Having gone through this exercise to show that our expansion and remodeling proposals are basically in compliance with the limitations set by the Zoning Code, let me address the real issue, and that is the inadequate facility we are presently operating. Through our remodeling we are attempting to do three things. 1. By adding 1200 SF to the front we hope to relieve some of the congestion at the checkout area. The present situation is an insult to our custom- ers. 2. By relocating storage and some of our operations to the basement we are expanding our sales floor to bring a better variety of goods to the cus- tomers. In order to do this, we are assuming a burden on ourselves by using the basement. 3. The present toilet and lounge facilities are inadequate to say the least, and our employees deserve at least what we propose. 6 4..s T0: Planning & Zoning Commission -2- August 21, 1980 Finally, we need to look at the parking problem. We presently have 33 spaces. Our 1200 SF addition would not decrease this number. This space is presently being used by direct vendors (Pepsi, potato chip, etc. trucks) which will in the future be required to use the rear loading area. This will help to de- crease the congestion in the front of the store. From the zoning it is my understanding that we need to add 13 more spaces (because of the 3400 SF addi- tion and expansion). This we cannot do because of space limitations. Speak- ing for the president of City Market and the present store manager we estimate that as many as fifty percent to seventy percent (during the winter season) of the store's customers don't use the parking facility, that they either walk or take a cab. This percent is what we would expect from a neighborhood business, reflecting the desires of the Planning and Zoning Board. We don't anticipate any more customers than at present because of this expansion program. Only an overall increase in the general population, summer and winter, of Aspen would make this situation change. Starting at the southwest corner of our building the garden display would extend 50 feet south along the west facia. 16 feet would be left open to allow people easy access to and exit from the building. To the north of the entrance the garden display would continue another 24 feet with 10 feet left for the phone booth and a bike rack. This display would rest on pallets that would extend 4 feet from the building. This would be within the 6-foot wide sidewalk that now runs the length of the west side of the building. The 17 feet of 3riveway which runs in front of this display would be unaffected. Also the 35 ex- isting parking spaces would remain unaffected. All merchandise would be kept at a level of height so as not to impede the vision of anyone walking or driving in the area. The most square footage that this display might occupy at any time would be 296 square feet. This display would never exceed the param- eters set forth in this request. The existing gross floor area of the store is 14,321 square feet. (This includes basement, storage and receiving area and deducts for access to the basement restaurant.) The existing sales floor is 11,217 square feet. The existing parking and driveway area is 12,500 square feet including the 6-foot wide sidewalk that the garden display would sit on. At one time we had decided not to pursue selling garden items in front of our store, However, so many customers have expressed their desire to have these items available at City Market we feel compelled to request your permission to do so. I believe this will clear up a lot about our proposed remodeling and hopefully allow us to appear only before the Board of Adjustments con- cerning our parking problem. Through an addition of 1200 square feet to the front of our store and extensive remodeling both on the ground floor and the basement, we pro- pose. to do the following changes in our building square footage: 1) Increase our sales floor to 10,355 sq. ft. 2) This will leave 2,957 sq. ft. of "storage and accessory uses" (sec. 24-3.6 (d)) on the ground floor. 3) We also intend to utilize 1370 sq. ft. of the basement for "accessory uses" i.e. meat preparation, toilets, lounge and office. The total of these three figures is 14,682 sq. ft., within the allowable 15,000 sq. ft. limits set by Sec. 24-3.6 (d). The remainder of the now vacant basement will become storage, (dry goods, meat, and frozen items). According to the introduction to section 24-3.6 "commercial businesses shall be restricted to a maximum gross floor area, excluding any basement area used exclusively_for storage (except commercial storage) purposes ---". I interpret "commercial storage" to mean warehousing, or else all storage for commercial uses would fall into "commercial storage" and this exclusion wouldn't make sense by its contradictory nature. Therefore, I hope you will agree that our proposed addition and remodeling in no way violates the present Aspen Code and that we may proceed in our attempt to upgrade this facility in a manner compatible to the high standards of both the City of Aspen and City Market. Yours truly, ~~~~ David Mack Corporate Architect cc: Building Inspector T0: FROM: RE: