HomeMy WebLinkAboutcclc.min.060601 COMMERCIAL CORE & LODGING COMMISSION MINUTES OF JUNE 6, 2001 Chairperson Jon Busch called the meeting to order at 8:30 a.m. In attendance were Eric Cohen, Bill Dinsmoor, and John Start. Terry Butler was excused. COMMISSIONER COMMENTS Eric informed the board that the Butcher Block situation has not changed. Staffwas directed to contact Ed Sadler and Nick Adeh. If there were a rectangular table against the wall with seating they would be fine. But what they have are roundtables and as soon as someone sits there they pull the table back and go into the sidewalk. The chairs pushed into the tables encroach. John Starr said there is a sandwich board at the Grottos and one at Aspen Sports in the public right-of-way. With the sandwich board it is impossible to walk through the area between the tree and fence at the Grottos. The Aspen Sports sign is advertising Taylor Fly-Fishing. Eric: Hamilton Ski Shop which is the Ute city cycles in the summer has promotional signs being placed on the cycles and above Ross Andrews jewelers on Durant St. Jon said more and more people are putting sandwich boards in front of their stores. Jon said over Boogies Ice Cream shop there is a neon sign which is totally visible from the sidewalk. Jon also said the streetlights at Independence Square needs straightened up. Bill stated that the old Gracy's store is advertising liquor in the newspaper for their openings. Staffwas directed to look into this. Kathy Strickland relayed that in order to give or sell liquor to the public a special event permit is needed. In order to qualify for a special event you have to be sponsored by a non-profit organization and the process takes 30 days. COMMERCIAL CORE & LODGING COMMISSION MINUTES OF JUNE 6, 2001 Jon suggested that we revisit the issue regarding wine and the art studios. Eric said it is how you are handling the situation. If you are opening a few bottles at a showing it probably is not that big a deal because the people who are coming are much more interested in the art but if you are promoting a grand opening party celebration with music etc. you are dealing with a different animal. People are coming for the party. John stated regarding the document that was presented at the meeting with Steve Barwick the Farmers Market was not included. The board felt that it should be included. Bill suggested that if the permit for the Farmers Market is presented to Community Development it should be kicked back to the CCLC. Jon said they mentioned that to Steve Barwick and he indicated that they are reviewing procedures and permits with Community Development. John suggested that we have Janice Voss come to the CCLC meeting to express interest in the review process of the Farmers Market. John said Steve was going to tell Janice'that the CCLC was interested in increasing our oversight function as it was previously. NEWSRACK ORDINANCE John said the proposed ordinance specifies where the news racks can be and it mentions the specific type of modular racks that are acceptable. The other issue was the shopper and they were to have their own place. John Worcester, city attorney said as long as we had a provision for them then it was acceptable. Bill said if he or someone else desires to have a condominium rack at his comer would be precluded by this. 2 COMMERCIAL CORE & LODGING COMMISSION MINUTES OF JUNE 6, 2001 John said the DEPP racks are condominium racks and the enclosure limits the number of newspapers you can have. The attorney said that is OK as long as we have a way to deal with the overflow and the shoppers. Maybe we take the condominium rack concept and in specific locations state that this is what it has to be in the high volume locations. If there is an obscure area they wouldn't have to be condominiumized. This is just a thought. Jon said he felt that the boundary for the condominium rack should be the commercial core. Kathy Strickland, chief deputy city clerk stated that she felt the condominium racks should be required wherever needed in the city. The CCLC would review the area as to whether a condo rack is needed at that specific site. Bill said there are areas that we could consolidate and clean up. John suggested that we contact the Aspen Times and have the specific locations identified by their personnel (Luke). Luke will know what areas that are needed and which ones should be eliminated. Kathy suggested that a photograph of each existing area be taken. John said the Lime Lite as six racks in front and the Hickory House also has numerous racks. Would be require them to have a corral? Jon said he would put it outside of the commercial core if someone requests condominium racks they have to conform to the condominium guidelines. 21.36.040 Bill said maybe it should say everyplace unless exempted. Jon said he would be happy to just clean up the downtown. John Starr relayed that it would be doubtful if we could get the funding for outside the core. The board felt that the city should provide the corral and pedestals. COMMERCIAL CORE & LODGING COMMISSION MINUTES OF JUNE 6, 2001 Kathy Strickland informed the board that she conversed with administration and they were affirmative regarding the pedestals. The vendors would pay for the racks themselves. The corral is costly and that would be a concern with regard to the budget. Eric felt that the ordinance should be citywide. Jon said he felt that the ordinance could be citywide but in terms of the enclosures they do not need to be city side. John said you only need corrals where things spill out. You do not need a corral if there are only four racks. An example would be Lime Lite situation. Bill said you would need a corral with 12 or more boxes. John said that would give Hickory House, Vinh Vinh, Main Street Bakery an opportunity to have a corral. An exemption would be private property. Jon said the city would not adopt something that is open-ended. The board directed staff to get estimates regarding the construction of the corral. John said we also would need to count how many we would be need. Jon said he is not willing to go outside the core for the corrals. We need something concrete to take to council. Jon said he sees this as a budget item for next year. Kathy said we have about 5,000 in contingency. Jon said that would be about the cost to design a corral. CCLC budget could purchase a few pedestals each year. John said we would specify locations where corrals would be required 21:36.040 and insert them in the ordinance. The petition would state the need etc. John said CCLC could say you are right and you either pay for it or it is in the budget. Bill said tenants would be apprehensive to make an investment for their landlord. John the open space board has heard that there is a backlog for requests for memorial benches. Possibly the corrals could be incorporated with a memorial plaque. Bill said on the short side of the corral maybe a bench should be incorporated on the short side. Have the corral redesigned. Kathy Strickland said the Parks Department has the lists for memorial benches. Jon feels that everyone likes the corrals. There are cost savings by doing them in volume. Jon also stated that we could do an annual appropriate in the CCLC budget. Staff was directed to get estimates on the design of the corral. Bill said the design could be less with a different kind of metal, possibly fiberglass. John said 030 needs to be amended to state citywide. 21.36.040 needs to state that any area with 12 or more racks needs to be in a corral. Jon reiterated that the newspapers would get upset if we do the condominium racks citywide. Staffreiterated that we are only looking at where 12 or more racks exist. Everywhere else new individual news racks would exist. 5 COMMERCIAL CORE & LODGING COMMISSION MINUTES OF JUNE 6, 2001 Bill said the removal of racks is specified in the ordinance. Staff said if racks need changed out a year could be established to comply. Kathy Strickland said eventually there are going to be areas outside the core that corrals and pedestals are needed due to the growth pattern of Aspen. Staff was directed to ask John Worcester if the ordinance should be citywide and if CCLC should be reviewing the removal or placement of racks outside the core area. Should this be commercial core only or citywide? Eric said maybe we limit it to the commercial core and add a paragraph at the end pertaining to future decisions. Kathy Strickland, Chief Deputy said Engineering would be reviewing the placement of the racks since they are in the public right-of-way. Jon said CCLC needs to be the main reviewing body for the commercial core regarding the racks and Engineering or the City of Aspen will do everything out of the core area. Eric suggested we get a map with locations and number of the newsracks in each location. The board requested Luke from the Aspen Times to be at the next meeting.
