hold soils, gravels, sands and fines in place behind the stabilization wall. A fabric liner will be installed below the anchoring stones and then laid upon the top of the bank. Stones removed from the rip rap wall will be placed over this fabric and laid up to the same elevation that exists today. The fabric will be overlain at the top of the wall by a sod mat, which presently exists. C v No other modifications to the existing stabilization wall are contemplated at this time. The wall height, depth, material type (except as noted previously) will remain the same. No additional fill is proposed, and all work will be completed in as brief a period as possible.