DATE: Planning and Zoning Commission (Aspen) Sunny Vann, Planning Office City Market Request for Variance, Use Square Footage Limitations August 25, 1980 The applicant is requesting a variance form the use square footage limitations of Section 24-3.5 of the Municipal Code in order to remodel and expand City Market. Such variances may be granted by P&Z should it determine that there are "practical difficulties or unnecessary hardships created by their strict application, or that public need and demand require an increased floor area fora particular use". Section 24-3.6(d) limits food markets to 12,000 square feet in gross floor area with an additional 3,000 square feet permitted for storage and accessory uses. In general, the applicant wishes to construct a 1,200 sq. ft. addition to the front of the Market and extensively remodel both the ground floor and basement. The 1,200 sq. ft. addition is designed primarily to relieve existing congestion in the vicinity of the checkout area while relocation of a portion of the Market's storage and the meat prep areas to the basement will allow expansion of the sales floor. The basement will also contain a small office and employee toilets and lounge. The Planning Office and Engineering Department have reviewed the applicant's request and offer the following comments: 1. Summarizing the attached floor area statistics, City Market proposes to expand their existing operation, which currently comprises approxi- mately 12,000 sq. ft, and is confined to the ground floor, to approxi- mately 15,500 sq. ft. via a 1,200 sq. ft. addition and the utilization of approximately 2,300 sq. ft, of undeveloped basement. While there are minor errors in the applicant's floor area tabulations, the end result is essentially the same. After deduction of eligible storage areas (approximately 2,800 sq. ft.), the expanded and remodeled market exceeds the 12,000 sq. ft. maximum gross floor area limitation by approximately 700 square feet. 2. City Market is located on nine city lots (27,000 sq. ft.) which are zoned NC, Neighborhood Commercial. With the exception of the FAR (1 :1) and open space requirements (25 percent), all area and bulk require- ments are established via the PUD process. The off-street parking requirement is 4 spaces per 1,000 square feet of gross floor area. 3. Based on the above criteria, the existing City Market is nonconforming with respect to both parking and open space. The current 12,000 sq. ft. market requires 48 parking spaces of which 33 are available. The proposed expansion would increase the parking requirement to approxi- mately 62 spaces with no provision for additional parking. Furthermore, the 1,200 sq. ft, addition would necessitate a reduction in that portion of the existing parking lot devoted to vehicular and pedestrian circu- lation, thus exacerbating an already significant congestion problem. While nonconforming structures may be enlarged, expansions cannot increase the existing nonconformity. Inasmuch as City Market's proposed modifications would substantially increase parking requirements, and hence the degree of nonconformity, no expansion can occur without an accompanying reduction in required parking from the Board of Adjust- ment. With respect to open space, approximately 6,700 sq. ft. is required of which, for all practical purposes, none currently exists. Recommendation: Given the relatively minor variance requested by the applicant (approximately 400 to 700 sq. ft. depending on how the proposed remodeling is tbbulated), the Planning Office would ordinarily recommend approval since it could be realistically argued that there are "practical difficulties or unnecessary hardships" created by the strict application of the floor area limitations. Similarly, a minor expansion such as the one proposed does not jeopardize the concept of a food market as a strictly neighborhood commercial use. However, in view of City Market's existing parking deficit (15 spaces), and the addi- tional 14 spaces which the proposed expansion would require, we would be Aspen Planning & Zi ig P. 2 City Market 8/25/80 remiss in recommending approval of the requested variance. The applicant's argument that approximately 50 percent of the Market's customers are pedes- trians or utilize a cab is noteworthy in that it would appear that auto disincen- tives are working. However, the standard of 4 parking spaces per 1,000 sq. ft. of neighborhood commercial space represents a reasonable requirement given the nature of NC uses, and therefore, should not be ignored. The Planning Office, therefore, recommends that the applicant's request for a variance from the use square footage limitations be denied. The garden display would rest on pallets that would extend four feet from the building within the six-foot wide concrete sidewalk running the length of the west side of the building. Sixteen feet across the entrance and exit doors and ten feet for the bicycle rack and telephone booths would be left open. PLANNING OFFICE REVISiI: BACICGROOND: On August 28, 1980 City Market obtained a variance from the Planning and Zoning Commission to expand the operation by approxi- mately 3700 square feet. This included a 1200 sq.ft. addition to the front of the store and remodeling of the existing 2500 sq.ft. base- ment. One of the major concerns raised at that time was the defi- ciency of parking spaces required in a neighborhood commercial zoned area. In February, 1981 City Market requested approval of it's PUD appli- cation including a reduction of the parking requirements and waivers to the open space requirements in the NC zone district. The Planning and Zoning Commission recommended approval of the conceptual PUD as well as the Preliminary Plat subject to compliance with a reduced number of parking spaces for efficiency in movement and safety purposes. On May 26, 1981 City Council approved the final plat submission and an application for an encroachment license allowing planters within the parking area, the awning over the Steak Pit Restaurant, and fencing and storage adjacent to Original Street. The current parking lot configucation including 35 parking spaces was approved at that time. APPLICABLE SECTION OF EONING CODE: Section 24-8.26 (a) of the Municipal Code provides criteria by which minor amendments to approved PUD plans can be approved by the Planning Director. Section 24-8.26 (b) provides the criteria by which City Council can amend the PUD plan after review and recommendations by the Planning and Zoning Commis- sion, stating that.... " ..if they (the amendments) are shown to be required by changes in conditions that have occurred since the final plan was approved or by changes in community policy. Any changes approved in the final plan shall be recorded as amendments to the final plan in accordance with the procedures established for the filing of the initial approved documents." (Section 24-8.26 (b)). The applicant chose to request a PUD amendment. from the Planning and Zoning Commission. In the opinion of the Planning Office, this route was the most appropriate way to request changes in its PUD plan, given the potential impacts of this change on circulation and open space on the site. MAJOR ISSUES AND CONCERNS: A. Referral Agency Comments 1. The Engineering Office - In a memo dated 5-17-85 the Engineering Office made the following comments about this application: a. What would the applicant do with the newspaper stands, trash canisters, and the shopping carts stored in the area proposed for the garden display. b. The display would use four feet of the six feet sidewalk, and would leave adequate room in the adjacent driveway for pedestrian traffic. c. The display would not reduce the number of parking spaces. d. The area has been used for the same purpose in past summers. 2. The Building Department - In a conversation with the Zoning Inspector on 5-28-85 concerns were expressed on the follow- ing matters: a. Would the applicant use any portion of the parking lot for garden display or other non-parking functions. b. Would the applicant place any items in the garden display area during the winter. B. Staff Convents The reason given by the applicant for requesting this amendment to the PUD is that many customers have expressed their desire to have garden- related items available and so City Market feels compelled to request permission to provide these goods. The Planning and Zoning Commission could consider this to be a legitimate "change in conditions that have occurred since the final plan was approved..." (Section 24-8.26 {b)). The front area of the City Market store, including the parking lot, tends to be congested because of the limited number of spaces, the narrow moving/emergency lanes, and the numerous pedestrians, bicycl- ists, and motorcyclists in addition to automobile drivers who come to the store. The parking lot has been one of the major issues in past reviews of City Market's PUD plan, as noted in the Background section above; and parking will continue to be a problem, with little doubt. Due to the limited space, it is important that the garden display does not infringe on the parking or driveway area. The four feet wide area proposed by the applicant for the display area would not infringe on this space, and thereby would not significantly change the existing traffic flow or parking arrangement in the parking lot. The entrance and exit doors span a distance of approximately sixteen feet, which is the distance to be left open from the garden display. This designated entrance area would not be adequate for the existing trash canisters located on both sides of the doors. The space to be left open for the bike rack and phone booths should be adequate. Regarding shopping carts, it is the applicant's responsibility to remove them from moving lanes or parking spaces. The newspaper racks presently located in the southern portion of the proposed garden display would appeac to be in the way of the garden display. City Market has considered several options of what to do with the news racks, and should specify what it intends to do with them. City Market has indicated in the winter this display area may contain a wood box not to exceed four feet in width and longer than 10 feet. If the entire display area proposed for summer use were used in the 2 winter, then snow removal could be hampered and cause further con- gestion of the front area of the store. The winter use area actually proposed does not appear to cause these problems. RECOMMENDATION: The recommendation of the Planning Staff is that you recommend approval of the requested amendment by City Market with the following conditions: 1. They haven't commented on what they propose to do with the newspaper stands, a trash canister, and the shopping carts that are stored in that location. The display would use about 4 feet of the 6 feet sidewalk. This decreases the pedestrian access, but does not totally eliminate it. The adjacent driveway is wide enough to accomodate an increase in pedestrian traffic. This does not reduce the number of parking spaces in City Market. This area has been used in past summers for this same purpose with no objection from this department. On May 26, 1981 City Council approved the final plat submission and an application for an encroachment license allowing planters within the parking area, the awning over the Steak Pit Restaurant, and fencing and storage adjacent to Original Street. The current parking lot configuration including 35 parking spaces was approved at that time. APPLICABLE SECTION OF ZONING CODE: Section 24-8.26 (a) of the Municipal Code provides criteria by which minor amendments to approved PUD plans can be approved by the Planning Director. Section 24-8.26 (b) provides the criteria by which City Council can amend the PUD plan after review and recommendations by the Planning and Zoning Commis- sion, stating that.... " .. if they (the amendments) are shown to be required by changes in conditions that have occurred since the final plan was approved or by changes in community policy. Any changes appcoved in the final plan shall be recorded as amendments to the final plan in accordance with the procedures established for the filing of the initial approved documents." (Section 24-8.26 (b)). The applicant chose to request a PUD amendment. from the Planning and Zoning Commission. In the opinion of the Planning Office, this route was the most appropriate way to request changes in its PUD plan, given the potential impacts of this change on circulation and open space on the site. NA.70R ISSUES AND CONCERNS: A• Referral Agency Comments 1• The Engineering Office - In a memo dated 5-17-85 the Engineering Office made the following comments about this application: a• What would the applicant do with the newspaper stands, trash canisters, and the shopping carts stored in the area proposed for the garden display. b. The display would use four feet of the six feet sidewalk, and would leave adequate room in the adjacent driveway for pedestrian traffic. c. The display would not reduce the number of parking spaces. d. The area has been used for the same purpose in past summers. 2• The Building Department - In a conversation with the Zoning Inspector on 5-28-85 concerns were expressed on the follow- ing matters: a. Would the applicant use any portion of the parking lot for garden display or other non-parking functions. b• Would the applicant place any items in the garden display area during the winter. B. Staff Comments The reason given by the applicant for requesting this amendment to the PUD is that many customers have expressed 'their desire to have garden- related items available and so City Market feels compelled to request permission to provide these goods. The Planning and Zoning Commission could consider this to be a legitimate "change in conditions that have occurred since the final plan was approved..." The front area of the City Market store, includinglthe24-8.26 (b)). tends to be congested because of the limited number of spacens, lthe narrow moving/emer'gency lanes, and the numerous pedestrians, bicycl- ists, and motorcyclists in addition to automobile drivers who come to the store. The parkinc lot has been one of the major issues in reviews of City Market's PUD plan, as noted in the Background section above; and past parking will continue to be a problem, with little doubt. Due to the limited space, it is important that the garden display does not infringe on the parking or driveway area. The four feet wide area proposed by the applicant for the display area would not infringe on this space, and thereby would not significantly change the existing traffic flow or parking arrangement in the parking lot. The entrance and exit doors span a distance of approximately sixteen feet, which is the distance to be left This designated entrance area would notobenadequateeforrthe existing trash canisters located on both sides of the doors. The space to be left open for the bike rack and phone booths should be adequate. Regarding shopping carts, it is the applicant's responsibility to remove them from moving lanes or parking spaces. The newspaper racks presently located in the southern portion of the proposed garden display would appear to be in the way of the garden display. Cit Market has considered several options of what to do with the news racks, and should specify what it intends to do with them. City Market has indicated in the winter this display area may contain a wood box not to exceed four feet in width and longer than 10 feet.
